1) Crypto Legislation Vote Recap: If you didn't spend the 20+ hours watching the various vote series on crypto legislation, this recap is for you. This entire week was unexpected on a number of fronts. Since it's Friday, I thought I'd channel my inner @NeerajKA and do some memes: Image
2) Bill #1: Financial Innovation and Technology for the 21st Century Act (aka the market structure bill). Unprecedented, but this bill passed the @FinancialCmte by a margin of 35-15 with 6 Ds joining the Rs in support. In @HouseAgGOP the same bill was voted out with 0 opposition. Image
3) Takeaway from FIT21: Gensler is continuing to lose the narrative that all tokens are securities especially within his own party as 6 Democrats bucked his "there's no need for legislation" talking point. Age also continues to be an indicator in terms of supporting a framework.
4) Bill #2 Clarity for Payment Stablecoins. Politics/White House got in the way and what was expected to be a deal between lead R @PatrickMcHenry and lead D @RepMaxineWaters divulged into a dramatic standoff. Despite some charged moments, stablecoin passed with all Rs and 5 Ds. Image
5) Takeaway from stablecoins: The White House wouldn't have objected at this stage if they thought this bill had no shot to be signed into law. Politics overtook policy. Even with the White House's objection, 5 Ds joining the Rs is notable especially considering many are senior.
6) @GOPMajorityWhip Blockchain Regulatory Certainty Act and @WarrenDavidson Keep Your Coins Act passed, but on party line vote. These crypto OGs (along with @RepDarrenSoto) laid the groundwork for the FIT Act and have moved to other priorities like self custody. Image
7) Reminder, this was just at the committee level. The next step is getting these bills to the House floor for a vote which should be in the fall. Overall, @RepRitchie said it best "'regulation by enforcement' not only had a bad day in the courts, it had a bad day in Congress."

1) This week in Congress and crypto: As of right now, the stablecoin and market structure bills are slated for a vote in the House committees next week. A lot of back and forth behind the scenes, but the Ripple case has made a huge impact on the politics of the bills. Here's why:
2) Off the bat, the SEC has put senior Ds in Congress in a weaker negotiating position. While the case wasn't a full "win" for Ripple, it has significantly weakened the SEC's arguments that 1) legislation wasn't needed and 2) the SEC never lost a crypto case in the courts.
3) D's position on legislation wasn't always a no. In fact during my time on the Hill in 2018, senior Ds @RepMaxineWaters and @SenSherrodBrown met with @WarrenDavidson and me to discuss legislation to regulate crypto and they said it was something they agreed needed to be done.

1) This week in Congress and crypto: Even though the Binance and Coinbase lawsuits by the SEC last week were expected, many in Congress are curious about the timing of the enforcement actions. This wasn't the first time the SEC's timing seemed politically motivated for crypto...
2) To level set, the actions against Binance weren't surprising in the slightest. Binance has a shady rep in DC and there are multiple agencies still investigating them including the DOJ. That timing didn't seem suspect. The action against Coinbase was suspicious though.
3) Coinbase's enforcement action announcement came just ONE hour before Coinbase's CLO @iampaulgrewal was slated to testify in front of the House Ag Committee. The hearing topic: legislation to regulate crypto at both the SEC and CFTC. The SEC's action dominated the hearing.

1) This week in Congress and crypto: Another week, another House crypto hearing except this time it is an unprecedented joint hearing between the House Ag and Financial Services Committee. The topic: Market Structure. No bill draft or principles out yet so here's what to expect..
2) Joint hearings are rare in Congress. Each Committee fights hard for its jurisdiction and even when they bleed over, rarely do Committees work with each other. That doesn't seem to be the case in the House and that is promising for the 10 AM Wednesday hearing.
3) This is the 2nd round of hearings on market structure. On April 27, both Committees held similar hearings on market structure at the same time. R's all in lockstep saying legislation is needed. Same with Ag Ds. For Financial Services, over half of the Ds agreed on legislation.

2) Market structure is a vague term but it is an important element of crypto regulation. There are many questions and conflicting messages from the CFTC and SEC about where their jurisdiction starts and stops in the crypto sector. In wake of this confusion Congress is stepping in
3) In a rare move, @HouseAgGOP and @FinancialCmte will be having their own respective market structure hearings on Thursday. This move to have hearings on the same day isn't to compete with one another, but rather the opposite. It is a sign they are tackling the issue together.

1) This week in Congress and crypto: March has been another brutal month for the crypto industry. The one action that has undoubtedly galvanized the industry in DC is the Coinbase wells notice. This is seen as an outright attack on crypto in America and many aren't happy...
2) The Coinbase well notice vs the Binance CFTC enforcement action is an important distinction. On one side an American company has done everything to engage policymakers, educate staff, testify in hearings, and offer solutions to compliance.
3) On the other, there's a foreign exchange with a shady track record in compliance, little engagement in DC, and has been poorly received by both pro-crypto and crypto-skeptic policymakers in Congress. Yet, in DC the outcomes for the two firms are nearly identical.

1) This week in Congress and crypto: Lots of questions and not many answers. Policymakers have been getting briefed by regulators daily on SVB. This story will be front and center of nearly every policy debate, including crypto, in the banking committees. Here's the latest...
2) It is pretty interesting to watch the trad-fi policy world deal with the sheer information flood that is Twitter. For many crypto folks this is standard, but not as often for trad-fi folks. Regardless, there is MUCH more noise than substance and it is causing problems.
3) DC sees a huge sector devastated by a crisis and is now looking for a culprit. It seems as if mainstream Rs are placing the blame on the Fed supervisors. Mainstream Ds are saying the 2018 bill, S 2155, which made changes to Dodd-Frank (remember 17 Senate Ds voted for it).
