NEW INDICTMENTS: Today, the SDNY has unsealed an indictment against three Russians with ties to Putin. It appears these three sanctioned guys had a US citizen friend with ties to pro-Russian US congresspeople and used that person to try to set up meetings with them. 1/
The defendants have apparently been in contact with this US citizen since 2011, and used that person to try to get pro-Russian sympathy in the US after the annexation of Crimea in 2014. The Russians were sanctioned after that and were denied visas to travel here. 2/
In 2017, one of the defendants drafted a plan outlining how to "recruit well-known persons to launch propaganda campaigns in favor of Russia" using their longtime US Citizen friend. When they applied for visas, they listed the US citizen as a reference. 3/
After being denied, they activated their US citizen friend to reach out to US congresspeople and wrote a letter to one referencing their US contact (so whomever that is knows people in congress). In that letter, they referred to their US citizen contact as "friend". 4/
The DoJ says they did that instead of referring to them as "representative" to conceal the fact that the US citizen WAS ACTING AS AN AGENT ON BEHALF OF THE RUSSIAN LEGISLATOR" (one of the defendants is Duma). That's FARA, ya'll. 5/
In March 2017, the Russian defendants organized a conference in Crimea and invited the US Citizen (CC1), a US congressman, and a US businessman to attend. The conference was to benefit one of the defendants, the purported "prime minister of Crimea". 6/
The Russians asked the Businessman to deliver a speech at the event, and offered to pay for all travel and expenses for the Americans. The Businessman drafted a speech and sent it to the defendants for review. They also had CC1 try to recruit the congressmember to attend. 7/
The congressmember ultimately declined. The indictment has 3 counts: FARA violation, visa fraud, and conspiracy to violate the international emergency economic powers act (sanctions violations). So I have to ask who CC1, the businessman, and the two congressmembers are 8/

PS: I should clarify here that this FARA is 951 (espionage lite) not 22 USC 611 (the FARA we all think of):
PPS: we know this indictment was filed under seal recently because it’s signed by Damian Williams, who wasn’t the US Atty until October, 2021.
Also, he says that CC-1 will be arrested and indicted.

DoJ only just cracked Tarrio’s phone. And I learned some things tonight from friendly and knowledgeable twitter followers about cracking phones. First, even if Apple wanted to help the FBI crack a phone, they can’t. The encryption is written so it can’t be cracked. 2/
Apple would have to write a back door into their encryption code, which would put all iPhones at risk. If a phone requires biometrics, law enforcement can compel the user to open it, but they can’t ask for the password without violating the 5A right against self incrimination 3/

THREAD: I have some actual questions. I’m not asking rhetorically or to make a point. First: Is @TheJusticeDept waiting until they have all the evidence on everyone before they indict so they can keep targets in the dark? 1/
I’ve heard good arguments that you don’t want to tip off targets lest they destroy evidence and intimidate witnesses. But don’t the targets in the 1/6 probe know who they are? It’s not like it’s a secret who did the coup. So why worry about tipping them off? 2/
I ask because I feel like there’s enough to indict people higher up on the ladder for *some* crimes based on publicly available information. For example, we know there’s enough to indict donald and Eastman on obstructing an official proceeding and conspiracy to defraud the US 3/

THREAD : People often ask me how I can remain hopeful that DoJ is doing their job. I have two words for them: Matthew Graves. 1/
Matthew Graves is the @USAO_DC and he’s only been on the job for just over four months. For a long time, I had posited that DoJ would stick to charging 18 U.S. Code § 1512(c)(2) Obstructing an Official Proceeding; because it’s easier to prove than Seditious Conspiracy. 2/
The last time DoJ brought Seditious Conspiracy charges was around 40 years ago, and 1512(c)(2) carries the same 20-year max sentence. After what happened with the Mueller probe, I wasn’t thinking DoJ would have the guts to charge Seditious Conspiracy. I was wrong. 3/

To clarify: I never said “Garland will prosecute, indict, convict, and sentence trump.” I said DoJ would investigate the leaders. Further, I never said Garland would “save us”. I said accountability is important. I still believe that. I’ve been very clear. 1/
I’ve said if garland doesn’t hold trump accountable for political reasons, that would be an egregious error. In fact, I’ve said he MUST hold people accountable. Additionally, I’ve said DoJ should consider the mueller findings. 2/
I’ve not had “blind faith” in anything other than DoJ would investigate. I’ve talked at length about prosecutorial discretion. I’ve warned about Donald’s possible defense. I’ve said this investigation would take a long ass time. 3/
