Today: Donald Trump faces a contempt motion by @NewYorkStateAG at 60 Centre this morning, for allegedly failing to turn over documents in her investigation of Trump Org.
Judge Engoron is on the bench
Courtroom is 2019-level packed
Right out the gate —>
Judge: “Why is this matter taking so long and taking up so many resources?” Notes going on for two years. “What do we have to show for it?”
AG, Kevin Wallace: “Each one of these assets is like a Russian nesting doll” explaining why the investigation has gone on for so long. Saying Trump is not cooperating and deadline approaches to file enforcement action
Trump atty Alina Habba: AG’s investigation is “aimless” “fishing expedition” noting 6 million pages of documents turned over by Trump Org and that despite AG complaints “we are right on schedule” . Then (of course) delay is bc this is “a political crusade”
Judge Engoron is not impressed with Trump’s objections after the court’s March 31 deadline to turn over docs. The time to object has passed, judge said.
Trump’s attorney also failed to say how or where they searched for documents even as he argued he didn’t have any documents.
Judge will rule in 10 minutes, he said, retreating to chambers.
Breaking: Donald Trump held in contempt by NY judge for failing to comply with @NewYorkStateAG subpoena and court order. He will be fined $10,000 until he complies. @Law360
That’s $10,000 per day until Donald Trump turns over documents the @NewYorkStateAG subpoenaed him for.
Civil contempt for the former president of the United States of America.
Breaking: Judge compels real estate appraisers Cushman & Wakefield to comply with @NewYorkStateAG subpoena and adds them as a respondent alongside Trump Org.
Contempt order now on the docket. Justice Engoron hints at how Donald Trump can stop paying $10,000 per day... turn over the documents or sign an affidavit swearing there are none.
Wow: @FoxNews just told a federal judge @TuckerCarlson did not slander fmr Playmate Karen McDougal because: “Would a reasonable viewer be coming here and thinking this is where I’m going to be hearing the news of the day?” @Law360
Legal note: Slander requires a false statement of fact. Opinion is speech protected by the First Amendment. This is where the @FoxNews lawyer was going with this.
And this juxtaposed gem: “It's not the front page of @nytimes. It’s @TuckerCarlson Tonight. It is a commentary show,” Murphy said of the top @FoxNews host. “Where you’re going to hear opinion and spirited debate.” @Law360
EXPLAINER: Now in day 4 of deliberations, the Weinstein jury must follow a specific path to decide the 5 charges, per Justice Burke. It’s a bit like a flow chart... so I made one to go with the verdict sheet. Here we go. @Law360
Start with COUNT 1: Predatory Sexual Assault — this top charge requires jurors to believe *both* Annabella Sciorra’s alleged rape claim (1993/94) & Miriam Haley’s alleged sexual assault claim (2006). @Law360
Remember: Sciorra is key. She anchors both Predatory Sexual Assault charges (Count 1 & Count 3), which carry a 25-to-life sentence. Without Sciorra, no life sentence. P.S.A. requires 2 accusers that allege first degree rape or criminal sexual act @Law360law360.com/articles/12372…
