NC Court review of state statutes under “beyond reasonable doubt” standard has clear implication-when legislature decides to intentionally discriminate against Black voters, NC court will defer to it & uphold such laws even in face of strong evidence proving discriminatory intent
Unconsidered in NC court’s opinion, the facts remain…North Carolina has long history of discriminatory voting laws, Black voters are 39 % more likely to lack qualifying ID, & enacting legislature made no efforts to determine law’s discriminatory impact on those burdened by it.
