1. First is always stay calm & be polite. Polis just penguatkuasa (enforce the law) ,not "orang pemegang kuasa". Which mean they cannot do anything they like, they need to follow law too.
Being polite is protect yourself and people surrounding you from further harm
2. Police can ask you to present your IC without any reason nor warrant. Please follow police instruction.
However, authority from Religion affair have no right to ask non-muslin to present their IC. Non-muslim is not in their juridiction.
But if religion authority come with police and request you to present your IC, you will need to present your IC to police.
(This is mainly because they want to identify you are muslim or not)
3. Police may not allow you to leave the party after checking your IC
you can politely ask police "Adakah saya ditangkap?"
4. If police say "no, you are not under arrest", you can take back your IC and leave the premise/party
But,what if police still not let you go?
Then you can again ask "adakah saya ditangkap?" if police answer the same, you can trying to leave the premise/party again
If police still stopping you to leave the premise/party, THIS IS ALREADY A FORM OF ARREST.
When this scenario happen, please follow tweet no. 3 , start notify friends / NGO / Lawyer
and if can, start video down what happen
5. If police keep silent when you ask "adakah saya ditangkap?" and police refuse to let you go nor return IC to you, this is also a form of arrest
When this scenario happen, please follow tweet no. 3 , and notify friends / NGO / Lawyer
and if can, start video down what happen
6. When police take your IC, they may start talking to you. You only need to provide information on your IC, such as name, address, phone number
No need to answer anything other than this. Example: student or pekerja, tempat kerja, sexuality, bf/gf siapa, who is the organizer & etc
you can remain silent all the time until lawyer show up.
DO NOT GIVE ANY INFORMATION TO POLICE THAT MAY USE TO AGAINST YOU.
However if police become very pushy and having sign of threaten, you can repeat saying "jawab di mahkamah"
7. If police already take you to police station, and start to questioning you:
- ONLY provide information on your IC, name, address, phone number
- they will ask your father name, just answer it, this is for their record, POLICE WILL NOT NOTIFY YOUR PARENT if you're adult
- if police ask "kerja apa/mana?" "student atau sudah kerja?" "bf/gf siapa?" "pakaian ini cantik, beli dimana?" "siapa kawan yg sama datang party ini?“ "dimana dapat tahu party ini?" "makeup you cantik, siapa yang buat? sendiri buat ker?" "harga ticket party ini" & etc
DO NOT ANSWER ANY OF THESE QUESTION even though the police seem very friendly or even seem like macam nak chitchat dengan you, all you need to do is answer :
"SAYA JAWAB DI MAHKAMAH"
again, you only need to provide information on your IC (name, address, phone number, dad's name)
8. When you are in police station, you may feel very nervous, stress, scare, not sure what to do....
We understand that. That's why is important to let your friend (that you can trust and support you), LGBT NGO , lawyer to know your situation.
And keep calm until lawyer show up
9. Police arrest you DOESN'T mean you will have "record", it just police procedure, and it will not affect ur career/scholarship/university intake
police will not and should not notify ur office, university, scholarship funder. Bcoz ur private life is ur private life
How police brutally answer "adakah kami/saya ditahan"? They answered by grabbing me roughly, dragging me on the ground, yelling at me, causing my shirt to be lifted, my pants pulled down, my phone camera cracked and caused multiple bruises on my body
When the police were grabbing and dragging me, they gave no mercy at all and ignored my question all the time, THEY JUST ACTED VIOLENTLY AND TRIED TO INTIMIDATE US
2/
TW: injuries, bruises, broken camera
But this will not stop us.
They thought yelling, bruises, injuries, intimidation will stop us.
But it will not, it will just make people angrier and #Lawan more
