Wayne and Paul are finally out after 12 hours of court and a grand total of 40 minutes of breaks. They're tired and hungry, but in good spirits because they had some solid wins today. 1/
The judge was more fair with jury selection than expected and they believe the pressure from supporters - both in person and online - contributed to that. So thank you! 2/
Most importantly, they successfully got a juror included on the jury who indicated he is aware of jury nullification and would generally be more favorable to the defense. This is a huge win. Jury selection for the final member of the jury will continue tomorrow AM. 3/
We hope to get the WebEx situation clarified by tomorrow morning as well so everyone can watch the trial unfold online. Thank you again for liking and retweeting - it really does help. 4/
And finally, make sure to watch the viral disruption of tonight's #MondayNightFootball game, where activists ran onto the field to raise awareness about this trial and the #RightTo Rescue. 5/5
Dr. Rosenberg described “profuse” diarrhea that she observed both Lily and Lizzie had, which “splattered” when they defecated. She said it was tan which was concerning, too. 1/4
She explained that diarrhea causes excessive fluid loss and dehydration is dangerous, especially in an underweight animal. 2/4
“It was concerning to see Lizzie having diarrhea inside the small farrowing crate with her sisters and her mother.” This diarrhea was almost certainly caused by infection. The most common virus being E. Coli. Very often they’ll have multiple of these. 3/4
Wayne gave Dr. Rosenberg an image and asked her to describe it. She said this is Lizzie, and she has bright red blood on her nose coming from her mother’s teat. 1/4
She explained that piglets are very competitive for access to teats and this has been exacerbated by an industry practice to produce sows who birth more piglets. They have more piglets than teats. The smaller, weaker piglets end up with the less productive teats. 2/4
She explained the conditions agalactia (not producing milk) and hypogalactia (producing less milk). Her analysis of footage of Lizzie’s mother led her to conclude that she had agalactia. 3/4
The judge is reading the jurors’ questions. They asked if Wayne personally carried both pigs out. He said yes, with assistance from Jon and Andrew. 1/3
A juror asked, “Did you see more sick piglets?” “Why did you not remove more piglets?” Wayne said he would like to help all the animals but Circle Four Farms raises 1.2 million pigs per year and sadly, we can’t help them all. 2/3
Another juror also asked if they saw other pigs in similar condition to Lily and Lizzie and if so, why did they not rescue them. Wayne already answered but it’s amazing 2 jurors asked this and used the piglets’ names and the word rescue! 3/3
Agent Anderson used social media and drivers license records to identify the intruders. He said this is the first time he’s ever had a case like this because it’s very rare. Once again, discussion of “the video” is happening, but the jury is still being denied seeing it. 1/
Mary is objecting to the Agent’s testimony about identifying Paul and Wayne based on social media posts. The judge will allow it.
Now, Agent Andersen is explaining that he collected physical evidence by visiting Smithfield. He coordinated with Topham, the witness from Tues. 2/
Andersen went into multiple buildings including Gestation 1 and Farrowing 7. He collected photographs of the inside and outside to match the barns from the video. 3/
