The first thing they did was go after so-called ‘ghost’ guns. @Polymer80inc & several other companies produce gun frames & receivers that cannot be built into firearms until the remaining 20% of machining/milling has been completed.
Under the congressionally passed & President signed Gun Control Act of 1968, Congress codified into law what is & is not a firearm. The full text of the law can be read at the link below; it states that a frame/receiver that isnt fully finished is not.

So this week, the BATFE has sent out a press release completely re-writing their controversial new Rule that uses the Chevron Deference legal premise to REWRITE the 1968 gun control act & redefine 80% receivers/frames as completed guns. The original released in April, illegally..

The issue is the ATF & Biden administration KNOW they do not have the Authority to do this. The EPA lost a Supreme Court case last session for doing the same thing: re-writing laws & using Chevron Deference to justify it. In W Virginia v EPA this was explicitly found illegal.
This is important: because this week the ATF is now in direct violation of TWO Supreme Court landmarks, for the SECOND time, regarding this one rule. They again illegally rely on Chevron to re-define frames & receivers— this time stating the bare frame/receiver is a gun.
The ATF is now in violation of West Virginia v EPA SCOTUS ruling as well as the Bruen v NY SCOTUS case where ALL gun control must now meet the Bruen std. This rule violates it, along w/ other SCOTUS decisions reaffirming that a ban on guns in widespread usage is unconstitutional.

This is key: the ATF & Biden administration are already under sanction by a Federal court in Texas fir these violations caused by their overstep on frames & receivers which deliberately aims to put companies such as @Polymer80inc out of business & deny Americans the ability..
…to manufacture their own firearms privately— something the ATF cannot track, which is the real motivation for their actions. The case in texas has been discussed by Firearms Policy Coalition @gunpolicy lawyer Anthony Miranda.
The Biden administration is in clear violation of the law, & they may have just destroyed any chance if winning the case on appeal.
Pay close attention to this case: it has wide reaching ramifications across the entire Executive Branch,
