🧵🪡 🧵🪡Some additional thoughts about the legal pointlessness of a Pomerantz deposition, apart from the question before the Second Circuit of whether the deposition should be allowed to proceed:
There are really only three general subjects that the House committee could ask Pomerantz about.
(1) They could ask him questions about Michael Cohen’s credibility. That won’t help Trump legally because:
(a) it wouldn’t be admissible evidence at a Trump trial; and
2/
(b) no matter what Pomerantz’s views are, Cohen’s credibility can be attacked on the basis of his prior lies, but is bolstered by (i) the fact he lied in part to help Trump, and by (ii) documentary evidence—like the reimbursement checks Trump signed—that back Cohen’s story.
