Last October residents in a referendum voted Yes to approve Spitalfields Neighbourhood Plan
But business voted No
Cllrs tonight will have
1/
to decide whether to support:
business No vote
or the
resident Yes vote

BUT this report misses out several key facts (once again demonstrating that Council officers do not like this subject)

The @TowerHamletsNow report does not mention that there is an active Police investigation into the business No vote, nor that 49.5% of the business vote came from a single building, nor that the anti-Neighourhood Plan campaign broke several electoral rules in the referendum

In the business referendum
1 person voted 5 times for different companies
2 people voted 4 times " "
3 people voted twice " "
In the vote registration forms sent to businesses they were told 1 vote only per person regardless of the number of properties

But The Neighbourhood Planning (Referendums) (Amendment) Regulations 2013 allow one person to vote a maximum of 2 times for 2 separate companies
Therefore 7 business votes are illegal
Police are investigating these votes (which they confirmed by email on the 21st Sept 2022)

In addition 49.5% (48 out of the 97 business votes submitted) came from a single building in the area with a single mail room
This building rents out individual small offices to a range of businesses (because those businesses pay business rates separately they each get a vote)

This business model is not reflective of the wider business community in area
But it does mean small offices have the same weight of vote as a whole restaurant or shop etc
I would argue that is unfair even if legal
But Councillors need to make a judgment as to whom to support

So of the 97 business votes submitted
9 rejected by Council officers (a large number) - why is unclear
47 were extra votes from a single building
4 votes were from people voting more then once
So it is entirely possible that if you adjust out these numbers from the results

that actually the business vote was much closer to a 50/50 split
(I can only assume from where the No votes came from as I can only see the business voter register not the actual votes)
Again Councillors tonight can make a judgment on whether to support the business vote or

Why do I talk about an attack on democracy?
Because at the weekend an unknown organisation on YouTube released a video attacking people involved in the Neighbourhood Plan
It was 8 minutes long, clearly professionally produced
This must have cost somebody ££
Who paid for it?

It was full of irrelevant & misleading content
But it also attempts to convert an argument over planning policy (the 7 policies in the Neighbourhood Plan) into a personal one by attacking 2 individuals
It said nothing about the planning issues at stake here

Last year I reported in this tweet thread about the very expensive letter campaign organised by a business in Romford against the Neighbourhood Plan
Who paid for it?
That campaign ignored electoral laws related to electoral imprints & campaign spending

So we have somebody paying a lot of £ to attack the Spitalfields Neighbourhood Plan
Why & whom?
Maybe they do not like this Neighbourhood Plan policy which offers more Affordable Workspace in future commercial developments?

Which of the 7 Neighbourhood Plan policies do you object to & why?
Here are the policies that your vote tonight will decide whether or not should be added to the Councils development plan

to help decide future planning applications
As you should know the Neighbourhood Plan can only do 2 two things:
a. Add these 7 extra land use policies to those that Councillors voted for (the Local Plan) & Mayor Sadiq Khan wrote (the London Plan)

b. Make recommendations on where up to 25% of CIL can be spent (but the Mayor of Tower Hamlets ultimately decides where to spend CIL & Council officers have in the past under John Biggs ignored recommendations made by Neighbourhood Plans (the Isle of Dogs Neighbourhood Plan)

Those are the only powers that Neighbourhood Plans have
They cannot change electoral boundaries, they cannot change ward names etc
Council officers & Councillors in planning committees make the decision on whether to use Neighbourhood Plan land use policies or not

And the evidence of the Isle of Dogs Neighbourhood Plan is that Council planning officers do not like nor respect Neighbourhood Plans (see also the 12th July 2022 development committee for evidence also within Spitalfields of officers not respecting Neighbourhood Plans)

The vote tonight will determine the future of Neighbourhood Planning in Tower Hamlets
Do we support or not resident engagement in planning?
Do we support the Spitalfields residents Yes vote or the flawed & partially illegal Business No vote?

And fittingly next week Roman Road votes on their Neighbourhood Plan
Is it worth residents voting?

