@WCPO PIKE COUNTY TRIAL: BCI agent Todd Fortner will return to the stand - he was on briefly Tuesday afternoon, showing some photos he took of Frankie Rhoden's property.
@WCPO PIKE COUNTY TRIAL: BCI special agent Todd Fortner back on the stand reviewing the photos he took of "Scene 2" - Frankie Rhoden and Hannah Hazel Gilley's property.
He found a sweatshirt in the driveway and collected it as possible evidence - giving it an item number.
@WCPO PIKE COUNTY TRIAL: Fortner now shows photos of several vehicles around the trailer - a black truck, red truck, and blue car.
@WCPO PIKE COUNTY TRIAL: Fortner shows the jury a couple area where he found cigarette butts, which he collected.
These went to BCI lab - one had unknown female DNA, one had male DNA with Frankie Rhoden not excluded, one had unknown male DNA.
@WCPO PIKE COUNTY TRIAL: Fortner says he found a blood stain on the wooden table in the front yard.
This is where the family changed baby Ruger's diaper after he was found between the bodies.
@WCPO PIKE COUNTY TRIAL: Fortner says he found a small blood stain on the front door, then swabbed it for touch DNA and fingerprinted the door.
@WCPO PIKE COUNTY TRIAL: Prosecutor Andy Wilson says the swabs from the blood stains on the door came back inconclusive of blood and on DNA for comparison.
@WCPO PIKE COUNTY TRIAL: No signs of damage for forced entry on front door to Frankie and Hannah Hazel's trailer.
Bobby Jo Manley said the toddler Brentley unhooked the chain to let her in.
DNA swabs from the door came back from lab as insufficient for comparison of DNA.
@WCPO PIKE COUNTY TRIAL: Fortner says inside Frankie and Hannah's trailer, the only light on was a nightlight and light over the oven. The TV was on children's programming. He says it was difficult to see - and it was cluttered inside.
@WCPO PIKE COUNTY TRIAL: Here's a photo Fortner took as he walked into Frankie and Hannah Hazel's trailer
@WCPO PIKE COUNTY TRIAL: Shows back door lock - not damaged - Fortner says the dead bolt was not locked
@WCPO PIKE COUNTY TRIAL: Fortner says he checked kitchen floor for potential shoe prints, using fingerprint powder. Also use oblique lighting.
Observed nothing of note there.
@WCPO PIKE COUNTY TRIAL: Using fingerprint powder, here's what Fortner found on the kitchen floor in Frankie's trailer.
Shoe prints appear to be a key to this case - we've heard about Walmart shoe purchase and allegations the Wagner boys wore the wrong sizes to throw off investigators
@WCPO PIKE COUNTY TRIAL: Fortner holds up three gel footwear lift impressions he took in the kitchen of Frankie's trailer that morning. Diagram on back shows where it was taken in the room.
@WCPO PIKE COUNTY TRIAL: Prosecutor Wilson is asking a lot about this laundry area in Frankie's trailer - if someone was there, could it block access to the bedroom where the bodies were found?
Fortner says it could yes.
@WCPO PIKE COUNTY TRIAL: In another bedroom, Fortner found an open window (this was discussed Tuesday) - and a tub of baby chicks.
In 2nd photo, Fortner points out a knife in the jam. Also the air conditioner just outside - had grass on top of it.
@WCPO PIKE COUNTY TRIAL: Fortner added that he felt entrance through the window was less likely at the time because nothing was disturbed in that bedroom.
@WCPO PIKE COUNTY TRIAL: Fortner found a piece of paper with a blood stain on it in the hallway outside the bedroom - lab came back showing that blood contained mixture of DNA from Frankie Rhoden and Hannah Gilley.
@WCPO PIKE COUNTY TRIAL: Court is taking its 15 minute morning break.
Afterward, prosecutor Wilson says testimony will move to the back bedroom where Fortner documented Frankie and Hannah's bodies.
@WCPO PIKE COUNTY TRIAL: Agent Fortner back on the stand after break.
