The issue was brought to the apex court’s attention last year, but the debate is quite old: can the Hindu majority community be deemed a religious minority in any part of the country?
The issue runs coterminous with the debate over who should identify such minorities.

Some say it’s a valid ask.
1️⃣ Petitioners ask to recognise Hindus as a religious minority in states where they are a numerical minority.
Articles 29 & 30 of the Constitution provide a charter for religious minorities to be recognised at all levels, not just the Centre.

2️⃣ Some petitioners argue that the Muslim community do not form a minority anymore, based on a 2007 ruling by the Allahabad HC. They believe that the welfare benefits for national minorities are being misused.

But is that the case?
1️⃣ The petitioners arguements don't account for the democratic principle of minority rights.
Even if states recognise Hindus as a minority in certain areas, Muslims and other minorities recognised by the centre will continue to receive entitlements.

2️⃣ The debate over Hindus being a minority was already settled in the TMA Pai Foundation ruling of 2002, making the rehash a mere gimmick.
The MHA govt recognises Jews as a minority. Hindus too can be identified as so in J&K, if the UT finds their numbers dwindling low.

The GoI is looking at hydropower to keep its net zero pledge.
