Currently discussing HB 3059: Give PSC authority to fine Class I railroads for safety and operational violations. Council notes that this law will likely be challenged in Federal Court as railroads are regulated by Congress. 2/

Sen. Hamilton (I think) asked about the cost of legal fees, she said in fiscal note $300,000. She said no basis for that number; it just sounded right. 5/

From people speaking on the bill, my understanding is that it would restrict shareholders voting on behalf of the West Virginia Investment Management Board and Treasury Board from making decisions based on “social justice” issues, limiting it to a solely financial decision. 11/
New witness speaking (missed name/ position), says that there is no evidence that shareholders are voting based off of social issues (says the board is conservative). 12/

The speaker continues to reiterate that he believes this bill is unnecessary as board members aren’t voting on social issues. He believes that it will unnecessarily clutter code. Senators aren’t buying it, asking what’s the harm if it regulates something that isn’t happening 14/

Sen. Trump says that Judiciary will resume 5 minutes after Government Organization ends. The Senate will resume after ether Finance or Judiciary end (which ever is last). 19/
The plan is to get through this quickly. Then get to the other bills on the agenda and have them quickly disposed of, sent to the floor, read a first time, and sent back to committee. (Not sure if 2007 Will be sent back, but the other three should be). 22/

On to HB 3190: Amending the definition of “minor”, which basically allows for sting operations.
They are debating an amendment to a strike and insert amendment. The amendment to the amendment would strike language that creates the offense of marital rape. 33/
H.B. 2622 excludes non-english speaking children from WV classrooms, and making it so county boards don’t have to employ ESL teachers to teach these children English. A 🧵 of some of parts of the bill that stood out.
Maybe it’s just me, but this doesn’t read well. The English isn’t Englishing. Maybe “Not speaking a second language” would be better. Anyways, one would hope that you would master your first language before writing a bill discriminating against people learning with their second

The two bills: DNA bill (S.B. 53)
If I understand correctly, the bill would require people being arrested provide a DNA sample upon arrest for certain crimes, as opposed to after conviction.
@lauraforwv proposed an amendment to S.B. 53 to prevent DNA samples to be added into any database until after a criminal conviction, meaning DNA would be collected on arrest, but not added to databases until there is a conviction.
