1/12 @SenatorDurbin & @SenWhitehouse want to impose ethics law on Supreme Court to which Congress itself is not subject. This follows Congress double standards w/ Executive Branch where Congress isn't subject to FOIA nor any record keeping requirement for Members. Pure hypocrisy!
2/ Congress is not subject to any recusal law and House and Senate Ethics Manuals state Members can vote and work on any matter that directly affects their own financial interests. That would include their spouse's (and spouse's clients) financial interests.
3/ Here are Senate and House Ethics Manual pages. How in the world can Congress exempt itself from recusal laws and attack Supreme Court on this issue?

4/ Justices are subject to recusal law in 28 USC 455. Executive Branch officials are subject to criminal provision on recusals (18 USC 208). But zip for Congress. See how this works? It’s pure hypocrisy.
5/ How about Congress applies every provision in this bill (S. 359) to itself? Let's see how serious @SenatorDurbin & @SenWhitehouse are about accountability and transparency. @SenJudiciaryGOP @JudiciaryDems

Per recent article, since 2007, there have been 1,523 complaints filed with Senate Ethics Committee with ZERO disciplinary actions. Senate needs to reform itself first.

Congress is at 16% approval & 61% disapproval, a dangerously low lack of faith in a government institution. Some polls have disapproval at 70% (+).

12/ As I testified last year, there is no ethics problem at Supreme Court. Dems just hate Court now that it is issuing opinions faithful to Constitution. To support any “ethics bill” would be to validate these baseless & partisan smears. Congress should focus on reforming itself.

1/ @SenWhitehouse & media ignore Justice Jackson’s clear violation of ethics law. Jackson admitted she failed to disclose source of husband’s consulting fees in past, then failed to disclose info correctly on 2022 nomination form & again in this year’s filing. Double Standard??



2/Jackson is required to list husband’s LLC name or sources of income. She has not. @SenWhitehouse & media will ignore because they just want to use “ethics” as weapon, invent “ethics” issues for originalist Justices & ignore blinking red-light violations by liberal Justices.
@SenWhitehouse 3/ Jackson listed “self-employed consulting income . . for medical malpractice cases,” “Legal malpractice consulting,” and on this year’s form “self-employed (expert witness fees).” None of those descriptions list the SOURCE of the funds, as required by law.

2/ @js_kaplan, @justinelliot @eisingerj either knew Judicial Conference cleared Thomas & were dishonest or did sloppy reporting & didn’t know. Journalism ethics 101 requires reporters to mention this important fact in its story. I asked them but they refused to answer.
3/ To recap: In 2011, @nytimes ran story on Thomas traveling with Crow on his private plane and boat and staying at his summer home in Adirondacks. 20 Members of Congress filed ethics complaints with Judicial Conference accusing Thomas of violating law for not disclosing trips.

1/ Justice Thomas complied with ethics law when he didn’t disclose trips under personal hospitality exception. In 2011/12, Judicial Conference specifically reviewed complaints Thomas hadn’t properly disclosed trips and concluded Thomas acted properly in not disclosing.
2/After complaints filed in Jan 2011 on Thomas not disclosing wife’s salary, which was inadvertent, there were complaints submitted based on June 2011 NYT story on Thomas traveling on Harlan Crow plane & boat & staying at Crow's summer home, Topridge.
