A former senior Stormont official, who for five years was central to the Brexit negotiations and their impact on Northern Ireland, has issued a highly critical broadside against the UK government over its attitude to the Northern Ireland Protocol.
2/ Andrew McCormick, who was the Stormont Executive lead figure in the negotiations, has said the UK government knew full well what the Protocol entailed and that it is chiefly responsible for what was agreed with the European Union in October 2019.
3/ He also dismissed any notion that the Protocol was anti-democratic.
“Responsibility for the Withdrawal Agreement of 2019 and the Protocol lies fairly and squarely with the UK government,” he has written in an article for the Constitution Society.
4/ “It is hard to imagine anything (other than Brexit itself) with greater democratic legitimacy under the UK constitution than something that was the very centre of the manifesto on which a government secured a clear majority in a general election.
5/ “There is little credibility in any argument that the UK government either did not anticipate the implications of what it had agreed, or was constrained and unable to choose any other option.
6/ “The facts and choices had been spelt out clearly over the whole period from 2016 onwards and the detail of the provisions (notably most of the applicable EU law contained in Annex 2 to the Protocol) were known at latest in autumn 2018.
7/ “And the time constraint to ‘get Brexit done’ was entirely self-imposed. Indeed, as some have pointed out, the UK government could not explain the Protocol without having to explain properly the wider consequences of Brexit.”
8/ Mr McCormick retired last year as Director General of International Relations for the Northern Ireland Executive Office.
9/ Between 2017 and 2020, when the North’s institutions were suspended, he regularly attended UK ministerial meetings, and until May 2021 represented the Executive during meetings of the EU-UK Specialised Committee on the Protocol.
10/ Mr McCormick said there was “no basis” for the argument that cross-community voting should be required for the application of the consent provisions in the Protocol.
This was because international relations were not a devolved issue, as was made clear by a number of UK acts.
11/ He said there was evidence that the Protocol “does have the consent of a simple majority both of the electorate in Northern Ireland and the Assembly”.
12/ Mr McCormick pointed out that in the general election of Dec 2019, there were 444,227 votes for the parties which, in the Assembly debate of 30 Dec 2020 voted for the implementation of the Protocol, and against the use of Article 16…
13/ …and 337,874 votes of the parties that oppose the Protocol (a 56 per cent/ 42 per cent split).
“So, it is reasonable to infer that, had consent been sought in October 2019, there is a very strong likelihood that the Assembly would have approved the Protocol.”
14/ Mr Cormick warned that nationalists were still required to acknowledge unionist concerns.
“Irish nationalists and republicans need to recognise that stability and security for all communities depend on confidence.
15/ “Even if it can be argued that unionists should have seen more value in the 1998 Agreement, realpolitik should acknowledge that the unionist community has limited (and for some at least, diminishing) confidence in the settlement…
16/ “…and that the Protocol represents a very real challenge to their confidence.
“It cannot be denied that Brexit and the Protocol created and create very challenging sets of issues, and neither was explained properly.”
17/ Mr McCormick said the government of Boris Johnson should have made it clear in October 2019 what the implications of the Protocol were, and that the Irish Sea border would be made harder the more the UK diverged from EU standards.
18/ “It is hard to see any basis for tolerating the unwillingness of the UK government ministers to invest fully in a fact-based, problem-solving approach to a highly complex and sensitive task.
19/ “This exacerbated the issues of confidence that arise from Brexit when the clear responsibility of London and Dublin was (and is) to build confidence. But that requires honesty.”

NEW: The European Court of Justice has ruled that refugee status may be granted to female asylum seekers who have, over time, adopted the values of equality between men and women in their EU host countries.
2/ The ruling could have far-reaching implications for the granting of refugee status where female applicants in particular are at risk of persecution in their home countries.
3/ The case was prompted by two female Iraqi teenagers who had been living in the Netherlands since 2015 and who feared that if they were deported to Iraq they would face persecution because girls and women did not enjoy the same rights as men there.
NEW: Ireland's foreign minister @MichealMartinTD says EU foreign ministers have for the first time discussed the prospect of sanctions against Israel if it does not comply with an order from the International Court of Justice (ICJ).
2/ He suggested Ireland would support such an approach.
“Certainly, if compliance [with Friday’s ICJ ruling] isn't forthcoming, then we have to consider all options,” he said.
3/ He also said a number of foreign ministers had raised the prospect of sanctions against Israeli officials who were aiding and abetting violent West Bank Settlers.
Mr Martin was speaking in Brussels following a meeting of EU foreign ministers, who were joined by Arab ministers.
NEW: The Irish foreign minister Micheal Martin has described as "barbaric" the attack on a Palestinian refugee camp in Rafah last night, saying that UN agencies had predicted that Israel's assault on Rafah would have dire consequences.

Doctors Without Borders @MSF has described a catastrophic situation at the Al-Shifa hospital in Gaza City, with Israeli defence forces now less than one kilometre away, according to the latest reports.
2/ MSF says between 40,000 to 60,000 civilians are sheltering at the hospital, while doctors treating hundreds of injured patients - mostly children - are facing a horrific shortage of basic medical needs, with fuel running out.

Taoiseach @LeoVaradkar has said he understood the arguments about a super majority being needed in the event of a referenum on a united Ireland, and said “50pc plus 1” would not be a desirable outcome.

NEW: EU Commission president @vonderleyen has written to staff saying she was “ready to engage, and to listen to your concerns” on the Middle East following a letter signed by over 800 Commission officials last week protesting against her allegedly unequivocal support for Israel.
2/ In a letter circulated internally, seen by @rtenews, Ms von der Leyen said the events unfolding in the Middle East were “a deep source of sorrow and concern for all of us.”
