Just finished reading and marking up the indictment. 130 paras over 45 pages. Thoughts:
This is a “speaking indictment” alleging, in plain terms, a conspiracy to fraudulently overthrow the results of the 2020 election by preventing Congress from certifying the results.
The
indictment is clear and it is detailed.

The indictment is NOT focused on the speech of 1/6 or solely on the events of 1/6.Anyone who tells you that Trump is being prosecuted for giving a speech on 1/6 is lying. The statements made in the speech are discussed in one para (#104)
out of 130.

What the indictment shows in great detail is a sweeping conspiracy that started on 11/14 and continued into the evening of 1/6 to overthrow the election.

The indictment shows that Trump knew the claims of fraud were false, based on statements from
a cast of characters ranging from state officials to state legislators to his own personal attorneys to DOJ attorneys to personal advisors and courts.

There are many heroes of this story, most of them Republican electeds who refused to violate their oaths. They range from VP
to Bowers from Arizona to Raffensperger in Georgia to Michigan legislators to DOJ officials.

A great villain in this story is Jeffrey Clark (co-conspirator 4). Trump tried to install him as acting AG on 1/3. He accepted the offer. It didn’t happen only because that same day
at an Oval Office meeting the top leadership threatened to resign en masse. Had Clark been installed as AG our democracy would likely not have survived. This man’s actions and his desires as recounted in the indictment are absolutely chilling. He is, in my opinion, one of the
great villains in American history and a disgrace to the Bar.

The pressure placed on Mike Pence was immense. I don’t personally care for Mike Pence, the politician. But we all owe Mike Pence a debt of gratitude for withstanding the pressure placed on him to act illegally.
Trump’s lies are catalogued in exquisite detail. Just one of dozens of examples: after being explicitly told by the GA SOS that his investigation showed that two (!) dead people voted in GA, Trump continued to lie that 10,000 dead people voted in GA.

The special counsel has
access to some very interesting evidence that in some cases goes beyond what the J6 Committee had, including Pence’s personal contemporaneous notes of meetings and conversations, referenced multiple times.

We know that an indictment is not a conviction and that the defendant
is presumed innocent. However, this indictment is damning, both in the scope of the conspiracy and in the amount of facts marshaled to prove the conspiracy. I don’t see how Trump escapes conviction on these charges.

End.

The Indictment. I’ve read it; encourage everyone to read it.
The charges are serious, 37 counts naming Trump, carrying max penalties of 5 - 20 years each.
There is no indication, from the facts laid out, that Trump sought to sell or give the info to any foreign country. I’ve
always doubted that as motivation, and doubt it more now, for at least two reasons: (1) it’s not charged or mentioned; (2) most of the documents seem to date from 2018-19, many relate to military capabilities and plans. I’m no intelligence expert but it seems like such documents
would become less valuable over time as the information in them becomes dated.
The most likely explanation to me, the one that is most consistent with Trump’s character and the facts alleged, is much less fantastical and more banal: mere hubris.
Trump kept them because he

The Framers surely did not intend to create a country where citizens would be routinely massacred at churches, schools, and on shopping trips. That is not “life, liberty, & the pursuit of happiness”. Can all Americans agree on that much?
I believe they would have acted to
protect the liberty of citizens to go about their daily lives in peace.
Better gun regulation is not the sole answer to what ails our society. But it must be part of the answer. In a society awash in guns and no shortage of people willing to use them for criminal or psychotic
reasons, the peace abiding citizens must demand better.
There are many concrete proposals out there that protect law abiding citizens’ rights to own guns while making significant changes to keep guns away from those who mean harm. These all need to be pursued with vigor. Pass

I went down a bit of a rabbit hole this morning and violated one of my rules - you’ll never debate anyone out of their position. You’ll only harden their position. So I’d like to approach this issue in a bit different way. Rather than debating it, I’d ask folks to consider this:
Try to put yourself in another person’s shoes. Imagine that you are a young person, or any age person, and all your life you have felt same sex attraction the same way the vast majority of us feel opposite sex attraction. Now imagine you are a Christian, raised in the church,
have done your best all your life to follow Jesus. Now imagine that you hear constantly, from people who know you, friends, family, and from people who don’t, leaders, pastors, folks on line, about how evil you are. How you, yourself, are a symptom of nothing less than the

Just listened to this Grammy winning song. Wow.
“Just like that”. We had an event happen on January 22d that I haven’t talked about here. Not yet. It was one of those “just like that” moments. Could have been. Anyway this is extremely moving.
Just to follow up. 1/22 I was maybe five miles behind our son the junior golfer caravanning back from a golf tourney - when a call came in from his best friend’s mother in tears telling me her son called and they were in a terrible wreck and might have killed sometime. In shock
I jumped on phone with 911 and started looking for them. At that point having no idea of my own son’s condition. In minutes rolled up on the wreck, before any law enforcement arrived, just me and a couple of passersby (very rural stretch of road). It was a horrific scene. By what

I’ve stated repeatedly my belief that Trump should be indicted over 1/6. I know folks get frustrated over the slow pace of things. I offer two rejoinders:
(1) We must be careful not to overestimate what the legal system is capable of doing. The system is strained to the maximum
when the highest elected official whose very job it is to see that the laws are faithfully executed is, himself, a criminal. I don’t know of any better legal system than ours and I don’t know of any legal system anywhere in the world that wouldn’t struggle to deal with that basic
fact. While an indictment and prosecution is, in my view, necessary, it is not sufficient to fully address our problem. It could even backfire if he is tried but not convicted. The problem we face, as a nation, is a political problem at heart, not a legal one. Trump and Trumpism
