UPDATES AT THE PRESIDENTIAL ELECTION PETITION TRIBUNAL TODAY TUESDAY, 6TH JUNE 2023

Good afternoon & welcome to Live Updates from PEPT.

The Court is set to resume by 2pm since its adjournment from yesterday where the Petitioners tendered documents for 8 states.

For the summary of yesterday and today's proceedings, in PDF and Voice-overs, keep tabs on my account and @_weyimi as we will be making them available before the end of the day.

It is presumed that the Petitioners in CA/PEPC/03/2023 will today, take a step away from INEC CTC...
of Forms EC8As and proceed to tendering documents of Forms EC8Bs, which are Ward Collated Results from the various states they will be contending in the petition.

While these are presumptions, join us in court or stay glued to know the turn out of events.

Peter Obi, in the company of his Campaign DG and other party stalwarts just walked into the court. Oseloka @OselokaHObaze has been in court minutes before.

Man is never tired... It was Peter Obi that Guinness saw and made that advert 'MADE OF MORE'.

It's 2:25pm... The court will now sit.

The court apologized for resuming late as there were certain issues they needed to settle in Chambers.

We will now proceed to the suit.

The case CA/PEPC/03/2023 is now called from the cause list.

- Peter Obi represents himself and the LP, the Petitioners.

No other party is in court, Counsels will now announce appearances.

The Petitioners:

They have moved the court to tender INEC documents of Forms EC8Bs in respect of Bayelsa State.

Now to objections...

All the Respondents:

They all object to the admissibility of the Forms EC8Bs in respect to the 8 LGAs in Bayelsa and shall advance their reasons at the time of written address.

The Court:

The Court admits all documents of Bayelsa and marks them Exhibit PY1-8.

As the court pleases.

The Petitioners also moves to tender 23 copies of Forms EC8Bs representing the 23 LGAs of Benue State which is in line with their document and where all parties agreed to.
All Respondents:

The 1st, 2nd, 3rd and 4th Respondent all objected to the admissibility of the Forms EC8Bs from 23 LGAs in Benue State. They will give their reasons at the time of final written address.
Petitioners:
They further moved to tender certified true copies of Forms EC8Bs in respect of 21 LGAs in Kogi State duly paid for and certified by INEC.

All Respondents:
In like fashion, they all objected to the admissibility of the documents & reserved reasons for final address.
The Court:
My Lords admitted the CTC of Forms EC8Bs from 21 LGAs in Kogi State into evidence and marked them as Exhibits PAA1-21

SOME OF MY TWEETS DIDN'T DELIVER...

The Petitioners:
They moved the court to tender INEC documents of Forms EC8Bs in respect of 21 LGAs of ADAMAWA State.

All Respondents:
They objected to these documents and chose to advance their reasons later.

THE COURT ADMITTED THEM.
Petitioners:

They moved to tender CTC of Forms EC8Bs in respect of 11 LGAs in Nasarawa State.

The court asked about the particular LGAs and they responded that all of the LGAs listed in the Schedule are available apart from Karu and Keana.

The court is expressing displeasure about the dressing of counsels in court, Hon. Justice Tsammani was specific about the patterns of lady's hairs and how they are outrageous.

He told them to do 'guy' outside the court and not when appearing in court...
He noted that if this was a normal court seating, he'd have walked the lady in question out... Slay Lawyer in the House.

From tomorrow, the court will enforce it but for today, 'Go and Sin No More.

He told the Petitioners Counsel that himself is dressed like Ezemuo😂😂😂
Petitioners:
They now seek to tender INEC certified Forms EC8Bs of 21 LGAs of Sokoto State.

1st Respondent (INEC):
'We object to the tendering of INEC certified Forms EC8Bs for reasons we shall advance later' 😂😂😂

The Petitioners apologized and noted that Sokoto documents are for 23 LGAs and not 21 as listed in the Schedule.

Their position remain unchanged, they object to the admissibility of the documents and shall advance reasons at the time of written addresses.

There have been silence in court for more than 7 minutes now... The justices seem to be deliberating on something...
The court just noted that one of the LGAs document is not in the files submitted by the Petitioners as they cannot find it. It's for one Njaba LGA.

The Petitioners apologize and decide on 25 LGAs and will tender the one left subsequently.
The Court:
My Lords have now admitted all Forms EC8Bs in respect of 25 LGAs of Imo State and marked Exhibits PAH1-25.

As the court pleases... Next is Kaduna.

All Respondents:
Their position is the same, they object to the admissibility of the documents and shall advance reasons subsequently.
The court noted that they have in the files, documents for 21 LGAs and not 19 as stated by the Petitioners.

The Petitioners inform the court that they will add the extra 2 to make it 21 LGAs as opposed to the earlier 19 mentioned.
The Court:
My Lords ruled that all Forms EC8Bs with respect to 21 LGAs of Kaduna State are hereby admitted into evidence and marked as Exhibits PAJ1-21.

