TRUMP (BUSINESS) RECORDS: I was in court today for argument about where the Manhattan DA’s criminal case against Trump should be heard: in state court where it started or in federal court, as Trump wants. And after 2.5 hours and a surprise witness, it went exactly as expected. 1/
At the end, and while warning nothing he was about to say is binding, SDNY Judge Alvin Hellerstein practically announced the case will return to state court. That is not a shock. The more interesting part is why Team Trump flamed out, despite some fireworks. 2/
The crux of Trump’s argument was that as a former federal officer, he’s entitled to remove the case to federal court because the Manhattan indictment was “for or relating to any act under color of such office.” Specifically, he argued he hired Cohen as his personal lawyer… 3/
because of the need to separate the personal from the presidential in order to appropriately carry out his duties with fidelity to the Constitution. And therefore, his retention of Cohen as his personal lawyer was directly related to his status as president. 4/
That was a fine story, Hellerstein suggested, but Trump offered not a single piece of evidence to prove it was rooted in fact. As Hellerstein’s impatience grew, Trump lawyer Todd Blanche said he had a witness with personal knowledge of those facts ready & waiting. 5/
And minutes later, after a short recess, Blanche called Trump Organization chief legal officer Alan Garten to the stand. 6/
Garten has been with the Trump Organization since 2007; his office was adjacent to Michael Cohen’s. And he was hardly the slam-dunk witness Trump’s team promised. He confirmed he has never seen any retainer agreement with Cohen & doesn’t know what services Cohen provided. 7/
And he could not articulate exactly why Cohen was hired as Trump’s personal attorney except to say that he and Eric Trump wanted to ensure that they did not undermine Trump’s separation from the business, as advised by his lawyers at Morgan Lewis. 8/
There was argument on whether Trump has a colorable federal defense on preemption grounds, but the die was cast once Hellerstein accepted the crux of the DA’s argument: That Cohen was Trump’s personal lawyer, paid with Trump’s personal funds, and handled personal affairs. 9/
And the fault was Team Trump’s. Not only did they violate a prior agreement with the DA’s office not to call live witnesses, but they called the chief legal officer of Trump’s business, who could not attest to some of their key points and made some damaging admissions. 10/
It was a bold gamble without any payoff. And something tells me that tonight, Todd Blanche, Trump’s shiniest new legal toy, is no longer feeling so golden. FIN.

And then Mr. Santos asks a good and reasonable question, “What would happen to him if he get[s] caught traveling at areas that he’s not allowed to?” And the Court gives a plain, stark response: “There would be a warrant for his arrest.” Santos’s dad realizes the seriousness. 2/
He seems to appreciate that it’s now his and his aunt’s role to make Santos understand he can’t leave the country, much less the limited places he’s allowed to travel within the U.S. The aunt gets that too, that they have to ensure he stays “on the line.” 3/

There’s a ton of GOP griping about Hunter Biden’s supposed sweetheart deal. That not only ignores fundamental differences in the gravity and duration of the alleged crimes, but also neglects some critical context: David Weiss did not staff the matter with Delaware lifers. 1/

Hi, friends. I’ll be on with @NicolleDWallace at the top of 5 p.m. to share my observations from the courtroom, but the thing that really sticks with me concerns Walt Nauta. As Trump left, Nauta left with him, falling into the line of Secret Service agents trailing him. 1/
In an instant, he went from being a co-defendant to resuming his duties as Trump’s aide. This guy has not cooperated—and barring additional charges or even more damning evidence than that highlighted in the indictment, I don’t expect him to. 2/
And if Nauta’s loyalty is being rewarded in the form of salary and legal fees, there is another former close Trump aide who I imagine is persona non grata right now. Her name is Molly Michael, and according to WaPo, she is Trump Employee 2 in the indictment. 3/

Trump Docs: In confirming that Trump's lawyers did not locate the memo he referenced in the Bedminster meeting, NYT also just named another attendee at that meeting: Liz Harrington, a spokesperson for the former president. 1/

But the Times also makes clear Margo Martin and Harrington were not the only Trump aides at the meeting; rather, they were among "a small number of aides to Mr. Trump" in attendance. Who were the others? 2/
And we know that folks working for Mark Meadows in connection with his book were also there. Whether they were ghostwriters or researchers, one would think those folks would be identifiable by now, no? 3/

TRUMP: Tonight’s @nytimes and last night’s Guardian reporting disagree as to when DOJ subpoenaed & imaged Margo Martin’s phones and laptop. NYT says it was after her March grand jury testimony; Guardian says it was before. But both agree DOJ had the tape before her testimony. 1/
It seems unlikely to me that DOJ would have Martin testify and only later seek her devices. After all, once she knew what they had, the incentive to destroy evidence by wiping her phone or dropping her laptop would have been strong. 2/
But let’s suppose the NYT’s source is correct, and DOJ had the recording both before Martin’s testimony and before issuing subpoenas for her devices. That would mean someone else had the recording and turned it over to DOJ. The question is who? 3/
