Mshololo: How many statements did you make with regards to this case?

Mshololo: Do you remember the question posed to you about what caused the delay of you arriving at the crime scene?

Mosia: Yes

Mshololo: Your answer?

Mosia: The person who reported the crime scene to me did not have the address.

Mshololo: What else?

Mosia: He told me to go to the hospital and on my way I went past the police station trying to find out if the station can help me.

Mosia: I did not say that.

Mosia says he only received the address when he arrived at the hospital.

Mshololo: Where first did you go when you were requested to attend the crime scene?

Mosia: I went to the police station.

Mshololo: Did you get the address?

Mosia: No I didn’t.

Mshololo: and that delayed you getting to the crime scene?

Mosia says he spoke with the police officers at the hospital for a short time before going to the crime scene.

Mshololo: The instruction or the call you got was for you to go to the crime scene, which is the house. Is that correct?

Mosia: That’s correct.

Mshololo: Were there any police officers you found at the crime scene?

Mosia: yes

Mosia: Some were inside the house and others were outside with Brigadier Ndlovu

Mshololo: You finding police officers in the house where the shooting incident happened, does this not mean there was a contamination or interference of the crime scene?

Mosia: That can be possible.

Mshololo: You testified that you took DNA swabs from the main door handle and from other handles in the house. You remember?

Mosia: yes I do

Mshololo: Because you found police officers in the house, you don’t know if they touched they door handles before you took the swabs?

Mosia: That’s correct.

Mshololo: The allegation is the suspect used the kitchen door to gain entry to the house. Do you understand?

Mosia: yes, that is the door that is mostly used in the house. We decided not to collect any evidence from that kitchen door.

Mshololo: it’s alleged the intruder used that door (kitchen) to enter the house?

Mosia: Yes

Mshololo: But you decided not to take any evidence fromt that door.

Mosia: Yes.

Mshololo: What was Kelly Khumalo doing when you arrived in the house?

Mosia: They were sitting and detectives were taking statements?

Mshololo repeats the question.

Mosia: I am not sure.

Mosia: I asked those who were there to leave the house so I could take control of the crime scene.

Mshololo: Who are they?

Mosia: the people at the crime scene, I don’t know their names

Mshololo: Who did you remove? And where?

Mosia: I asked them to leave the house. It was just myself and Brigadier Ndlovu in the house.

Mshololo: Was he a good person to show you the spots?

Mosia: That's correct

Mshololo: How do you know he didn't show you the right spots or points?

Mosia: I cannot answer that.

Mshololo: So there's a possibility he misled you?

Mosia: I cannot answer that.

Mshololo: Did he (Ndlovu) make a statement to confirm that he is the one who showed you points?

Mosia: He signed on my scene report.

Mosia has been asked about his statement regarding the movement of the bullet. He says he did work that should’ve been done by a ballistic experts. He now says he cannot answer questions about the movement of the bullet.

Mshololo: This was your evidence. I am expecting you to answer the questions and not give unnecessary explanations.

Mosia: I will try

Mshololo: You only took 8 pictures and you left?

Mosia: I didn't leave.

Mshololo: From your first visit of the crime scene you only took 8 pictures?

Mosia: That's correct.

Mshololo: are you saying it was tough for you at the crime scene?

Mosia: It was a bit challenging. I cannot say it was tough.

Mshololo: we want to understand this challenge. What prevented you from taking picture 124 (of the inside of the kitchen)?

Mosia: I had to wait for the task team to arrive.

Mshololo: You don't want to answer my question.

Mosia: nothing prevented me from taking the picture.

Mshololo: From that picture at night when you arrived at the scene, did you do any examination in that kitchen area?

Mosia: No I didn't. I decided to contact crime scene management team.

Mshololo: Who was in control of the crime scene when you left the first time?

Mosia: I handed the crime scene back to Brigadier Ndlovu and told him when I was leaving.

Mshololo: Is it the same Brigadier who didn't have the address for the crime scene?

Mosia: yes.

Mshololo: And his conduct led toy arriving at the crime scene later than expected?

Mosia: I cannot answer that.

Judge: But Mr Mosia, had he called you and said this is the address of the crime scene, would you have been there sooner?

Mosia: He called me that #SenzoMeyiwa was shot. He said he doesn't have the address but I should go to the hospital

Mshololo: Brigadier Ndlovu was a senior member of the SAPS, correct?

Mosia: yes.

Mshololo: Is it not expected of a police officer to verify the address where the complaint has been laid?

Mosia: Yes it is

Mshololo: in this case, Brigadier Ndlovu didn’t do that? He called you and referred you somewhere else?

Mosia: I had two other cases. I had to go to the other scenes and I was still waiting for task team to arrive.

Mshololo: When you arrived for the second time, were there people at the house?

Mosia: There were people outside the house, on the street.

Mshololo: by people what do you mean?

Mosia: Bystanders.

Mshololo: and inside the house?

Mosia: I didn’t go inside the house. I was waiting for the task team to arrive.

Mshololo: Whether before or after the task team arrived, where there people inside the house?

Mosia: No, the crime scene was clean.

Mshololo: I am going to repeat. When you entered the house, were there any people you found inside the house?

Mosia: I cannot be certain of my answers, this thing happened 8 years ago

Judge: but this is a simple question.

Mosia: The crime scene was clean, meaning there was no-one.
