NOTBALE: Prosecutors want to begin jury selection in December 2023 but then delay the start of trial until after the holidays. https://t.co/G19RfFGouQstorage.courtlistener.com/recap/gov.usco…
Prosecutors say they expect to produce almost all of the evidence in the case to Trump by Aug. 28, including:
Prosecutors: "It is difficult to imagine a public interest stronger than the one in this case in which the defendant — the former President of the United States — is charged with three criminal conspiracies intended to ... disenfranchise voters." politico.com/news/2023/08/1…
Prosecutors dig at Trump's counsel for saying Trump is preparing his defense from scratch. He's seen extraordinary swaths of evidence via the Jan. 6 select committee, they note, and has had contact with DOJ about the case since at least June 2022. politico.com/news/2023/08/1…
Also, prosecutors say there's a "minimal" amount of classified information that might be shared as part of discovery, so they want Chutkan to set a CIPA hearing to follow the already-scheduled Aug. 28 scheduling hearing. politico.com/news/2023/08/1…
SIDE NOTE: Jury selection for the Proud Boys seditious conspiracy trial began on Dec. 19, broke for the holidays and finished by Jan. 10. Prosecutors proposed schedule seems to envision a selection process that goes a similar length. politico.com/news/2023/08/1…
And if selection begins in Trump trial on Dec. 11, as envisioned by the government, it woudl mean questionairres or other pre-selection vetting processes would have to begin weeks earlier. politico.com/news/2023/08/1…

NEWS: Prosecutors now say Hunter BIDEN plea deal is unlikely and the case appears headed for trial. https://t.co/8Ix34jIi6vstorage.courtlistener.com/recap/gov.usco…
Prosecutors also say venue for the charges is in either California or DC. Rather, venue for these offenses and any other related tax offenses lies either in the Central District of California or in the District of Columbia
Currently imagining Hunter Biden and Donald Trump on trial in Washington D.C. at the same time.
Almost entirely Jan. 6 defendants, Donald Trump and Peter Navarro. (Plus trial of anti-abortion activists charged with barricading a clinic)
Trump’s attorneys John Lauro and Todd Blanche are in the building. Hearing starts at 10 with a focus on setting a protective order governing evidence-sharing in the case.
About to get underway here. Blanch, Lauro and Lauro's colleague Gregory Singer are seated at defense table. Molly Gaston and Tom Windom at prosecution table. @libradunn is in the gallery. Paul Kamenar, a veteran of various Mueller fights, was spotted with Trump legal team earlier
Chesebro's arc begins with this Nov. 18, 2020 memo that describes need to appoint alternate electors as a backstop in case Trump succeeded in court. He identifies Jan. 6 as a "head deadline." https://t.co/Rb6hCcUXdApolitico.com/news/2023/08/0…
But CHESEBRO's advice took a sharp turn on Dec. 6 — thanks to @lukebroadwater & co. for unearthing this missing link memo — when he framed the alternate electors as a way to prevent Biden's election. https://t.co/H0Fpxhd9H6politico.com/news/2023/08/0…
NEWS: Special counsel Jack Smith obtained a search warrant for Donald Trump's Twitter account in January.
A delay in compliance by the company prompted a federal judge to hold Twitter in contempt and fine the company $350,000.
Details TK
At the heart of the issue was a "nondisclosure order" appended to the search warrant, prohibiting Twitter from disclosing the existence of the warrant to anyone. Twitter objected to that restriction and delayed producing Trump's data.
MORE: Twitter wanted to disclose Jack Smith's search warrant to Donald Trump. A judge said no because disclosure could jeopardize the ongoing investigation. But Twitter still resisted turning over documents for another week, resulting in daily fines.
JUST IN: Special counsel team says it can be ready for a hearing on any day this week. Trump team asks for a Monday or Tuesday hearing, even though Judge Chutkan asked to set a hearing by this Friday.
Unclear why Trump lawyers can’t meet Wednesday and why Friday is off the table
One very obvious option is to do it Thursday afternoon and have Blanche call in remotely from Florida, since arraignment will be long over by then.
UPDATE: Judge Chutkan has set the next Trump case hearing for *Friday* at 10 am. Unclear if Lauro can make it, given earlier representation.
JUST IN: Trump has filed his response to the special counsel's motion for a protective order. Read the 29-page response here: documentcloud.org/documents/2390…
The biggest point of contention: Who is Donald Trump allowed to share evidence with to prepare his defense. His team wants a very loose definition that could allow for "volunteer attorneys" or others without "paid employment arrangements."