He's about to describe entering Frankie and Hannah's bedroom and seeing their bodies - he calls it dark and cluttered. Had to use artificial light at times
Photos will be shown to the court (not on the livestream).
@WCPO PIKE COUNTY TRIAL: Agent Fortner says he found blood inside the door to the bedroom. Single drip stain.
Also just testified he found blood on paper in the hallway leading to it. It was Frankie and Hannah's mix.
@WCPO PIKE COUNTY TRIAL: Agent Fortner says the bedroom was a bloody scene.
Adds that the blood drop inside the door was consistent with a child being taken out of the room. The sample of that blood was not sent to the BCI lab, according to prosecutor Wilson.
@WCPO PIKE COUNTY TRIAL: Fortner says there was an incubator for baby chicks in the room.Found cellphones there too.
Then started documenting condition, location, positioning of bodies. Both Frankie and Hannah were in bed - gunshot wounds to head. Lots of blood between them.
@WCPO PIKE COUNTY TRIAL: Agent Fortner testifies that the blood between Frankie and Hannah's bodies was smeared in a way consistent with movement, wiggling.
Hannah had a nursing bra on - unclipped. Blood smeared along breast and side.
Defense objects to this - denied.
@WCPO PIKE COUNTY TRIAL: That line of questioning was to get to a point prosecutors made in opening statements - that Hannah Hazel was nursing Ruger when she was shot and killed.
Family in the courtroom is shielding faces are graphic photos of the bodies.
@WCPO PIKE COUNTY TRIAL: Agent Fortner describes the injuries to Frankie and Hannah.
What is George Wagner IV doing during this? It appears he is taking notes off and on.
@WCPO PIKE COUNTY TRIAL: At least one family member just left the courtroom - as prosecutors show photos of gunshot wounds to their heads. These photos are close ups - defense objects to them.
Hannah Gilley's mom is in the middle here - understandably very emotional in that courtroom.
@WCPO PIKE COUNTY TRIAL: Defense team continues to object on basis of these photos being inflammatory and not in dispute.
Judge Deering again overrules the objection.
@WCPO PIKE COUNTY TRIAL: Agent Fortner described moving Hannah Gilley's body for photos and with the coroner. Her arms were stiff from rigor mortis by that time.
Says she had no torso wounds - all to the head.
@WCPO PIKE COUNTY TRIAL: After removing Frankie's body ("in the evening, it was dark"), Fortner says he found a rimfire cartridge casing in the bed - collected it as evidence. It was a Remington casing according to lettering on it.
@WCPO CORRECTS: Hannah's mom is in the middle of the row behind this - grabbed wrong screenshot.
@WCPO PIKE COUNTY TRIAL: Agent Fortner says he found more of the same kind of Remington rimfire casings in the bed
@WCPO PIKE COUNTY TRIAL: Fortner found two cellphones in a crib in the bedroom - at least one was a Kyocera phone.
@WCPO PIKE COUNTY TRIAL: A live round was found on the floor near the bedroom door - results of DNA testing were inconclusive, Frankie and Hannah could not be excluded as contributors to that mixture.
@WCPO PIKE COUNTY TRIAL: Fortner says he did a FARO scan of Frankie and Hannah's bedroom before he collected the cellphones and casings there.
He's about to show the scans. As we've learned from his prior testimony, there are millions of measurements taken.
@WCPO PIKE COUNTY TRIAL: If you're wondering what this FARO scan tech looks like - since we can't show the scenes from court - here's a video from the company (this is the latest version, but you get the idea):
@WCPO PIKE COUNTY TRIAL: Like the first scene, both sides stipulate as fact -
"The DNA profiles of Jake, George, Billy, and Angela Wagner were not found in any evidence collected from the scene."
@WCPO PIKE COUNTY TRIAL: Court is taking a lunch break - we'll get a little more from agent Fortner when we're back - then likely bringing Dr. Karen Looman back to discuss Frankie and Hannah's autopsies.
Fire drill @wcpo - will get back to live tweeting shortly!
@WCPO PIKE COUNTY TRIAL: BCI special agent Todd Fortner is back on the stand - Richard Nash is doing his cross-examination.
