MADDOW: When you look back at the prosecutors who unsuccessfully prosecuted seditious conspiracy- they agonized over what effect that was going to have on the country - that it was going to effectively vindicate the causes of the people who weren't successfully prosecuted... 1/
It's going to make them martyrs, it's going to make the justice department and the whole government look like they were persecuting these people just for their political beliefs. Losing these cases is not just a missed opportunity to convict them... 2/
It can have a real impact on the ability of these groups to recruit and potentially advance their efforts to overthrow the government. It's REALLY high stakes to bring these (seditious conspiracy charges) and I think @ryanjreilly reporting has been so good on this...3/
He rightfully points out that this is a mixed verdict. The leaders were convicted but three of them were acquitted and that has to weigh on the DOJ as we head into the next seditious conspiracy trail. END/

THREAD: THE 11TH CIRCUIT UNANIMOUSLY VACATES JUDGE CANNON’S ORDER APPOINTING A SPECIAL MASTER. As I expected, this ruling reads like the 11th circuit ruling in the classified documents case. First, they cite Chapman and the 1st Richey Factor. 1/
In order to get your shit back from a DoN search, you have to prove your constitutional rights were callously disregarded. Donald made no such argument. 11th circuit says if you don’t meet that factor, which is the first of four Richey factors, you don’t have jurisdiction. 2/
But again, for FUNSIES, the court says “we’ll go over the other three Richey factors for completeness, and you didn’t meet any of those either.” (Paraphrasing). 3/

Garland goes on to talk about the significant action in Jackson Mississippi. They filed a suit and proposed interim order to stabilized their drinking water system. They're working on a consent decree and will appoint an interim monitor. 3/

Getting the seditious conspiracy conviction will change the way we talk about the history of January 6th forever. But it can't just be left to the criminal justice system alone. There has to be political accountability. There has to be activism and journalism. 2/
The voters need to hold people accountable. Political parties need to hold people accountable. And the courts need to hold the line as far as criminal behavior by these folks. Everything has to happen all at once, and everybody needs to pull in the same direction. 3/
THREAD: For those with misplaced anger that Pence is “considering” testifying: he has not been subpoenaed. You want to get voluntary testimony first. If they say no, then subpoena. Then they don’t have a choice. Pence is not a target in this investigation. Trump is. 1/
Journalists (should) report news as soon as they get it. They don’t - nor should they - sit on a story until it’s dramatic enough for you. Step one is “considering.” Step 2 is a subpoena. The last thing you want is a recalcitrant witness that could help your case. 2/
