Status hearing now with Timothy Hale before Judge Trevor McFadden.

Hale has been imprisoned since January 2021; McFadden, a Trump appointee, has held Hale behind bars under pre-trial detention orders.

His trial is set for May 23, 2022.

DOJ says "hundreds of thousands of FBI...
files still have not been unloaded to the sharable database. They won't be available until April as they undergo "review."

DOJ addressing chronic issue of defendants in DC Gulag (where Hale is) not being able to see discovery. She blames it on Hale not signing protective order.
DOJ will file a superseding indictment in a "matter of weeks" to remove its lie that Kamala Harris was in the Capitol on January 6.

DOJ wants another exclusion from Speedy Trial clock; defense objects.

Hale's original trial date was November 2021.

Hale says he won't sign...
protective order. "I've waited a year, finally got access to my evidence, I feel ready to go to trial."

Hale says DOJ has withheld evidence against him.

"I believe it would be prudent to stop taking the prosecution at face value."

Says there is evidence of agitators...
in the crowd.

That was quite a burn.

McFadden denying DOJ in limine motion based on "an indictment we all know is incorrect."

McFadden says DOJ must show where Vice President was during the protest--this is another controversial matter. DOJ wants to prevent cross-ex of Secret
Service agents to confirm his whereabouts.

We are "amazingly" in a situation where well over a year later, DOJ does not have full discovery and has repeatedly misled the court on deadlines.

McFadden won't toll the Speedy Trial clock.

Hale atty tells McFadden of Hale's...
recent medical issue (bleeding from ear) which has caused hearing loss.

DC Gulag refused treatment.

McFadden wants to know if he notified DOJ, Hale atty says he's never had to go thru the government before to help client.

Also says he hasn't been able to see Hale for 5 weeks.
End of hearing.

Trial still set for May 23--which means Tim Hale, charged with no violent crime--will be incarcerated for more than 16 months before trial.

Political prisoners.

This is your average reply. After calling Trump an authoritarian for years without evidence, Democrats get mad when the label is accurately applied to Biden and in their rage endorse his authoritarianism against Trump supporters
Fabricating evidence. And this is just one example

Making up charges. Again this is one example — obstruction of an official proceeding is another

Let's do a little flashback to late 2019, early 2020 when Democrats, supported by NeverTrumpers now banging the war drums, covered up Biden-Ukraine grift and Ukraine's interference in the 2016 election with impeachment ruse.

Remember Alexandra Chalupa?

amgreatness.com/2019/11/11/ins…
Remember when George Kent confirmed Ukraine's endemic corruption and admitted Hunter's "board appointment" to Burisma was a major problem?

Forgot about this from my Feb 2020 column: "Under Biden’s direction, leaders in the European Union brokered a massive bailout for Ukraine. The veep helped negotiate a $17.5 billion aid package from the International Monetary Fund."

DOJ just changed the official name of its J6 investigation from “Capitol breach” to “Capitol siege.”

This new stunt, just like January 6 itself, is an orchestrated effort btw Democrats and Capitol police to demonize foes of the Biden regime and silence criminal dissent:
As I wrote today, DOJ opened a “Capitol siege” section in DOJs criminal division and is looking to hire at least 20 new lawyers to expand its abusive, vengeful prosecution of Trump supporters.

Sure, be outraged at Trudeau. What about tyranny here?

amgreatness.com/2022/02/21/tru…
The real siege is against the American people.

They’re worried about Putin? REALLY?

This is the crushing of political dissent in America by a weak leader and party on the verge of losing political power across the board.

And GOP leaders are doing what? Squawking about Ukraine.

Judge Mehta, after making numerous pretrial conclusions in his lengthy motion related to Trump today, now considering whether Stewart Rhodes should remain incarcerated before trial.

Mehta, as always, trying the case in a pretrial detention hearing: amgreatness.com/2022/01/20/the…
Oath Keepers entered the building non-violently. No weapons (left behind in VA) and attacked no one.

Mehta mesmerized with the “QRF” that never materialized.

These trials need to be moved out of DC—Mehta preening for judicial promotion.

amgreatness.com/2022/02/07/no-…
Mehta “concerned” about the timing of Rhodes’ legal purchases of guns after January 6. Rhodes is Person One in the Oath Keepers conspiracy case and to fend off criticism, DOJ charged him a year after January 6 with “seditious conspiracy.”

Mehta says Rhodes is a danger for…

First major trial of a J6 defendant is set to begin later this month.

DOJ already in some hot water with the judge, who notes jury instructions and other indictments still claim Kamala Harris was in the Capitol during the protest--she was not in the building. h/t @joshgerstein Image
I explained why DOJs falsehood about Harris' whereabouts is relevant to thousands of misdemeanor charges. Judge McFadden also scolded DOJ for perpetuating the lie before a grand jury:

amgreatness.com/2022/02/11/jud…
Reffitt was charged six months after January 6 on a firearms violation--DOJ accused him of having a gun at the Capitol after DOJ and Wray had to admit no one had been charged with carrying a firearm that day.

But looks like DOJ only has proof of Reffitt carrying a holster...