They will now tender INEC certified Forms EC8Bs covering 31 LGAs of Oyo State.

All Respondents:
They object to the documents for reasons they shall advance in their written Addresses.
The number of LGAs tendered by the Petitioners were corrected from 31 to 27.

The Court:
My Lords have now admitted all tendered documents of Forms EC8Bs with respect to 27 LGAs in Oyo State and marked as Exhibits PAK1-27.

Now to Cross-River...

Petitioners:
They have sought to tender all INEC obtained certified true copies of Forms EC8Bs for 18 LGAs of Cross-River State.

All Respondents:
They object to the admissibility and shall advance their reasons in their final written addresses.
The Court:
The Justices have now admitted into evidence, all tendered documents of Forms EC8Bs in respect to the 18 LGAs of Cross-River State. They are respectively marked Exhibits PAL1-18.

As the court pleases ..

Petitioners inform the court that they will jump Ebonyi which is not here and tender three more and close for the day.

They sought to tender documents obtained & certified by INEC as custodians of these documents, which are Forms EC8Bs of 16 LGAs of Edo State.

All Respondents:
In uniform manner, they objected to the admissibility of the documents and will advance their reasons later
The Counsel to the 4th Respondent observed that on the schedule to the documents, the Petitioners listed one LGA twice and would require some clarifications.

Based on this, the Petitioners noted that it is an error and stepped down one, thereby leaving Forms EC8Bs at 15 LGAs.
The Court:
The documents, Forms EC8Bs of 15 LGAs of Edo State were admitted into evidence by the court and Marked as Exhibits PAM1-15.

And now, to Akwa Ibom...

Petitioners:
They now seek to tender Forms EC8Bs of 31 LGAs of Akwa-Ibom State.

The Counsel to INEC offered to help the Petitioners in case they are having difficulty sorting their documents... The Petitioners responded with laughter in the air, that INEC deliberately scattered the documents to frustrate them.

Meanwhile...
All Respondents:
They all objected to the admissibility of the documents and shall advance reasons for the objection in their final written addresses.

The Court:
31 bundles of Forms EC8Bs from 31 LGAs of Akwa-Ibom are hereby admitted & marked as Exhibits PAN1-31.

And now the last for today...Lagos State.

Petitioners:
The Counsel applied to the court to tender all Forms EC8Bs for all 20 LGAs of Lagos State as evidence they'll use in proving their case at the tribunal.

And as usual..

All Respondents:
They objected and reserved reasons.
The Court:
The bundles of 20 INEC certified Forms EC8Bs arising from 20 LGAs of Lagos State were admitted in evidence and duly marked as Exhibits PAP1-20

The Petitioners inform the court that they have documents of Forms EC8Bs for Ebonyi State, but because it was not listed in the schedule, they can push it to tomorrow and thereafter, they will move into tendering documents for Forms EC8Cs.

It's raining heavily in the city of Abuja this afternoon, but it won't stop the court from holding. We will start shortly.

While we wait to continue the Peter Obi's case (CA/PEPC/03/2023) at the PEPT later today at 2pm, I decided to update you on all the documents submitted so far at the tribunal.

On Day 1 of the Hearing, Peter Obi tendered documents from the US District Court...
Showing evidence of the forfeiture of $460,000 by the 2nd Respondent (Tinubu).

Moving to Day 3 (1st June), Peter Obi moved to the tendering of PUBLIC DOCUMENTS duly certified by INEC. This they also did on Day 4 (2nd June).

Now let's look at these documents... Image
On Day 3 alone, Certified True Copies of Forms EC8A from 115 LGAs of 6 states were tendered. The states include Rivers, Benue, Cross-River, Niger, Osun and Ekiti.

All the respondents (INEC, Tinubu, Shettima and APC) objected to the tendering of each of these documents. ImageImage

Good Morning & welcome to Live Updates from PEPT.

The Court will resume by 9am, however, it's 7:50am and we can see the PO Team bring in documents for tendering.

HEARING SESSION RESUMES

The court is set to continue with the Peter OBI/Labour Party Petition this morning and the Atiku/PDP Petition will resume at 2pm

Recall that the Atiku Petition is yet to call any witness, since the start of the hearing, they've been tendering documents before the tribunal.

These documents include Forms EC8A and the likes, BVAS Report Data and many more from all 36 States of the Federation.

The 1st Respondent (INEC) noted that they will not object to any of the documents but those from 3 States; Kogi, Adamawa one other state.

The other Respondents objected to almost all the documents.

Notice on restrictions on phones and gadgets can still be seen within the court, but not yet enforced.

We've just been told to go out of the court and submit our phones before entry.

The 'No Phones and Gadgets' will be enforced today by the court.

A certain SAN (name withheld) was told to keep his phone outside before accessing the court. He simply looked, hissed & went in with his phone without being stopped. 😂😂😂

People are seated in court and carried out civil disobedience to the rule of keeping their phones outside. Image
