THREAD: A couple of things about what to expect from the trump warrant that we recently learned from Garland’s DoJ in the Eastman case. See, the DoJ seized Eastman’s phone and that gave Eastman a sad. He filed to get it back and to make the DoJ destroy any evidence they got. 1/
Eastman argued that his warrant wasn’t valid because 1) the. Affidavit was not attached, 2) the target offenses were not listed and 3) it was overbroad. 2/
The affidavit lists all the juicy details and trump was NOT given a copy, nor will DoJ release that part. In the Eastman case, here’s what this DoJ had to say about the affidavit not being given to Eastman. 3/
Now, for Eastman, his warrant didn’t need to describe the target offenses because they were SEIZING his entire phone and not SEARCHING it for specific crimes which would he burdensome. Here’s how the court differentiates search from seizure 4/
So I believe Donald’s warrant would have the target offenses on it since they were looking for particulars. And just in case Donald brings this up, there’s no rule that says they have to give you the warrant before they take your shit. 5/
It’s also interesting that in BOTH the Eastman filing AND the motion to unseal the trump warrant, the DoJ refers to this stage as the “pre-indictment” phase of the probe. END.

BREAKING: THREAD: DOJ ALLUDES TO POSSIBLE CRIMINAL CONSPIRACY INDICTMENTS in the latest Eastman filing! The first thing that stands out to me is the DoJ response to Eastman’s argument that the DoJ OIG didn’t have jurisdiction to seize his phone. 1/
Eastman claims the DOJ OIG can only investigate current and former DOJ officials. But Graves and Windom say “investigation into wrongdoing by one individual routinely involves obtaining evidence from OTHERS, PARTICULARLY IN CASES INVOLVING CONSPIRACIES.” 2/
And they’re not citing case law when they suggest this could be EVIDENCE in one or more CONSPIRACIES. So that’s pretty fucking awesome. NEXT: they mention potential indictments a LOT. This is despite Eastman not mentioning indictment. 3/

Knowing Donald, I could easily believe the plan was to collect all phones starting January 27, give everyone new phones, then “sit” on the old phones until the records retention time requirement lapsed (usually 18 months), then wipe them all “within policy guidelines”. 2/
