A new order from Judge Amy Berman Jackson suggests the question of whether Danny Rodriguez's full confession gets admitted may all boil down to whether he definitively says "no" in this clip.
Was it though? Judge for yourself. Seconds after a muffled and simultaneous “no,” he’s saying he’s “pretty ashamed” and goes right on talking:
Not even clear it’s a “no” honestly, he just makes some sort of noise.
"Any further briefing by the government on the question of whether the defendant unambiguously asserted his right to cut off questioning is due by December 8, 2021.”
Here's a zoomed in version. Danny Rodriguez does shake his head no, but is talking about how he's "ashamed" just seconds later.
“They take a Danny Rodriguez interview, and they see that oh, this guy’s a moron. He’s a sad person who’s kind of pathetic in a way, and they think, ‘How bad could Jan. 6 really have been?’ They’re not looking at the big picture.” huffpost.com/entry/mike-fan…
Hindsight being 20-20, a yes-or-no question that gave him an opportunity to bail once he already signed the Miranda form wasn’t the best strategy at that moment. Better to ask an open-ended question and get him to accept the premise.
Here’s how it shows up in the transcript, but on video it doesn’t seem like Danny Rodriguez gets a “no” in before the agents starts speaking. He does shake his head though.

“Most of the people on the ground are buffoons, so what? There are 15,000 of them.”
In case you missed it: Officer Mike Fanone tells me the “moron” who electroshocked him on Jan. 6 was manipulated by Trump: huffpost.com/entry/mike-fan…
There’s a key hearing in the Danny Rodriguez case this week:
Josiah Kenyon, a 34-year-old man from Nevada, assaulted law enforcement on Jan. 6 while dressed as Jack Skellington from The Nightmare Before Christmas, feds say. #pinstripeboilersuit
"employees of the motel… confirmed a subject wearing a Jack Skellington costume from The Nightmare before Christmas was a guest on or around January 6, 2021.” justice.gov/usao-dc/press-…
"The cost to replace the damaged window was $41,315.25, including, materials, labor, and installation.”
U.S. Marines reservist Marcos Panayiotou stormed the Capitol in a "MAKE POLITICIANS AFRAID AGAIN" hat, feds say.
"the FBI interviewed another close family member of PANAYIOTOU (hereinafter “Person #3”), who stated that PANAYIOTOU... “does stupid things sometimes.” storage.courtlistener.com/recap/gov.usco…
Coming to an OPSEC training slideshow soon: the former Marine who stormed the Capitol in a “Reparable Management Company – 1st Maintenance Battalion, Camp Pendleton, CA” hoodie.
"Marquez then held his vape pen up to the camera, as if to capture the arrogance of the rioters… smoking in a senator’s office during an Electoral College certification proceeding to formally elect the next President of the United States.”
NEW: Michigan’s Justin Jersey — aka #Fingerman — was one of the Jan. 6 attackers who helped kick off the online manhunt for Capitol rioters back in January.
One of his codefendants on the superseding indictment is a fellow Michigan resident IDed through similar means: huffpost.com/entry/logan-ba…
Justin Jersey is charged in a superseding indictment, so there’s no FBI affidavit laying out how this case was built. There is, however, this twitter thread:
