Good late morning from Los Angeles, where I have arrived for the hearing on Tory Lanez’s motion for new trial over the shooting of Megan Thee Stallion. Check this thread for updates and also, subscribe to my website to get my full article emailed to you. legalaffairsandtrials.com/subscribe
I’m late going in, but that’s ok. I think everyone is already in court, but I’ll be in there soon. Will update ASAP.
OK we are on 90-minute lunch break. I think I only missed about 15 minutes of argument. I heard a good hour of back and forth between Judge Herriford, prosecutors and Lanez's lawyers about various arguments, starting with Instagram post. Background here: legalaffairsandtrials.com/p/all-the-deta…
The biggest theme of the hearing so far is ineffective assistance of counsel. Lanez’s lawyers’ supplement apparently criticizes Shawn Holley’s work for Lanez and says she had a conflict that pushed George Mgdesyan into the case with little time to prepare.

Conductor says they’re trying to get permission from @Metrolink/@MetrolinkOC to pull up into the next station and if they do that I can take an Uber from there, so hopefully it happens soon and I’m on my way. (Driving up to LA and back for court is not feasible.)
For people laughing that a train hitting and killing a human being is somehow “karma” related to social media vitriol engulfing a rapper’s criminal case, I really hope you think long and hard about your approach to the world. 🙏🙏
“The evidence of guilt is overwhelming,” judge says. Seriously - this never seemed like a tough case.
Judge says he’s deferring sentencing to later date, and I’m just surprised he even has to say that. Of course he won’t be sentenced today.
Turns out Murdaugh will be sentenced tomorrow. They do it fast in South Carolina apparently. No sentencing memos needed.
Ex-Los Angeles Councilman Jose Huizar’s estranged wife, Richelle Rios, is to testify today in ex-Deputy Mayor Ray Chan’s corruption trial. Jurors heard a lot about her husband’s hedonistic ways through the testimony of his former top aide, George Esparza: bit.ly/3J6p4lA
One of the more comical (but also very real) aspects of the Jose Huizar scandal is him recruiting his wife to seek election to his City Council seat so the power would stay in the family. Richelle Rios Huizar was pretty subdued on the stand today, giving mostly short answers…
…but she had a succinct explanation for why she abandoned her City Council campaign in 2018: “The FBI searching my home.”
“I just didn’t see a path forward after that,” she testified.
(She’s back on the stand in a few minutes for cross-examination.)
Michael Avenatti: Gone but not forgotten. The public defender doing his appeal is trying to halt required payments on the $7 million in restitution he's to pay to the clients he ripped off. Motion filed today.
The motion reveals ongoing efforts by @USAO_LosAngeles to try to recoup some of the $4 million Avenatti stole from cosmetics magnate @MichellePhan. He used $1.5 million of it to pay his taxes, so prosecutors are trying to get the IRS to give $1.5 million to Phan.
Here's the full motion. "At minimum, substantial questions exist here as to the appropriateness of the
restitution amount awarded at sentencing." storage.courtlistener.com/recap/gov.usco…
A $1,000 sanctions order over T.I.'s lawyer's conduct during witness depositions offers a window into the scorched-earth tactics behind the legal epic that is @MGAEnt v. @Tip, aka OMG Girlz v. OMG Dolls.
"Objection. It doesn't look blonde to me. It looks yellow white, Chase."
Among the other offending statements made to MGA lawyer Chase Scolnick: "Mr. Chase loves to run to the judge." (This is after a magistrate judge had warned T.I.'s lawyer about previous conduct.)
Here's the full order. The $1,000 that T.I.'s lawyer is ordered to pay is meant to cover some of MGA's lawyer fees. It's a bit short of the $93,381.21 MGA requested. storage.courtlistener.com/recap/gov.usco…
The California State Bar has filed charges against Trump’s lawyer John Eastman that could lead to disbarment. It’s all about what he said at the Jan. 6 rally in Washington, D.C.: bit.ly/3WFuNme
Here is the full 35-page charging document. 11 counts against John Eastman, mostly moral turpitude for misrepresentation: bit.ly/3j7gXeq
I extensively covered Eastman's litigation fight before Judge Carter over @January6thCmte wanting his Chapman University emails. I also went to a speech he gave at the California Republican Assembly’s convention last March:
