We uncovered emails and documents about the law enforcement response in Portland, Ore., including a log of complaints made to DHS about officers’ actions there.

We obtained complaints related to federal officers’ alleged behavior in Portland last June and July, which were collected in a spreadsheet by the DHS Office for Civil Rights and Civil Liberties.
In one entry, a food delivery worker alleged that around midnight on July 16, 2020, he was "caught in the middle of a protest next to the Mark Hatfield Courthouse in Portland."
CRCL wrote that "he had just finished doing a ‘postmates order’ when he got into his car.” An officer then asked him to get out of his vehicle, which he refused to do "because he claimed he had not broken any laws."
The driver said the officer “proceeded to force my window down and break it until they finally backed off.”

The complainant asked for "justice and compensation," saying that he needed to use his car to make a living.
Our investigations have also shed light on the involvement of ICE, the US Marshals Service, and the Secret Service.

On June 1, federal officers violently cleared Washington, D.C.’s Lafayette Square, a park in front of the White House.
A timeline released to American Oversight by the Secret Service in response to our request for directives regarding the use of force that day shows a minute-by-minute accounting of activities related to that day's protest.
Other records produced in response to our FOIA requests detail the involvement of the U.S. Marshals Service in the protest response on June 1 and during the following days.
Just over an hour before the protest clearing, a message to officials outlined the deployment of deputy marshals to Lafayette Square and said that USMS would “be providing support to the U.S. Park Police at Lafayette Park.”

We also obtained records from Immigration and Customs Enforcement that include a series of emails from before and after the Lafayette Square incident.
The documents are substantially redacted, but provide yet another glimpse into how law enforcement officers from across the federal government were deployed against the June protests D.C.

BREAKING: A Wisconsin judge ruled that the Wisconsin Assembly and Speaker Robin Vos “have chosen to willfully violate a court order and are held in contempt.” The Assembly and Vos have 14 days to purge the contempt. After that, they will pay $1,000/ day until they comply. Image
To avoid the penalty, the Wisconsin Assembly and Speaker Vos must submit evidentiary proof that they have searched for records — including deleted records – responsive to our public records requests.

Last summer, the Wisconsin Assembly hired independent contractors to investigate the results of the 2020 election. These contractors, who reported directly to Vos, were tasked with keeping weekly reports of their findings and collecting data and evidence.

Last week, the General Services Administration approved the sale of Donald Trump’s lease for the Trump International Hotel in D.C.

We obtained documents that show that Kelly Craft, Trump’s ambassador to Canada, directed government business to the Trump International Hotel while in office.

“Is this a meeting I should attend?” Craft wrote in one email to a staffer. “If so, I would prefer the TRUMP HOTEL.”
In another instance, Craft helped line the former president’s pockets by using his Washington, D.C., hotel for a September 2018 meeting with Canadian officials, records we obtained show.

Arizona Senate President Karen Fann & Wisconsin Assembly Speaker Robin Vos both received memos confirming that state lawmakers cannot alter electors’ selection or actions after an election — a strategy that Trump allies had floated after the 2020 election.

Vos and Fann apparently sought this legal advice — about whether their legislatures could affect the selection of electors after the election took place — shortly before Trump supporters submitted fake electoral certificates to Congress.
It isn’t clear whether Fann or Vos sought the guidance in furtherance of such a plan or whether it was to dismiss calls from the Trump campaign and members of their own party to take action to overturn the popular vote in their states.

Our brief supports @CREWcrew’s argument against the broad use of the “commercial” prong of FOIA Exemption 4, which protects “trade secrets and commercial or financial information obtained from a person [that is] privileged or confidential.”
In 2019, CREW FOIA’d the Justice Dept. for records related to the procurement of pentobarbital. The drug was added to the Bureau of Prisons’ execution protocol in 2019 following former AG Barr’s announcement that the federal government would resume executions.

The easiest way to ensure complete and timely access to government records would be for agencies to devote resources for responding to FOIA requests.
The increase in the use of text messages and apps with disappearing messages has been another barrier to transparency. Ensuring systematic preservation and searches of these messages would help make sure public officials can’t avoid accountability.
