There's someone new in court... A right activist, political activist, lawyer and Spokesperson Southwest of the Peter Obi Campaign Team, Dele Farotimi @DeleFarotimi is in Court today...
He's on my check list of pictures today. I came late & couldn't give you all the live photos.
My Lords are here... The court will now sit @ 2:47pm.
- Dr. Livy Uzoukwu SAN leads the Petitioners Team. And from the outer Bar in the team is my very good friend and brother, Vincent Otaokpukpu Esq. (The Bone 🦴 Crusher) 🌚🌚🌚
- AB Mahmoud SAN leads the 1R Team.
- Chief Akin Olujimi SAN leads the 2&3R
- LO Fagbemi SAN leads the 4R Team.
The Petitioners will now call a witness... It's about to get interesting...
The Petitioners and the court are trying to sort out the document showing the list of witnesses and every other thing in respect of the witness about to be called.
The court asked that the document be paged again and the Petitioners have done that.
We will now proceed...
The Witness have now taken the Witness Box and have now sworn an oath.
Where do you Live:
- I live at 7 Khartoum Wuse Zone 5 Abuja
Occupation:
- I'm a software engineer and an architect.
Did you sign your witness statement:

Can you recognize the Statement
- Yes
He now recognizes the statement and agrees that he wishes to adopt it as his witness statement on oath.
Ikwueto SAN:
He identifies both motions having been given the permission to do so by the court.
He notifies the court that since the respondents replies the motions, the Petitioners have a reply on point of law with written arguments made in that respect.
The motion on notice of May 22 have two substantive prayers and is supported by 13 grounds upon which it is brought.
This motion is also accompanied by affidavits with 6 substantive paragraphs and Exhibit A is attached to the Affidavit which is the Petitioners Interrogatories...
for delivery on the 1st Respondent as they deal with the cardinal issue of non-compliance against the 1st respondent.
Ikwueto SAN urged the court to consider the motion in line with the Exhibit A attached and asked that they decide it in the interest of Justice.
1st Respondent:
With respect to the May 22, 2023 Motion, they filed a counter affidavit on May 25 alongside their written address on the same date.
With respect to the June 2, 2023 motion, they filed their counter affidavit on June 5, accompanied by their written address.
They adopt all the arguments canvassed in the addresses and with specific reference to the latest written address.
They drew the attention of the court to the case of Eketione v. INEC (2019).
They prayed the court to dismiss the application on the basis that it was filed 26 days after the close of filings.
2nd and 3rd Respondents:
They noted that they've filed responses to the motion by the Petitioners dated 6th June.
They humbly adopt their document and urged the..
Court to dismiss the two applications.
The counsel told the court that they will like to reply to the reply of the Petitioners filed yesterday. (It's unheard of that a party replies to a reply)
The court reprimanded him and noted that it wasn't possible to reply a reply.
🤦🏾♂️🤦🏾♂️
4th Respondent:
They identified also, their documents, counter affidavits and written addresses opposing the motion by the Petitioners.
They further urged the court to dismiss the motion. He noted (sarcastically) that they will not be asking for cost if the case is dismissed.
Ikwueto SAN noted that they'd have brought another (subpoena) witness however, they'd like to continue the tendering of the documents.
He said they can take the EC40G series if the Justices will be disposed to continue with the proceedings.
Ikwueto SAN hands back to Dr. Livy SAN who hands to Prof. Paul Ananaba SAN:
The Petitioners now seek to tender INEC certified true copies of Forms EC40G for Bayelsa State.
1st Respondent:
They object to the admissibility of the documents for reasons they shall advance later.
2nd and 3rd Respondents:
They too object to the admissibility of the documents and shall advance their reasons at the stage of final written address.
4rh Respondent:
They object to the admissibility of the documents and their reasons shall be embedded in their final address.
The complains, yet again, about the manner which the documents are piled. The Justices expressed displeasure that sometimes they mention more documents and actually tender less until corrections are noted.
The Court:
The bundles Certified True Copies of Forms EC40Gs in respect to 4 LGAs of Bayelsa State are hereby admitted into evidence and marked as Exhibits PG1-4 accordingly.
Dr. Livy SAN thanks the Justices for their efforts and ask that the hearinf continues by 2pm tomorrow Friday June 9, 2023, subject to their overriding convenience.
What the law envisages in Section 58 CFRN is that, for a bill to become law, there must be concurrence of both the Senate and the House of Reps. That is, the bill must be passed concurrently by both houses of NASS.
Once the president signs this bill, it becomes law.
In simpler terms, 3 structures makes a bill become law.
- Senate must pass the bill
- House of Reps must pass the bill
- President must sign the bill
Where these three play this role, a bill will become a law, passed and assented to.
For the summary of yesterday and today's proceedings, in PDF and Voice-overs, keep tabs on my account and @_weyimi as we will be making them available before the end of the day.
It is presumed that the Petitioners in CA/PEPC/03/2023 will today, take a step away from INEC CTC...
of Forms EC8As and proceed to tendering documents of Forms EC8Bs, which are Ward Collated Results from the various states they will be contending in the petition.
While these are presumptions, join us in court or stay glued to know the turn out of events.
While we wait to continue the Peter Obi's case (CA/PEPC/03/2023) at the PEPT later today at 2pm, I decided to update you on all the documents submitted so far at the tribunal.
On Day 1 of the Hearing, Peter Obi tendered documents from the US District Court...
Showing evidence of the forfeiture of $460,000 by the 2nd Respondent (Tinubu).
Moving to Day 3 (1st June), Peter Obi moved to the tendering of PUBLIC DOCUMENTS duly certified by INEC. This they also did on Day 4 (2nd June).
Now let's look at these documents...
On Day 3 alone, Certified True Copies of Forms EC8A from 115 LGAs of 6 states were tendered. The states include Rivers, Benue, Cross-River, Niger, Osun and Ekiti.
All the respondents (INEC, Tinubu, Shettima and APC) objected to the tendering of each of these documents.
Mr. Saturday is in court already, even though it's a Friday. Man is looking too good to be representing the Respondent.
Anyways, I'm in court too, with my dear elder brother @realevabest, please follow him. I want to appear as Amicus Curiae today 😏😏 But I forgot my wig & gown.
