Hearing from 2 sources, familiar with the special counsel grand jury on J6, that Trump's consideration of using purported fed. authority to seize voting machines is under scrutiny. SC probing whether there was criminal intent to build a premise for delay/block in certification...
Why this matter... investigators, I'm told, are interested in whether Trump was CHOOSING, verbally and in documented exchanges, to buy into S. Powell/Flynn suggestion that, by claiming voting machines were problematic, the election had to be sent back to the states...
See p. 194 of Peril. Look at what Trump says to the group in the room, per our reporting: "I care about getting these machines... I want to get these machines and I have a right to do so... "
One interesting element of this is that Giuliani despised Sidney Powell & crew and thought they were encroaching on his turf. So the SC, I'm told, is looking at how Rudy was working states for Trump, all while Powell/Flynn were working machine angle. Related but diff't schemes...
As SC explores whether there was provable criminal intent, it's becoming, at the least, a wide-ranging probe exploring how plots to overturn election developed, the sources said... whereas Rudy wanted to push states to have special sessions, the Powell group wanted fed. power...
Many Qs for witnesses, I'm told, related to whether people knowingly used fraud to try to achieve their ends. Did they know the alt. elec scheme was based on lies/bad intel? (Rudy had so many affafidavits coming in.) And did they push machine scheme knowing they weren't at fault?
Final thoughts for tonight: the reason it seems mid-December now matters in the probe is that it's BEFORE the Pence scheme really kicks in and picks up speed. It's the closest Trump comes to bringing in Powell to WH, considering EOs on machines. A moment of planning, decision...
So while "use Pence" scheme is certainly also key part of probe, SC team clearly asking questions about WHAT ELSE was considered, how, and WHEN did Trump mention it and why, and how did he respond to attys? Alt. electors, seizing voting machines, pressuring state officials, etc.
Recall, many people in that 12-18-20 Oval mtg. are cooperating w/ SC on J6 probe and repeatedly told Trump that what Powell was suggesting was not true or legal. Trump's response to guidance from attys is part of understanding his motivations and conduct.
The question remains, though, whether SC will seek indictments or write up a lengthy report... no one I've spoken with, with varying levels of connection to the investigation, is quite sure what Smith will do... the constant word is this is "serious" but hard to predict.

NEWS (thread): I've been hearing for months that some major GOP donors are interested in recruiting a late entry into 2024 race, even in early 2024, if Trump is convicted or continues to face legal challenges yet dominates the field. Two names routinely come up: Kemp, Youngkin...
Today @CBSNews had an exclusive, lengthy sitdown with Gov. Brian Kemp of GA, who has clashed with Trump over 2020 but is widely seen on right as fellow conservative, be it on handling the pandemic or social issues. I asked him about my latest reporting on the late-entry talk...
How Kemp, who maintains he is focused on GA, ends the exchange: "In politics, there's always doors opening and closing and everything else, but I've learned over the years, it's best for me to stay focused on the task at hand. And the good Lord will take care of everything else."

(Thread) learning some new things this morning about WHY this all happened and the motivation, especially for the audio from 2021 discussing classified material. In short, it comes down to one person: *Milley.* Trump loathed his coverage in press, in books, per multiple sources…
As Trump fumed in post-presidency period about Milley, in his view, being cast as a hero and himself as an insurrectionist, he began to talk regularly about Milley in 2021, dismissing him and bringing up stories that made Milley seem unintelligent and untrustworthy, per sources
Trump’s anger about Milley led him to be cavalier about what he said about Milley and their interactions & policy decisions, and it frustrates some aides who notices how he would veer into dicey/near classified material in convos. Then Trump started to do interviews for books…

(thread/tonight) What I'm hearing... Trump is frustrated not just with the indictment but with people in his inner circle who reassured him for months that it was very unlikely to happen... source close to Trump says "too much happy talk for way too long" about what could happen
A second source close to Trump says "Trusty knows the special counsel" and is expected to try to work with Rowley and Blanche to figure out exactly how to play the next step, which will be a move to dismiss/formal attempt to question special counsel and especially DOJ's Bratt...
Monday's mtg. with DOJ didn't go well. It was mostly the Trump team laying out their concerns and the DOJ officials listening. This was not a negotiation or a friendly "let's see where things stand" meeting, per multiple people briefed on it... Blanche didn't go but was briefed

(thread) Have covered Christie closely since his run for governor in 2009. Watching his NH town hall tonight. He's now in the race. A few observations... he's starting this bid on low simmer. Reintroducing himself to voters, casting himself as a thoughtful, seasoned GOP hand...
At age 60, after failed bid in 2016 and the scars of the bridge scandal still there, he's not entering with a rah-rah or bombastic message. This isn't (yet) the fiery Christie of 2010/2011. But there are echoes of his 2013 reelect in this 2024 campaign pitch...
He's saying to GOP voters: I know who I am. I know what you think. But maybe, if I can reimagine my own career and try to think "big" (his theme), the party can think about reimagining itself with him as a guide/standard-bearer. It's not an ideological case but an exit ramp.

BREAKING: Trump’s lawyers just spotted by @CBSNews entering the Justice Department, per @RobLegare who is on site… comes as sources tell me the special counsel is moving toward a charging decision in the classified documents case
Sources tell @CBSNews that Trump’s lawyers are expected to raise concerns about how prosecutors have handled atty-client questions during the grand jury but there is no sign the special counsel is going to waver from how he and his team have handled the crime-fraud exception…

(thread) This Pence development today is significant and potentially historic. A former vice president is now willing, within certain specified constitutional grounds his lawyers fought to arrange, to testify about potential illegal acts by a president.
cbsnews.com/news/mike-penc…
Trump's lawyers might try to appeal Pence's decision, but they keep losing efforts to assert exec. priv. with this grand jury.

That means Pence could appear before Jan. 6 grand jury in the coming weeks to testify under oath about what exactly Trump did and said in private.
Think about what this means. The special counsel could now get a first-hand account of what Trump specifically said to Pence in Oval Office meetings ahead of Jan. 6, as long as Pence and his lawyers do not consider those conversations related to his specific constitutional role.
