Michael Avenatti: Gone but not forgotten. The public defender doing his appeal is trying to halt required payments on the $7 million in restitution he's to pay to the clients he ripped off. Motion filed today.
The motion reveals ongoing efforts by @USAO_LosAngeles to try to recoup some of the $4 million Avenatti stole from cosmetics magnate @MichellePhan. He used $1.5 million of it to pay his taxes, so prosecutors are trying to get the IRS to give $1.5 million to Phan.
Here's the full motion. "At minimum, substantial questions exist here as to the appropriateness of the
restitution amount awarded at sentencing." storage.courtlistener.com/recap/gov.usco…
Prosecutors also filed this today, which confirms the IRS is going to give back the $1.5 million from Avenatti that was actually settlement money he stole from @MichellePhan. bit.ly/3JWZz7o
Avenatti currently has three active federal appeals. The 9th Circuit appeal of his California sentence is just getting started. Opening brief due April 10. The 2nd Circuit panel heard oral argument Jan. 19 in his Nike extortion conviction. No decision yet. ca2.uscourts.gov/decisions/isys…
Avenatti's opening brief in the appeal of his conviction for stealing from @StormyDaniels fraud also is in. Some of it focuses on Judge Furman's extensive "Allen charge" instructions to the jury that eventually turned a holdout juror. bit.ly/3x7w8YF

A $1,000 sanctions order over T.I.'s lawyer's conduct during witness depositions offers a window into the scorched-earth tactics behind the legal epic that is @MGAEnt v. @Tip, aka OMG Girlz v. OMG Dolls.
"Objection. It doesn't look blonde to me. It looks yellow white, Chase."
Among the other offending statements made to MGA lawyer Chase Scolnick: "Mr. Chase loves to run to the judge." (This is after a magistrate judge had warned T.I.'s lawyer about previous conduct.)
Here's the full order. The $1,000 that T.I.'s lawyer is ordered to pay is meant to cover some of MGA's lawyer fees. It's a bit short of the $93,381.21 MGA requested. storage.courtlistener.com/recap/gov.usco…
The California State Bar has filed charges against Trump’s lawyer John Eastman that could lead to disbarment. It’s all about what he said at the Jan. 6 rally in Washington, D.C.: bit.ly/3WFuNme
Here is the full 35-page charging document. 11 counts against John Eastman, mostly moral turpitude for misrepresentation: bit.ly/3j7gXeq
I extensively covered Eastman's litigation fight before Judge Carter over @January6thCmte wanting his Chapman University emails. I also went to a speech he gave at the California Republican Assembly’s convention last March:
Jurors in @MGAEnt v. @Tip heard from a woman who said she stopped buying OMG Dolls because "I did not want to support a company that steals from African Americans and their ideas."
Today, a judge declared a mistrial because of it, agreeing with this argument from MGA's lawyers.
This is happening now in Judge James Selna's courtroom, where I'm stationed. The judge declared the mistrial a few minutes ago, but the jury hasn't yet been told. They'll be brought in soon, then dismissed. There is a lot going on here that I'll be explaining in an article today.
T.I.’s lawyer Erin Ranahan tried to get Judge Selna to reconsider, saying the testimony wasn't anything helpful for their case.
"We did not want that theme before this jury in particular. This is not Los Angeles. There’s not a single Black person on the jury."
California Supreme Court Justice Martin Jenkins swore in attorney Michael Gregg as @OCBarCA’s new president tonight. Jenkins said it’s “no accident” that he’s doing this “just several days after our annual celebration of the birth and career of Dr. Martin Luther King.”
Gregg was born in London and lived in Jamaica before moving to the U.S. when he was 9. He went to law school at USC and is a @Littler shareholder in Irvine. The bar magazine recently profiled him. (Jenkins remarked on Gregg’s swag in the cover photo.) ocbar.org/All-News/News-…
It all happened tonight at the @OCBarCA’s annual judges’ night and annual meeting, aka the biggest night of the year for the Orange County legal community. The place is always packed with superior court judges and also a few federal.
Jose Huizar must've heard about Judge John F. Walter's 8 a.m. to 2:30 p.m. trial schedule with only two 10-minute breaks?
Seriously though, this comes on the eve of Judge Walter's pre-trial hearing on the motions in limine. Ex-deputy mayor Raymond Chan still is set for trial.
Here's the 42-page (!) factual basis for Jose Huizar's guilty plea. Looks like a jaw dropper.
"the Council District 14 Enterprise (“CD-14 Enterprise”), located in the City of Los Angeles (“the City”), was a criminal enterprise…" bit.ly/3IY38cX
This right here from the plea deal indicates a huge amount of prison time for Huizar. The standard range for offensive level 39 with criminal history category I is 262 months to 327 months, or about 21 years to about 27 years.
T.I., Tiny and Zonnique arrived at the federal courthouse in Santa Ana a few minutes ago for the first day of trial in their case over MGA’s OMG Dolls and Zonnique’s former group the OMG Girlz. Opening statements are underway now. I’ll be sharing updates on this thread.
Bumping loud in U.S. District Judge James Selna’s courtroom: “Gucci This, (Gucci That)” by OMG Girlz.
T.I.’s lawyer introduced the song and video to the jury: “With that, we’re going to give you a taste of Gucci This and Gucci That, and what the OMG Girlz were like” visually.
Next on the federal courtroom playlist: “Where the Boys At?” by OMG Girlz. Jurors also say a video clip of the OMG Girlz backstage, meeting with fans. T.I.’s lawyer Dave Scheper is talking about the group’s undying brand. He said they “remain highly relevant.”
