🚨BREAKING: Supreme Court BLOCKS Biden's unconstitutional forced vaccine mandate - “OSHA has never before imposed such a mandate. Nor has Congress.”

Only 3 liberal justices - Breyer (Clinton), Kagan, and Sotomayor (Obama) - dissented on the OSHA mandate.

"The [mandates] exemptions are largely illusionary... The regulation otherwise operates as a blunt instrument. It draws no distinctions based on industry or risk of exposure to COVID–19. Thus, most lifeguards and
linemen face the same regulations as do medics and meat packers."
The mandate does contain an “exception” for employers that require unvaccinated workers to “undergo [weekly] COVID–19 testing and wear a face covering at work in lieu of vaccination.” But employers are not required to
offer this option and it pre-empts state laws to the contrary
[We agree] the mandate likely exceeded OSHA’s statutory authority, raised separation-of powers concerns in the absence of a clear delegation from Congress, and was not properly tailored to the risks of workers and workplaces.
The Secretary lacked authority to impose the mandate [which] ordered 84 million Americans to either obtain a COVID–19 vaccine or undergo weekly medical testing at their own expense. This is no “everyday exercise of federal power.”
It is instead a significant encroachment into the lives—and health—of a vast number of employees. “We expect Congress to speak clearly when authorizing an agency to exercise powers of vast economic and political significance.”
The question, then, is whether the Act [giving OSHA its powers] plainly authorizes the Secretary’s mandate. It does not. The Act empowers the Secretary to set workplace safety standards, not broad public health measures.
And no provision of the Act addresses public health more generally, which falls outside of OSHA’s sphere of expertise. Act that repeatedly makes clear that OSHA is charged with regulating “occupational” hazards and the safety and health of “employees.”
OSHA is limited to regulating “work-related dangers.” [Biden] argues that the risk of contracting COVID–19 qualifies as such a danger. We cannot agree. Although COVID–19 is a risk that occurs in many workplaces, it is not an occupational hazard in most.
COVID–19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day-to-day dangers that all face from crime, air pollution, or any number of communicable diseases.
Permitting OSHA to regulate the hazards of daily life—simply because most Americans have jobs and face those same risks while on the clock—would significantly expand OSHA’s regulatory authority without clear congressional authorization.
A vaccine mandate is strikingly unlike the workplace regulations that OSHA has typically imposed. A vaccination “cannot be undone at the end of the workday.” Imposing a vaccine mandate on 84 million Americans in response to a pandemic is not part of what the agency was built for.
OSHA does have authority to regulate COVID–19 occupation-specific risks, where the virus poses a special danger because of the job or workplace. For example, researchers who work with the virus or those in particularly crowded or cramped environments.
But the danger present in such workplaces differs in both degree and kind from the everyday risk that all face. OSHA’s indiscriminate approach fails to account for this crucial distinction—between occupational risk and the risks addressed by a general public health measure.
It is telling OSHA has never before adopted a broad public health regulation untethered from the workplace. This “lack of historical precedent,” coupled with the breadth of authority claimed, is a “telling indication” that the mandate extends beyond the agency’s legitimate reach.
It is not the Supreme Court's role to weigh such tradeoffs (billions in lost revenue and 100,000s leaving their jobs due to the mandate vs 6,500 lives saved and hundreds of thousands of hospitalizations prevented) - That is the job of Congress, through the democratic process.
Supreme Court punts on Federal vs State Government rights in regard to vaccine mandates and states instead states Congress must first give OSHA legal authority to issue such a mandate before it would rule on that issue.
"[OSHA] does not have the right order individuals to undertake a medical procedure that affects their lives outside the workplace. Historically, such matters have been regulated at the state level by authorities who enjoy broader and more general governmental powers.
Meanwhile, at the federal level, OSHA arguably is not even the agency most associated with public health regulation. And in the rare instances when Congress has sought to mandate vaccinations, it has done so expressly.
Even if [congress really] did endow OSHA with the power it asserts [to issue a nationwide vaccine mandate], that law would likely constitute an unconstitutional delegation of legislative authority.
🚨Under [Biden's] reading law would afford OSHA almost unlimited discretion and certainly impose no “specific restrictions” that “meaningfully constrain” the agency.

The Supreme Court does not address the list of 6 other reasons lower courts cited in overturning Biden's mandate, including Biden failing to show vaccine stop spread and infection.

As seen in Ontario, the strategy ends mass public testing and surveillance and redefines hospitalizations and deaths.
The strategy published in 3 Journal of the American Medical Association articles, in which Biden paid his advisers to urge himself to shift course on his response to COVID-19.

The course shift consists of nothing more than ending the tracking of the pandemic.

🚨[THREAD] Ontario's Covid dashboard is a master class on how Covid Injection Racketeers HIDE fully vaccinated infection rates using rates per 100,000 by age group.

1) Note among all ages 80/100k cases are fully vaccinated vs 60/100k in the uninjected.

Fully Vaccinated: 13,436 cases (80/100k)

Case rates among the unvaccinated are way higher than the unvaccinated for ALL age groups.

🚨My fully vaccinated son is vomiting in his room, hacking his brains out and running a high fever after testing positive for Covid today.

His doctor has cleared him under the new CDC guidelines to return to school in 5 days on Monday to infect his schoolmates and his teachers.
To clarify questions about the CDC guidance being for only for 5 days if infected and asymptomatic. That is clearly not the case:

The doctor made it clear within 5 days the fever should go away but the infectious cough will persist well after.
Yes. That cough he will return to school with after 5 days is still infectious.

That is why the WHO just blasted the Biden administration's decision to allow infected people to leave isolation after just 5 days.

🙏🙏My double injected 16-year-old son just tested positive for Covid after a running a 103 fever all night.

Says it's the worst sickness he's ever had.

Double injected Wife feels she will be getting sick.

My 12-year-old daughter and I are uninjected with no symptoms so far.
My son first developed a slight cough 2 days ago which worsened yesterday. He tested negative last night when he first started running a fever.

His fever worsened overnight, and he tested positive this morning.

Hopefully it is Omicron and is mild. Much more than "just a cold".
As of now he still has his sense of smell.

The symptoms he describes are more like bad flu than a cold, including chills, muscle fatigue and sore muscles along with the fever.

🚨If the GOP had any balls they would demand an immediate investigation into why the FDA used the CDC's false claim that Omicron made up 92% of US cases to justify halting shipments of monoclonal antibodies.

This decision can now be directly tied to deaths of Americans.
🚨Locations in Texas, New York and Florida are now reportedly out of monoclonal antibodies due to this errant decision by the FDA which relied on faulty CDC data.

It's been two years. The CDC should be doing better surveillance. How many more will die due to their incompetence?
We are an international laughing stock. The FDA jumped the gun and suspended shipments of antibodies.

This after they suspended GlaxoSmithKline's sotrovimab last month do test if for Omicron. It's the only one that does.
