I will try not to swear with abandon as I explain what happened in DC District Court today.
Ethan Nordean has been in jail for 14 months. He is not charged with any violent crime related to Jan 6--he didn't assault anyone or carry a weapon. His only "crime" is being a Proud Boy
Judge Timothy Kelly--A TRUMP APPOINTEE--has denied release for Nordean and other Proud Boys also not charged with crimes of violence.
ONCE AGAIN caved to this abusive DOJ and VACATED Nordean's May 18 trial date.
Why?
Because DOJ AGAIN admits it doesn't have all its evidence ready--15 MONTHS AFTER THE FBI STARTED ARRESTING AMERICANS FOR JANUARY 6.
As I noted the other day, defendants have no choice but to...
concur bc attorneys haven't seen all evidence incl exculpatory evidence to defend their clients.
LOOK AT THIS: @USAO_DC doesn't want Judge Kelly to be "distracted" by the fact Nordean and his co-defendants have BEEN IN JAIL FOR OVER A YEAR WITHOUT BEING CONVICTED OF A CRIME:
Here is Matthew Graves, a Biden campaign advisor whose wife is a leftwing activist in DC, mocking their ongoing detention status and, of course, the law.
Everyone shut your f*cking piehole about Putin.
Political prisoners.

So here is my NON-LAWYER guess on what's happening related to Trump criminal charges for J6.
Looks like the committee will punt on a criminal referral.
Pressure is on Garland but my guess is he felt burned by the school board memo, which I don't think he knew much about and...
was likely orchestrated by Lisa Monaco. After Senate GOP blasted him and Cotton said he should resign in disgrace, not sure Garland wants to do more of Monaco's dirty work.
That said, the bag man here will be Matthew Graves, the US Attorney for DC handling all J6 prosecutions.
Graves will build from the Oath Keepers and/or Proud Boys obstruction and conspiracy cases.
He'll use alleged collaboration btw Rhodes and Tarrio before/on January 6 to "attack" the Capitol and provide security to folks like Roger Stone as evidence of Trump's culpability.
Some thoughts on closing arguments for Whitmer "kidnappers," which concluded yesterday. Jury deliberations begin Monday.
First, it was huge that Judge Jonker, who favored the government and hamstrung defense in many ways (even though I think he handled the trial very well)...
allowed the jury to consider the FBI entrapment defense. He clearly believed enough evidence existed for jurors to weigh FBIs extensive involvement in deciding the guilt of the 4 remaining defendants.
Defense lawyers did a solid job in closing yesterday. My chief concern...
is that defense didn't explain FBI motive (to my knowledge, my access to all closing arguments was choppy due to travel) and I'm not sure if the jurors got a "this is WHY the FBI did this" explanation.
I'm not a lawyer but that seems like a missing piece.
Traveling today but will try to cover Whitmer closing arguments as much as possible.
AUSA Roth says you can do what you want in America "except plan to kidnap, kill, or blow up" a governor.
Roth walking thru various trips the men took to organize the kidnapping plan.
Roth defending all the FBI assets involved in the case, says there’s no rule as to how many FBI informants and agents can work an investigation.
Also raised encrypted chats—but those were created by lead FBI informant.
Roth now defending the preposterous kidnapping plan, which I’ve discussed earlier. It was total nonsense—also, FBI had her home under surveillance with cameras at some point.
Big big problem is nearly every event Roth describes was organized and paid for by FBI.
Looks like closing arguments start today in Whitmer "kidnapping" trial--the trial went faster than predicted. DOJs case relies heavily on inflammatory texts, videos, and conversations documented by FBI informants. Defense was hampered by judge's rulings to omit as evidence...
potentially exculpatory exchanges between FBI handlers and informants, undercover agents. Judge also denied forced testimony of CHS (informant) Steve, which would have been pivotal to the entrapment defense. Defense also could not raise misconduct by key FBI agents removed...
from the govt witness list, including the special agent who signed the federal complaint against the men. Richard Trask was fired after his arrest last summer for assaulting his wife in a drunken rage after a swingers party. My guess is the most critical testimony was from...
Back to Whitmer "kidnapping" trial. Defense began yesterday--on witness stand now is Daniel Harris, one of the four men facing federal charges for conspiring to abduct and possibly kill Whitmer.
DOJ filed this yesterday, asking judge to prevent jury from considering entrapment:
Here's the response from Adam Fox's attorney. He might call Fox to the stand as well.
Huge blow to defense. Judge rules Steve Robeson, convicted felon and longtime FBI informant central to the kidnapping plot, doesn't have to testify. Defense atty: "Apparently, the government doesn’t have to be held accountable for their actions." woodtv.com/news/michigan/…
