@WCPO PIKE COUNTY TRIAL: Defense attorney John Parker argues the case against #GeorgeWagnerIV is about complicity - never a question of the manner or cause of death.
He says repeated showing of gruesome crime scene + autopsy photos is prejudicial.
@WCPO PIKE COUNTY TRIAL: Judge overrules the motion for mistrial.
State (Angela Canepa) argued the number of shooters was "absolutely in dispute" - and notes the burden of proof. Said they have to prove there was an aggravated murder.
@WCPO PIKE COUNTY TRIAL: Interestingly, Canepa referenced defense opening statements calling Jake Wagner a liar.
She says all the evidence - graphic photos included - will prove his story. So they must show them.
@WCPO PIKE COUNTY TRIAL: Bryan White takes the stand, as expected.
He is a former BCI agent, who was assigned to what they call "Scene 3." Now works in Madison Co. Sheriffs Office.
@WCPO PIKE COUNTY TRIAL: White was 2nd most senior crime scene investigator.
Remembers getting a call before 9 a.m. on 4/22/2016 - need to respond to Pike County for 2 victims, then jumped to 5 (and then obviously 8)
@WCPO PIKE COUNTY TRIAL: White was assigned to 3122 Union Hill Road - this was Dana's house. Chris Jr and Hanna May were also there.
Investigators call this "Scene 3."
@WCPO PIKE COUNTY TRIAL: Like we've heard about the prior two scenes, White says there were two agents assigned to the scene - he was lead.
They met law enforcement there and then started taking photos from the outside moving in.
@WCPO PIKE COUNTY TRIAL: White says he found cigarette butts and a $5 bill in the grass - most important things found outside.
Started processing the scene around 2:30 p.m.
PIKE COUNTY TRIAL: White is now describing photos taken that day - starts with exteriors. Bud Light bottle highlighted by cone - an officer put that there. Doesn't appear relevant to anything, though.
PIKE COUNTY TRIAL: White describes seeing a white bucket in the yard - found a $5 bill underneath it.
PIKE COUNTY TRIAL: A look at one of the cigarette butts found outside Dana Rhoden's home - it was taken as evidence.
This cigarette butt had Hanna Rhoden's DNA on it, according to the lab.
PIKE COUNTY TRIAL: $5 bill found in Dana Rhoden's backyard was sent to lab for DNA testing - insufficient DNA for comparison
PIKE COUNTY TRIAL: White then walked into a barn on the property - White says he is just documenting things. This portion of the barn is unfinished.
PIKE COUNTY TRIAL: White describes moving into the house - it had a unique layout because it had been added onto.
Started in a back bedroom.
PIKE COUNTY TRIAL: White is describing moving into Dana's house - this is the living room looking into the kitchen. There is an addition back there too.
In prior testimony, prosecutors pointed out the bassinet there.
PIKE COUNTY TRIAL: White shows photo of the front door lock - says no sign of forced entry here.
PIKE COUNTY TRIAL: White is now describing heading into Chris Jr.'s room.
Chris was dead in the bed on his stomach, covered by red comforter and was shot multiple times in the head.
PIKE COUNTY TRIAL: White documented injuries to the back Chris Jr's head - said it looked like at least one gunshot wound there.
Chris Jr. was 16 years old.
PIKE COUNTY TRIAL: White says there was a backpack and pair of boots in the bedroom as well.
White also found what he thought was blood on the carpet by the bed.
PIKE COUNTY TRIAL: White shows front door again - says "no defects" on it.
PIKE COUNTY TRIAL: White is now describing the second bedroom he went into - this is Dana Rhoden's room.
She was under a comforter, a pillow covering her head. White says there was some blood on an exposed bedsheet before he moved comforter. She was bleeding from the head.
PIKE COUNTY TRIAL: They removed the pillow covering Dana's head as evidence.
White says one gunshot wound was immediately evident. Some tissue from her body was on the bed.
PIKE COUNTY TRIAL: White is now describing moving into the third bedroom - Hanna May Rhoden's bedroom.
She was also in bed, shot. Pillows on the floor. We know her days-old baby Kylie was with her alive when her body was found.
PIKE COUNTY TRIAL: White now shows the rear door of the addition to Dana's home. He says it was covered in plastic and "inoperable." So, not a point of entry.
PIKE COUNTY TRIAL: We are back from lunch break. Former BCI agent Bryan White remains on the stand under questioning by special prosecutor Angela Canepa.
PIKE COUNTY TRIAL: White says evidence collection started in Chris Jr's bedroom.
They also took shoe prints right at the front door and in the kitchen -on vinyl tile. They got a print at the door.
PIKE COUNTY TRIAL: White says they used fingerprint powder to see the prints. And LCV.
He says first contact is the most likely to show up - moisture can be taken off sole in carpet. Hence, finding something at door but not in kitchen.
PIKE COUNTY TRIAL: Here's a look at what checking for footwear impressions looks like - that's fingerprint powder on the tile.
PIKE COUNTY TRIAL: Here's a closer look at overlapping impressions White says they found in the entry area. Some are boots first responders would wear but he noticed something unique.
PIKE COUNTY TRIAL: White is explaining using a gel lift to get footwear impressions. Compares it to lifting a fingerprint.
PIKE COUNTY TRIAL: White shows the evidence bags holding Chris Rhoden Jr's comforter. He was wrapped in it, asleep, when he was shot and killed.
PIKE COUNTY TRIAL: On the comforter from Dana Rhoden's bed, prosecutor Canepa says the BCI lab found insufficient DNA for comparison
PIKE COUNTY TRIAL: White collected two pillows from Dana's bed.
The one covering her head had "a complex mixture of DNA not suitable for DNA comparison."
The one beside her was not submitted.
PIKE COUNTY TRIAL: White says he also collected a phone cord from Chris Jr's bedroom - wanted to check for touch DNA in case suspects took a phone off it.
PIKE COUNTY TRIAL: Stipulation as fact that phone cord was swabbed for DNA - had Chris Rhoden Jr's DNA
PIKE COUNTY TRIAL: Court is taking a 10 minute break
PIKE COUNTY TRIAL: Court has adjourned for the day.
A juror had requested a 10 minute break - then attorneys went to judges chambers for a while. We're unclear on why we're done for the day.

@WCPO PIKE COUNTY TRIAL: BCI special agent Todd Fortner back on the stand reviewing the photos he took of "Scene 2" - Frankie Rhoden and Hannah Hazel Gilley's property.
He found a sweatshirt in the driveway and collected it as possible evidence - giving it an item number.
PIKE COUNTY TRIAL: Court resumes now - we're told more BCI agents will take the stand first this morning and we may hear from Dr. Karen Looman, a Hamilton co. coroner investigator this afternoon.
