It's Tuesday and I'm at the Moakley courthouse for the #LieberTrial. The prosecution is expected to call their last witness at 9 am ET. Afterwards, we'll hear from the defense.
The prosecution is now calling Sarah Axelrod, who is Harvard's assistant vice president at the office of sponsored programs. Her office is responsible for reviewing grant proposals.
Axlerod testified about the documents principal investigators sign when they submit grants saying everything in the grant is complete, accurate, and truthful to the best of their knowledge.
Prosecution offers documents Lieber signed in 2008 and 2013 saying the information in the grants was complete, accurate, and truthful.
On cross examination, defense attorney Torrey Young asks Axelrod if she knows if Lieber has seen those documents since 2008 and 2013, and Axelrod says she does not know.
The prosecution is finished presenting evidence. Now the defense has called Anqi Zhang, who did her PhD in Lieber's lab from 2014 - 2020. She is now a postdoc at Stanford.
Zhang is testifying about her time in the Lieber lab. She says she did not collaborate with researchers at Wuhan University of Technology and that WUT research was very different from what was going on in the Lieber lab.
Zhang is saying the Lieber, who was diagnosed with lymphoma in 2015, was very sick in 2018. "I noticed that he was not in the lab very often."
On cross examination, Assistant US attorney JR Drabick asked Zhang about affiliations on publications and had her read Lieber's affiliation on one paper where he lists Wuhan University of Technology. Zhang is not a coauthor on that paper.
With that, the defense rests and the jury has left the courtroom.
Now the defense is making a motion for acquittal, which the judge has denied.
The jury has been excused and the lawyers are now discussion what instructions Judge Rya Zobel will give to the jury.
Closing arguments are beginning with assistant US attorney Jason Casey speaking first.
Casey is saying the charges against Lieber and the evidence that supports those charges.
He is starting with charges of not reporting a foreign bank account, pointing to Lieber's FBI interview in which he said he thought he had about $200,000 in an account in China.
Casey is saying Lieber did not want to pay taxes on that money which was why he kept the bank account in China.
Now, Casey is speaking about the tax charges and that Lieber received income from Wuhan University of Technology that he did not report on his taxes.
Now Casey is outlining the false statements charges.
He is first talking about the statements Lieber made to Harvard saying he was never a participant in the Thousand Talents Program.
Now Casey is talking about statements Lieber made to investigators from the US Dept of Defense
Casey repeatedly points to statements Lieber made during his post-arrest interview with FBI in which he said he'd not been transparent with the DOD investigators.
Now defense attorney Marc Mukasey is giving his closing argument, saying the gov't's case is based on weak links: a mystery man the gov't can't produce, a so-called contract, and the video clips from the interview with the FBI.
Mukasey says he wants the jury to review the videos because they are "a muddled mess of misunderstandings and mistakes"
Mukasey says that the discussion of the thousand talents program during interviews probably lasted a couple of seconds. “The world’s greatest nanoscientist is facing multiple felonies over a discussion that lasted a nanosecond,” Mukasey says.
Jason Casey is giving a final argument.
Now the Judge Zobel is suspending proceedings. She will give the jury instructions after lunch.
Zobel has given her instructions to the jurors. They are now beginning their deliberations.
I do not know if the jury will finish today. If they do, I will report what happens.

Question seems to be: if the jury is not unanimous on one count do they have to find not guilty? The answer is no.
We hear the jury has a verdict. Mukasey remarked "that was quick"

Judge Rya Zobel has left the courtroom to thank jury for their service.

It's Monday and I'm back at the Moakley courthouse in Boston for the #LieberTrial. Proceedings should begin at 9 am EST when defense attorney Marc Mukasey will resume cross-examination of FBI special agent Kara Spice.
Mukasey is asking Spice about the unsigned contract that is supposed to have come from the Thousand Talents Program. She says she has never seen an executed copy of the document.
The FBI took a photo of Chinese noodles from the Lieber home.

I'm back at the Moakley courthouse in Boston for another day of the #LieberTrial. I wish I could take a photo from the lobby outside the courtroom. The view of Boston Harbor is splendid on this sunny day. Testimony should begin at 9 am EST with FBI agent Kara Spice.
The gov't is pointing out Lieber's affiliations on publications and the funding agencies in the acknowledgements section. Today it is a Nature Nanotechnology paper. Yesterday it was NanoLetters.
The gov't presented emails from Lieber in 2013 and 2014 which he is unhappy about not being selected as a foreign associate to the Chinese Academy of Sciences

Back at the Moakley courthouse in Boston this morning for Charles Lieber's trial. Opening statements are scheduled to begin at 9 EST.
