2. This is the interesting part. The statement says that the laws should prohibit IDEAS that violate the Civil Rights Act of 1964.
The Civil Rights Act of 1964 does not BAN IDEAS.
As a country, we should not be in the business of banning ideas.
3. But it is revealing of the fundamental nature of the anti-CRT movement. It is a blunt attack against the concept of free expression.
4. This is exactly how these bills played out in practice. I documented how this week a right-wing group is using an anti-CRT law in Tennessee to try to prevent second graders from learning about MLK.
1. In 2021 a slew of dark-money groups were formed to drive opposition to Critical Race Theory. They are organized as non-profits, which means their donors can stay secret.
But the public is entitled to some information about these groups, including how they spend their money
2. The problem, however, is that the disclosure system for non-profits is a joke. Organizations formed in January 2021 or later don't have to file their first 990 until NOVEMBER 2022.
There is really no justification for this.

A Tennessee chapter of "Moms for Liberty" filed a complaint with the Tennessee Department of Education alleging that assigning 2nd Graders a book about MLK Jr's March on Washington violated the state's new law banning Critical Race Theory
The Tennessee Department of Education declined to "investigate" but for a technical reason. The complaint dealt with curriculum during the 2020-21 school year and not the current school year.
So Moms for Liberty could refile the complaint and they might be successful next time. Their issue with the MLK book are two images that are historically accurate.