It is clear from the Truman Brewery proposed development that many people are unhappy about some of the development
Councillors last year said their hands were tied by current planning policies
The Neighbourhood Plan gives Councillors more options

But they retain the decision-making power on how or whether to use them
Rejecting the Spitalfields Neighbourhood Plan means returning to the status quo of planning policy in the area

A couple of points answering some of the potential objections to Neighbourhood Plan
a. The name of the Plan does not include Banglatown - this is easily fixed but was done because the Plan area is not the same as the Ward area & to use the same name may have caused confusion

b. Neighbourhood Plan has nothing to do with the Spitalfields Town Council campaign even if a couple of the people are the same
c. It does not include the whole of the ward especially areas to the east of Brick Lane - this could be fixed by creating a new Neighbourhood Forum

Sorry I missed the fact that in the detail of the report the total number of businesses was reported as 812 of which 88 submitted valid votes
Business turnout 10.8% not 67% as quoted last night v
Resident turnout 13.46%
But as you can hear in the webcast it was the alleged

higher business turnout that convinced Aspire Cllrs to ignore resident vote in favour of the business vote
Cllrs used the wrong information
How will @TowerHamletsNow now justify its reversal of the resident vote?

Council may try and add numbers this way
298 residents voted Yes
18 business voted Yes
= 316
252 residents voted No
70 businesses voted No
= 322 but that includes numerous illegal votes + 48 votes from a single building
Do they really want to justify their decision this way?

As a result of the @AspireParty & @TH_Labour decision to support the businesses opposed to resident involvement in planning the Mayor is proposing instead "a developmental Masterplan for the Spitalfields and Banglatown area"
What is called a Supplementary Planning Document SPD

But SPD's cannot introduce new planning policies with the same weight as those now lost from the Neighbourhood Plan (which had material weight in the planning process from July 2021 to last night)
So the planning policies in the area are now less restrictive which means

developers will find it even easier to get new applications approved
Plus the Mayors wording suggests the new Spitalfields & Banglatown SPD will be housing focussed
But a lot of the development in the area is commercial
But this is what the businesses wanted more freedom to

Last night Labour & Aspire Councillors voted against the Spitalfields Neighbourhood Plan
They chose to support a flawed business vote over the vote of residents
They did so based on a Council report that was misleading on a key fact & missing essential decision-making info.

The claim made last night was that the business turnout of 66.67% was much higher than the resident turnout of 13.46%
And the 80% No vote from businesses was much higher than the resident Yes 54% vote
= support business
But the business turnout calculation was incorrect

A reminder that in the Spitalfields Neighbourhood Plan referendum last October both businesses and residents living in the Forum area got to vote
Inevitably not everybody votes but elections are decided by those who vote
But last October residents voted Yes and business No

London Marathon this Sunday 2nd October - avoid traveling by road that day
The main London Marathon which normally runs in April has been pushed back to this Sunday
It is one of the great events in the area, and is worth watching in person if you have never seen it but it

will have a major impact on transport and roads from 4am/8am to 12am/8.30pm depending on where you are (no buses after 7.30am on the island for example)
A word of warning, the maps of road closures may not be accurate based on the one time I tested them

I would avoid all road-based travel that day, if you need to use your car Sunday, either leave very early and return late or park your car elsewhere

Some advice after 11 hours queuing if you want to see the Queen lying in state
- it’s cold
- there are toilets
- it’s long from 6.15am to 5.45pm for me - 2 hours longer then indicated
- it’s worth it
- no liquids/gels/sweets allowed inside
- you can get food on the way as

lots of stalls/coffee shops on the route (if open)
The wind along the river + lack of sunlight makes it much colder then you think from weather forecast
- Children were in the queue & did ok, they can go ahead & rest
- there are a few places you can sit down on the way

No big bags allowed (but there is a bag drop 4 hours from end)
It was magnificent but wear comfortable shoes/socks/clothes to enjoy it
Hopefully we won’t be doing this again for many decades so it is a sight worth seeing in my opinion & to say thank you to Her Majesty

I believe Mayor @LutfurRahmanTH is making a mistake here
It also raises fundamental issues about democracy & possibly Council officer advice & the Salisbury Convention
In his manifesto he said
"Reopen our roads, and abolish the failed Liveable Streets scheme"

It was clear that if Lutfur was elected there would be major changes to Liveable Streets & that the roadblocks would go (ANPR bus gate less clear)
But now it appears this is all subject to consultation & that in theory consultation responses may change the outcome "Gunning"

But on the 5th May 84,125 people voted in the Mayoral election
Lutfur won with a clear lead
+ Elliott Weaver & my Mayoral campaign also promised big changes to Liveable Streets (LS) = 56%+ of votes went to Mayoral candidates promising LS changes
Lutfur can now implement
