Before their sexual encounters became national news, MLB pitcher Trevor Bauer and the woman who accused him of rape discussed what happened in a 27-minute call covertly recorded by police.
Lindsey Hill: "I'm just kind of trying to understand, like, do you think that's OK, like? Or, like, how could you think that's OK? If you, you know, like, if that makes sense."
Trevor Bauer: "Yeah, yeah, that makes sense. I understand."
FULL RECORDING:
I got the recording Monday night and soon fell into a silo while grappling with the magnitude of what I had.
It was tempting to throw the recording online immediately, but there is so much more to this case and all the litigation.
The 27-minute recording should be listened to in its entirety, but this is an interesting clip. Bauer doesn't outright offer Hill money, but he says "if there's anything I can do to help you, like, you mentioned, like, missing work, like. I just, I want — to want to make sure that you're OK. Honestly, like, if I can help please, if there's something I can do."
Hill didn't sue Bauer until four months after he sued her.
FULL RECORDING:
An example of what's in the article: Judge Selna's sanctions order against Hill. The judge said Bauer suffered "little if any" prejudice from Hill's contact with potential witnesses and redacted his mention of some apparently bad evidence for Bauer. legalaffairsandtrials.com/p/never-said-t…
The federal litigation made clear there are photos of bruising that haven’t been publicly released. They are mentioned in the call and Bauer says he was surprised by them. A nurse in the restraining order hearing also testified about heavy bruising. .legalaffairsandtrials.com/p/never-said-t…
One big piece of litigation tea is Bauer’s lawyers preparing to argue Hill’s privilege claims with her lawyer about the video are pierced under the crime-fraud exception. It’s what prompted this declaration from her lawyer saying, nothing there. legalaffairsandtrials.com/p/never-said-t…
Anyone interested in the call should listen to the actual audio recording, but here’s a transcript of everything Lindsey Hill and Trevor Bauer said. documentcloud.org/documents/2401…
Litigation is full of wins and losses.
Bauer lost his motion to quash Hill’s subpoenas against his other accusers, but it wasn’t a total L: Judge quashed a subpoena for a woman who isn’t an accuser but said she had info about him planning sexual assaults. legalaffairsandtrials.com/p/never-said-t…
I’ll be live on YouTube at 1 pm PT / 4 pm ET to discuss all the litigation that was going on before Trevor Bauer settled with Lindsey Hill, and my reporting on the May 2021 phone call. I’ll take questions in the chat. youtube.com/live/FtodVSFOx…

My last article on John Eastman’s California State Bar hearing included this hopefully helpful summary of Judge Carter’s email orders. Full piece in the archives: legalaffairsandtrials.com/p/judge-in-joh…
Eastman mentioned his SCOTUS petition when I asked him about Carter’s rulings after the first day of his state bar hearing back in June. Here’s the full discussion.
Good morning from Los Angeles, where Tory Lanez is due in court at 10:30 a.m. He wants to bail out of jail as he appeals his convictions for shooting Megan Thee Stallion, instead of going to state prison to serve his 10-year sentence.
I'm going into the courthouse now.
Lanez’s bail motion is signed by a young attorney with Unite the People, which provides legal services to inmates.
Jose Baez (yes, that Jose Baez) indicates he's still on the case, only saying this morning on Instagram that a "prior commitment" prevents him from being here.
Bail pending appeal is rare, but Lanez is asking Judge David Herriford to allow him to live with his son and new wife in a home he'll rent from a guy who rents out "exotic" homes and cars.
Guy tells cop to stop harassing two Black men, gets thrown in @LASDHQ SUV and told he'll be dropped off in gang territory to be assaulted. Cop ends up crashing SUV and injuring him, and a cover up ensues.
Mitchell Epner points out: "The most chilling part is the discussion of the implicit assumption that the corrupt Sheriff's Deputies could get the plaintiff locked up for 'being under the influence of a stimulant' with no @LASDHQ questions asks.
"Not his first rodeo."
Another former @LASDHQ deputy, Christopher Blair Hernandez, pleaded guilty in July and is to be sentenced in January. Here's his plea deal, which puts him at 24-30 months in prison for conspiracy. storage.courtlistener.com/recap/gov.usco…
John Eastman's California State Bar hearing over #J6 is back in session.
Elections expert and lawyer Matthew Seligman was testifying yesterday, but Sambo "Bo" Dul, who was state elections director in Arizona in 2020, is up now.
Eastman's lawyer is asking Dul about her previous work with the Perkins Coie law firm. Prosecutor objects for relevance, but Judge Roland overrules because direct exam did touch on Dul's background. So now Randy Miller is asking Dul about Perkins Coie.
Judge Roland sustained an objection, but Miller turned to asking about Perkins Coie's work with Arizona elections. Dul says no involvement.
Perkins Coie is the subject of a lot of online speculation - it was the go-to firm for Twitter before @ElonMusk took over.
Just in: Tory Lanez has been sentenced to 10 years in prison for shooting Megan Thee Stallion.
Tory spoke for several minutes. He said he still cares about Megan. He called her "someone I still care for dearly to this day" regardless of what she may think of him.
He said "the victim's my friend." He talked about bonding with her over the loss of their mothers.
"We both lost our mothers. We would sit there and drink, and drink until we got numb," Tory Lanez said of Megan Thee Stallion
Good morning from Los Angeles, where Tory Lanez is to be sentenced for shooting Megan Thee Stallion. Prosecutors are asking for 13 years and citing Lanez’s lack of remorse, while Lanez is asking for probation and proclaiming his innocence. Stay tuned for updates from court.
I’ve got all the sentencing papers linked in this article, along with the basics about the case and what’s been going on since Lanez was convicted on Dec. 23. Subscribe to get an article about the sentencing in your email after it’s over. bit.ly/3OJtWQE
My Sunday piece looks at the history of the false DNA evidence claims in Lanez’s case, from DJ @Akademiks to Casey Anthony’s defense expert. bit.ly/45dMSMM
