This EXPLAINS why Jack Smith was asking CORCORAN about a phone call he had with Donald trump on the same day the surveillance footage was subpoenaed. Background: 2/ cbsnews.com/news/trump-eva…
If that call were innocuous, there’d be no reason to attempt to pierce attorney client privilege using the crime - fraud exception. From the article in the last tweet: 3/ Image
But if Donald tried to OBSTRUCT the subpoena of the surveillance footage - which potentially shows Walt Nauta moving boxes around after the classified documents subpoena - then it would make sense to want to question Corcoran about that phone call. 4/
FURTHER: a new round of subpoenas has gone out related to discussion about the subpoena of the surveillance tapes, and trumps head of security at the Trump Org - Matthew Calamari - will TESTIFY to the federal grand jury THURSDAY. Calamari’s son will also testify. 5/ Image
Additionally, the special counsel has heard testimony from other witnesses and asked them about whether the surveillance footage was TAMPERED WITH. And it appears the DoJ has a TEXT MESSAGE from Nauta to Calamari about the tapes. 6/

WHAT WE KNOW:

1. Donald cut his trip short to return to the states.
2. The Calamaris just testified in the documents case and they work for the Trump Org.
3. DoJ subpoenaed Mar a Lago surveillance tapes last June. 1/
4. DoJ ALSO subpoenaed the tapes directly from the software company
5. There appear to be gaps in the tapes the Trump Org handed over
6. Corcoran was compelled to testify about a phone call he had with Donald the day the Trump Org got the surveillance tape subpoena. 2/
7. Nauta wouldn't cooperate so he was investigated, & a text between him and a Calamari was found
8. Jack Smith has a cooperator in the documents case
9. Since arriving home, Donald has been losing his shit on Truth Social about the documents case & Obstruction of Justice. 3/

THREAD: This is cool. So we know it’s really hard for dems to force a bill to the floor for a vote because they’re the minority party in the House. But they did a little trickery, which I love to see. 1/
If a bill sits in committee for more than 30 days, dems can use a “discharge petition” to force action on it. So a relatively unknown dem rep (DeSaulnier) wrote a bill and put so many different things in it that it went to over 20 committees for consideration. 2/
He did this over 30 days ago. It went largely unnoticed. But now it’s ripe for a discharge petition, and can then be used as a shell, or vehicle, to get a debt ceiling limit increase to the floor for consideration. Like an Etch-a-Sketch. Poof! New bill! 3/

THREAD: lawyers for the Proud Boys in their seditious conspiracy trial are arguing that their obstruction of the electoral count by force is NOT THEIR FAULT. They are arguing that it’s DONALD TRUMP’S FAULT because he “authorized” the Proud Boys to commit crimes that day. 1/
That can also be called a “public authority” defense. But the public authority defense would require Donald to HAVE the authority to order the Proud Boys to commit the crimes in question. The DoJ has argued in separate filings that Donald did NOT have that authority. 2/
Judge Beryl Howell recognized: “The president cannot, in keeping his constitutional function and responsibilities under Article II, lawfully permit actions that directly undermine the constitution.” 3/
