Last week, we questioned Cyber Ninjas CEO Doug Logan under oath about his refusal to turn over public records related to the Arizona Senate’s partisan election "audit.”

Despite court orders to produce the records, Logan refuses to release them.

Over the course of five hours, Logan repeatedly argued that records in his possession were not public records and did not need to be released. Numerous court rulings have determined that they are.

The deposition was ordered on Jan. 18 after Logan failed to appear for a previously noticed deposition. The court then consolidated our lawsuit with a similar case brought by @azcentral, so our attorneys as well as theirs were able to participate.
At issue here are records related to Arizona’s sham “audit” that are still in the custody of Logan and Cyber Ninjas. We’ve already obtained tens of thousands of pages from the Senate, but key questions remain unanswered. Learn more here:

We’re investigating Texas’ election “audit.” In Sept. 2021, the Texas secretary of state’s office announced a “full forensic audit” of the 2020 election in four counties — just hours after former President Trump publicly asked Gov. Abbott to do so.

Trump’s demand for the investigation in Texas came nearly a year after he won the state by a 5.6 percent margin. The “audit” has focused on results in Dallas, Harris, Tarrant, and Collin counties, all of which except Collin were won by Joe Biden. Image
We have submitted over a dozen public records requests that ask for the release of communications concerning the audit from the offices of the secretary of state, governor, attorney general, and more.

NEW: Shortly before Trump supporters submitted fake electoral certificates to Congress, leaders in Wisconsin and Arizona apparently sought legal advice about whether their legislatures could affect the selection of electors after the election took place.

Arizona Senate President Karen Fann and Wisconsin Assembly Speaker Robin Vos both received memos confirming that state lawmakers cannot alter electors’ selection or actions after an election — a strategy that Trump allies had floated after the 2020 election. ImageImageImage
It isn’t clear whether Fann or Vos sought the guidance in furtherance of such a plan or whether it was to dismiss calls from the Trump campaign and members of their own party to take action to overturn the popular vote in their states.

Logan testified that he did most of the “audit” work himself, with the help of an employee and subcontractors. He also said that he has started a new entity called Akolytos.

We’ve been investigating an election “audit” in Fulton County, Pa. Last year, we obtained text messages and other communications indicating that state Sen. Doug Mastriano apparently threatened the county with a subpoena unless they undertook the review.

According to earlier reporting from the Washington Post, the Fulton County review took place on Dec. 31, 2020, without the knowledge or attendance of the county’s Democratic commissioner, Paula Shives.

The documents we obtained contain text messages exchanged later that day by Shives and the county’s other commissioners and the county’s elections director, in which Shives expressed frustration at having been shut out from the review.

We’ve been investigating whether and to what extent Trump administration officials assisted the former president’s efforts to overturn the results of the 2020 election. This month, we submitted new FOIA requests to the Department of Defense to investigate.
