I want to walk through jury instructions on seditious conspiracy to demonstrate the vagueness of the charge and how easy it is to prove.

Just look at (2)--this could apply to essentially any political protest on the federal level. Image
So agreeing to a "conspiracy" (I'll get to that laughable definition in a moment) to interfere in the execution of federal law is "seditious" but oh btw it's not necessary for DOJ to prove that the accused knew which law they conspired to break🤔 Image
There are not enough LOLs in the world for this.

One prosecutor told Proud Boys jury that a "wink and a nod" constitutes agreement to a conspiracy.

Now do you see the low bar to indict Trump? Image
But it says "by force!" Here's DOJs burden of proof.

Basically none.

Further, what "force" was used when no one brought a weapon, no one assaulted police, and some (Nordean) walked through an open door WITH POLICE RIGHT THERE.

Further, Enrique Tarrio was in Baltimore on Jan 6 Image
Consider how this would apply to nearly every protest in Washington, especially climate demonstrations and Kavanaugh confirmation process.

This is conspiracy to obstruct Congress. Image

Hoping this is my last thread of the day but I can't pass up dissecting this batshit interview with a Proud Boys juror

Not only did they quickly convict on seditious conspiracy, this juror thought deleted messages were evidence of guilt---except the messages were probably... Image
removed by DOJ due to unknown number of FBI informants and other conspiracy "tools," unidentified and/or uncharged participants, in numerous chats.

Some genius-level thinking there!

Cell service was down everywhere in DC especially near Capitol. Nordean didn't have his phone on all day but sure, they should've texted each other to "stand down" or something. So that makes them seditionists, cool story, juror. Image

Oh boy. Let’s break this down.

First, Graves is in unique position of prosecuting both local and federal cases in DC.

Blaming COVID restrictions at Superior court (local) for crime wave doesn’t pass muster.

Why?

Bc DC District court had similar restrictions for same period:
Throughout 2021 and into 2022, District (federal) court held hearings for J6ers remotely. No different than local court.

J6 grand jury empaneled 1/8/2021. 1st criminal indictments handed down the following week.

Graves office moved at lightning speed against Trump supporters…
while allowing DC to descend into violent chaos.

Think of how jury selection in Jan 6 trials impacts juries for real crimes. DC isn’t a big city but Graves is flooding the court with trespassing, obstruction trials from an event ~28 months ago.

His office brags about new cases.

Once again, you gotta hand it to Democrats. As they viciously and relentlessly go after justices on the highest court, Republicans won’t even send a letter to a single judge on DC District court demanding answers on their handling of Jan 6 cases.
No letter demanding that Beryl Howell account for her ruling that carved out special pretrial detention rules for J6ers. Or her involvement in grand jury proceedings in all Trump investigations. Or her shredding of privilege for GOP members of Congress:

Did I miss GOP demanding public testimony from Judge Tim Kelly for his egregious, political handling of Proud Boys case? No one interested in why he’s kept innocent men accused of no violent crime with no criminal record in jail for 2+ years?

Aside from fact Epps is from Arizona, it was surreal to hear DOJ talk about “1st wave” of “rioters”—which included Epps—at closing arguments in Proud Boys trial today.

DOJ: “Rioters took over entire plaza. All hell broke loose. It was a terrifying spectacle.”

Epps was there: Image
Prosecutor Conor Mulroe, forced to confront Epps issue because he's in so many videos and key breach points, warned jury there are many "fantasies" about Epps being a "government agent." DOJ: Everyone at Jan 6 is a rioter. Except Epps who is a victim of rightwing "fantasies."
DOJ insists the "seditious conspiracy" for Jan 6 can be "unspoken," "implicit," "a mutual understanding," and a "wink and a nod."

How is Epps, involved in 1st breach point (as DOJ describes it) and present during first 90 minutes, not an "implicit" or "unspoken" co-conspirator?

At DC courthouse to cover closing arguments in Proud Boys trial. Lots at stake for DOJ—any convictions for seditious conspiracy bolsters case for similar charge against Trump since govt has used his “stand back stand by” comment as a calling cry of sorts.

More on that later.
A chief from DOJ organized crime division is here bc it’s important to observe what’s happening with the dangerous crime racket known as the Proud Boys. “This is a good judge. He has no time for nonsense.” 🙄

Lol amgreatness.com/2023/03/29/tim…
It would be great if Republicans investigated how much money and how many (legit)crime fighting resources have been diverted to Jan 6 cases.

US Attorneys from across the country have been reassigned to DC to prosecute these cases. One of many Qs for DOJ

Icymi: Today at Proud Boys trial, one defendant describes the dangerous assault by police against protesters assembled outside: ImageImage
He describes “sniper” fire. Capitol police used guns to fire pepper balls (projectiles with gas) at the crowd. This violates every protocol: Image
This, as I’ve reported and police have testified in trial, justifiably enraged the crowd of protesters outside ImageImage
