A THREAD on COLORADO law

Want to review a CRITICAL aspect of a NEW CO law that is limiting transparency when it comes to the man now suspected of murdering 5 and shooting/injuring 17 others in Colorado Springs over the weekend

It involves this bill

leg.colorado.gov/sites/default/…
HB19-1275 SAILED through the 2019 legislative session.

It was passed with good intent. A desire to keep people away from the burden of previous convictions/arrests. Particularly minor ones.

Here are some basics.
So what does this have to do with Colorado Springs?

Well, for one, we KNOW the alleged shooter was arrested just last year.

There was a bomb threat. And deputies recommeneded felony menacing/kidnapping charges.

This is the press release
But today... the case has totally DISAPPEARED

Doesn't exist. Can't find anything in the Colorado court system on it

For all intents and purposes, it never happened.

Why? The case was dropped... charges never filed...

And thanks to this section of HB-1275, poof, it's gone.
It all means... as of now... we CANNOT access what were once very public records.

This case was sealed. Clearly.

And due to the NEW law... it's vanished.

Which allows the El Paso County Sheriff to avoid scrutiny for what it did/didn't do back then.
You're reading this right.

A law that SAILED through the #COLeg in 2019 with the the help of legislators wanting to protect people from police convictions/arrests...

is NOW BEING USED to protect law enforcement from public scrutiny.
We have questions.

Many of them.

Primary among them... was there reason to issue a RED FLAG order in the 2021 case?

But today, thanks to the state legislature, we cannot access ANY RECORDS about that case.
We'd also like to know why the case was dropped.

How long Aldrich remained in jail?

What were the specific nature of the threats?

Why should the public care? B/c this guy went into a nightclub and killed 5 and injured/shot 17 more.
I'll add one more thing.

The law did offer what amounts to an escape clause

Yep, the El Paso County DA appears to have some wiggle room based on this line in the bill.

Let's see if they take the legislature up on the offer.
Let me add one more thing...

Legislators can muck up things even with the best of intentions.

And when it comes to TRANSPARENCY issues, they need to consult more PUBLIC RECORDS advocates when they muck with this stuff.

Please and thank you.

We deeply want mass shooters to be simplified into something manageable

something that helps us better understand why.

But there’s a real challenge to that.

“Why” is not always discernible.

It typically involves motives as complex as the mind itself.
Colorado has a long history of mass shootings.

We also have a long history of the early application of presumed and simple motivations.

Only later do we learn more.

And even then the answer isn’t always satisfying.
Hate is almost always a factor.

Deep narcissism too.

I do not intend to downplay any role both might have played this weekend.

But I also know the desire to find motive behind the unthinkable remains powerful.

I feel it too.

I have no idea what “preliminary charges” are…

We’ve got the be super clear on this.

Charges have not been filed. When they eventually are, there will likely be dozens of them.

That could happen in a matter of days.
Charges will include 1 or 2 murder charges for each of the 5 dead.

Each would carry a life sentence should there be a conviction.

Also. Prosecutors will absolutely file attempted murder charges on behalf of, at the very least, each of the 17 with gunshot wounds.
But they could very well charge attempted murder on behalf of everyone who was at the club.

There could be assault charges.

And, should it merit, hate crime charges too.

We’re talking a very long list. Theater shooter had 150+

There could have been many more

@DenverPolice just released body cameras/HALO video of July 17 LoDo police shooting that resulted in 6 bystanders getting injured.

Let's start with HALO camera up above. Man in picture, say police, is Jordan Waddy.

He's involved in some sort of fight. Police respond.
Waddy heads up Larimer. Police walk with him, on Larimer.
While Waddy attempts to cross Larimer, he sees police.

At one point, he puts his hands up. Briefly.

And then walks back toward the Larimer Beer Hall.

Journalism literacy 101

Most journalists work in local newsrooms. They are your neighbors. They gripe about some of the same things you do.

They seldom cover national politics. Routinely cover hyper local issues.

They don’t appear on cable news.

And they work very, very hard
Many make far less than you might ever imagine.

Most have struggled…particularly over the last 2 years.

They’ve seen wonderful colleagues leave. For more money. Better hours. To do something else.

They’ve been barked at by strangers. Accused of “fake news”.
Many did this for altruistic reasons. They want to better their communities. Inform their cities and towns

They’re hyper curious about all sorts of things you might find boring.

They witness tragedy far too often. And it’s hurt them. Deeply.

Most will never complain tho
