Former President Donald Trump is 'guilty of numerous felony violations' with regard to his business dealings, according to an ex-prosecutor who had been investigating the Trump Organization’s practices since February 2021.
Attorney Mark Pomerantz had been helping lead the Manhattan DA’s office's inquiry into allegations of financial fraud at the Trump Organization, but resigned in Feb 2022 after newly elected DA Alvin Bragg stopped an effort to seek an indictment against former President Trump.
The NY Times obtained a copy of Pomerantz's resignation letter.
In the letter, the attorney wrote to Bragg: 'I believe that your decision not to prosecute Donald Trump now, and on the existing record, is misguided and completely contrary to the public interest. I therefore cannot continue in my current position.'
Another attorney associated with the investigation, Carey Dunne, also resigned from the case alongside Pomerantz.
The Manhattan DA's office has been investigating the Trump Org’s business practices to determine if he falsely inflated his assets to obtain favorable bank loans. The pair had reportedly planned to charge Trump with falsifying business records.
Pomerantz wrote in his letter that he believed the investigation had uncovered 'evidence sufficient to establish Mr. Trump’s guilt beyond a reasonable doubt, and we believe that the prosecution would prevail if charges were brought and the matter were tried to an impartial jury.'
