BREAKING: Per federal source, DHS is preparing to discipline multiple horseback Border Patrol agents who were accused of “whipping” Haitian migrants in Del Rio last summer. I’m told DHS will imminently allege “administrative violations”, agents will be able to respond @FoxNews
Per federal source, this announcement is expected to come down any day now. It’s unclear what “administrative violations” the BP agents will be accused of, but they are not being accused of any criminal conduct. The horseback unit involved is based out of Carrizo Springs, TX.
It has been nearly 9 months since this incident took place. The agents have been taken off their normal duties and have not been allowed to have contact w/ migrants since.
President Biden assured the public at the time that “there will be consequences” for the agents involved.

Specifically, on 12/7/20, DA George Gascon took office & issued Special Directive 20-08. It states “any prior strikes will not be used for sentencing and shall be dismissed or withdrawn” & “if the charged offense is probation eligible, probation shall be the presumptive offer.” Image
LA DA sources tell me that in March 2020, Flores was initially offered 32 months (low term of 16 months x 2 for the prior strike).
In January, 2021, after Gascon took office, the offer was revised in accordance w/ Gascon’s SD 20-08 to just 2 years probation & strike dismissed.

NEW: Per sources, the gang member who fatally shot two El Monte PD officers last night was on probation for felon w/ a firearm after he received a bare minimum sentence in plea deal under LA DA @GeorgeGascon last year, despite having a previous strike on his record. @FoxNews
Law enforcement sources tell me Justin William Flores had a previous strike conviction in 2011 for PC 459, but that he still received the absolute bare minimum sentence for his felon in possession of a gun charges last year in accordance w/ Gascon policies. 2 years probation.
The two fallen officers have now been identified. Sources in the LA DA’s office tell me if this case had been prosecuted without Gascon’s policies in Feb 2021, Flores would have likely been behind bars on a 2.5-3 year minimum sentence.
Instead, he was out on probation last night.

THREAD (1/4) A 16 y/o hit & run driver in a stolen car who ran over a mom & child in Venice was sentenced on Friday to 5-7 months in juvie camp. LA DA @GeorgeGascon office tells me this was an “appropriate resolution”, but I’ve learned he has a prior criminal history. @FoxNews
(2/4) Per multiple law enforcement sources, the juvie was on probation, & violating it, at the time of this hit & run, and he had been previously convicted of felony poisoning after he spiked a teen girl’s drink at Palmdale high school in 2019. She was hospitalized. @FoxNews
(3/4) Despite the juvie’s criminal history, sources in the LA DA’s office tell me that in accordance with his policies, Gascon’s admin didn’t charge the juvie w/ assault w/ a deadly weapon or attempted murder for the hit & run, which led to light juvie camp sentence. @FoxNews

BREAKING: Multiple sources tell me a Texas National Guard soldier has just drowned in the Rio Grande here in Eagle Pass while trying to save migrants in the water. Texas DPS confirms, and tells me a body has been recovered. I’m told a statement will be coming out soon. @FoxNews

NEW: (1/3) A DHS source in RGV sector tells me the federal gov has started mass releasing Cubans, Venezuelans, Nicaraguans, & some Colombians via *parole* after this email went out on Sunday notifying BP agents that HQ had authorized the move “effective immediately.” @FoxNews
2/3) Under federal law, parole is only to be granted on a *case by case* basis for “significant public benefit” or “urgent humanitarian reasons”. On Tuesday, I asked CBP how they justify these mass paroles. Today, they replied, and completely ignored my question about the law.
(3/3) I previously obtained leaked Border Patrol documents that revealed the federal gov granted nearly 32,000 paroles to migrants in just 2 months last summer. Former USBP Chief @RSScott_BP252 told me he only issued 5-10 *per year* when he was BP Chief.

NEW: We witnessed the federal gov mass releasing single adult migrants, almost all men, at a parking garage in Brownsville. Taxi cabs were then called for them. We followed the taxis to Harlingen airport, where the migrants were dropped off to get on flights around U.S. @FoxNews
There are black tarps set up around the parking garage to obstruct the public’s view. In a statement, the city of Brownsville confirmed to me that they use this spot to work with the federal government to facilitate travel for the migrants released from federal custody. @FoxNews
Single adult migrants are supposed to be expelled from the country via Title 42. CBP tells me they had no involvement with these releases. An ICE source tells me these were ICE releases. ICE tells me they are looking into it. I am awaiting further comment from them. @FoxNews