@WCPO PIKE COUNTY TRIAL: Nash is asking Fortner about this path that links 4199 Union Hill Rd (Chris Sr's property) to 4077 Union Hill Rd (Frankie's property).
And asking about this photo of the open back window - with the AC unit that had grass on it.
@WCPO PIKE COUNTY TRIAL: Nash is asking about the room with the open window.
Nothing knocked over, Fortner didn't see anything on the carpet (like grass or dirt).
@WCPO PIKE COUNTY TRIAL: The room with the open window is down this hallway off the living room - to the left based on a map shown in court.
@WCPO PIKE COUNTY TRIAL: No shoe prints found by the trailer's back door, according to Fortner.
Here is a picture of the kitchen, with the back door in the middle of the screen. Nash notes the black bag in front of it.
@WCPO PIKE COUTNY TRIAL: Nash asks if Fortner ever shared the FARO scan of Scene 2 with anyone other than those involved in the investigation - he shakes his head and says "Oh no."
On to Andy Wilson for re-direct.
@WCPO PIKE COUNTY TRIAL: On re-direct, prosecutor Wilson asks Fortner if walking through wet grass could wipe away evidence on bottom of shoes. Fortner says yes.
Also clarity on his position of someone entering back window. Fortner says not likely but a smaller more agile person could
@WCPO PIKE COUNTY TRIAL: Short re-cross on Fortner.
State recalls Dr. Karen Looman, from the Hamilton County coroner's office. She performed all 8 autopsies in 2016.
@WCPO PIKE COUNTY TRIAL: Dr. Looman will testify now about the autopsies of Hannah Hazel Gilley and Frankie Rhoden.
They got to Hamilton Co. early on Sat 4/23/2016. She autopsied Hannah that day, did Frankie the next day Sun 4/24/2016
@WCPO PIKE COUNTY TRIAL: Autopsy + toxicology +opinion for Hannah Gilley is a 9 page document.
Special prosecutor Angela Canepa also hands Dr. Looman the chain of custody report for her body & the diagrams she made.
@WCPO PIKE COUNTY TRIAL: Report shows Hannah Gilley's body was placed in the cooler in Hamilton Co at 6:07 a.m.
Dr. Looman describes a photo of Hannah - says she is wearing a maternity bra and the front is open.
@WCPO PIKE COUNTY TRIAL: Dr. Looman says Hannah Hazel only had head injuries.
@WCPO PIKE COUNTY TRIAL: Dr. Looman says Hannah Hazel was shot five times - including in her left eye.
Says x-rays show 4-5 bullets still in her skull plus fragments.
@WCPO PIKE COUNTY TRIAL: Dr. Looman says one gunshot went directly into her eye - she thinks her eyelids were mostly closed.
Says she can't tell in autopsy whether Hannah Hazel was awake or asleep at the time she was shot.
@WCPO PIKE COUNTY TRIAL: Dr. Looman says the shot to the left eye would have immediately made Hannah Hazel unconscious because of the damage it would do to the brain.
@WCPO PIKE COUNTY TRIAL: What Dr. Looman calls wounds 3 and 4 were so close together she says she couldn't tell which damage, path or bullet belonged to which.
@WCPO PIKE COUNTY TRIAL: Dr. Looman says the bullets used to shoot Hannah Hazel were smaller and missing copper jackets - different from the ones she pulled from Chris Sr and Gary (she testified about them yesterday).
Tells jury she questioned whether they were plain .22 caliber ammo
@WCPO PIKE COUNTY TRIAL: Had to jump off to anchor.
@WCPO PIKE COUNTY TRIAL: Defense attorney John Parker argues the case against #GeorgeWagnerIV is about complicity - never a question of the manner or cause of death.
He says repeated showing of gruesome crime scene + autopsy photos is prejudicial.
PIKE COUNTY TRIAL: Court resumes now - we're told more BCI agents will take the stand first this morning and we may hear from Dr. Karen Looman, a Hamilton co. coroner investigator this afternoon.
