UPDATES AT THE PRESIDENTIAL ELECTION PETITION TRIBUNAL TODAY FRIDAY 2ND JUNE 2023

Good Morning & welcome to Live Updates from PEPT.

The Court will resume by 9am, however, it's 7:50am and we can see the PO Team bring in documents for tendering.

We can see documents in boxes tagged Oyo, Edo, Lagos, Bayelsa, Akwa Ibom, Adamawa and other States.

How long it's going to take today, we don't know, but it's definitely going to be an interesting ride.

The court welcomes everyone and asked if we are prepared 'very well' for a seamless process.

Petition Timing:
Peter OBI Petition - 9am to 12pm
APM Petition - 12pm to 1pm

The court have decided to take the APM Petition first due to an observation that they may still adjourn today on the basis that they have not obtained the Supreme Court Judgment in the PDP-Shettima Case.

Recall that they adjourned in order to obtain the judgment.

Mr. Saturday chuckled, rose, bowed to the court and sat in style. Everyone laughs except me of course, I don dey hungry already, like sey I farm for dream.

Meanwhile, as Counsels for APM & Respondents announce appearance, Datti walks into court in his usual Gold Kaftan & high rising Hula (Cap native to northern Nigeria).

Counsel of the APM informs the court that they have not been able to obtain a copy of the judgment from the court, which was the reason for the adjournment on Tuesday.

They further applied for an adjournment so that they can obtain the judgment.

He further appealed that, subject to the convenience of the court, all parties in the petition have agreed to come back next week Friday, June 9, 2023.

Other parties did not object, hence, the court adjourned till Fri. 9 for the continuation of hearing.

HEARING SESSION RESUMES

The court is set to continue with the Peter OBI/Labour Party Petition this morning and the Atiku/PDP Petition will resume at 2pm

Recall that the Atiku Petition is yet to call any witness, since the start of the hearing, they've been tendering documents before the tribunal.

These documents include Forms EC8A and the likes, BVAS Report Data and many more from all 36 States of the Federation.

The 1st Respondent (INEC) noted that they will not object to any of the documents but those from 3 States; Kogi, Adamawa one other state.

The other Respondents objected to almost all the documents.

As they resume today by 2pm, we'll know the headway with that petition.

We've just been told to go out of the court and submit our phones before entry.

The 'No Phones and Gadgets' will be enforced today by the court.

A certain SAN (name withheld) was told to keep his phone outside before accessing the court. He simply looked, hissed & went in with his phone without being stopped. 😂😂😂

Amina JSC of the Supreme Court in the PDP suit against Shettima held that the principles in Nwosu v APC (2019) cannot apply for 2 reasons:

1. That Nwosu was nominated by two parties
2. That Nwosu participated in two primaries but Shettima participated in one

The provisions of S. 35, Electoral Act 2022 is in no different from S. 37, Electoral Act 2010 which applied to the Nwosu case.

ON THE FIRST REASON:
The law is clear that a CANDIDATE stands voided if he is nominated by:
a. More than one party
b. In more than one constituency... Image
It is clear by this provision that whether multiple nomination was done by multiple parties or done in multiple constituencies, such candidate stands voided and can never participate in an election.

Nwosu's case was in two parties, Shettima's case was in two constituencies...
