Judge Tanya Chutkan, an Obama appointee, just imposed a gag order on Donald Trump. He will not be allowed to comment about Special Counsel Jack Smith or his staff, court staff (not sure if that means her) and “potential witnesses” in the case.

🍌republic.
She will file full order later today. Chutkan claimed her order was to prevent Trump from launching a “pre trial smear campaign” that poses a “danger to the administration of justice.”

I’m sure Trump will immediately appeal but no high hopes for DC Circuit to reverse.

This means the next few months before trial will be filled with motions and hearings related to allegations by DOJ that Trump violated the order.

A massive contempt trap in addition to the unprecedented silencing of a candidate for president.

Matthew Graves filed a heavily redacted motion objecting to unsealing the case. As others have noted, this is highly unusual. Lazar was arrested on numerous serious charges and denied release in July 2021.

NEW RAY EPPS: Surveillance video shows Epps involved in the second breach of Capitol grounds after participating in 1st breach moments before. This incident creates opening for protesters on west terrace, which coincides with start of joint session of Congress at 1pm.

WATCH:
Epps touches part of a metal fence as police attempt to pull it up. Contrary to his testimony and DOJ report, Epps was not helping police. It appears that Epps stays behind 2 individuals standing on the fallen fence.

I am told mishandling a fence is an act of terror.

So the only individual who appears to be involved in orchestrating two key breach points is Ray Epps.

NEW: Attorneys for Ryan Samsel, the man who Ray Epps whispered to right before Samsel breached 1st set of bike racks, waives jury trial in favor of bench trial before Judge Jia Cobb, a Biden appointee

Samsel has been in jail for 34 months awaiting trial, now set for next month:

Samsel has been denied medical care and access to counsel & evidence while being moved to several prisons. DOJ has delayed his trial for almost 3 years by adding new charges and co-defendants. Defense notes how DOJ, as one judge said, "charged first, collected evidence later."

Samsel's lawyers asked judge to finally release Samsel so he can get needed medical care and prepare for trial. If she grants motion, it's unlikely the October trial date stands.

NEW: Statement of offense for Ray Epps finally on docket. It's amazing, after reading so many of these, that Epps faces a single misdemeanor. Based on allegations, he should face multiple felony counts including obstruction of an official proceeding:

So Epps is a key figure in 2 breach points--key moments DOJ has emphasized in trial as initiation of the "attack on the Capitol"---but he gets one misdemeanor? Ryan Samsel has been in prison since Jan 2021 awaiting trial. Epps, not so much. Image
This sort of conduct routinely has been described as assaulting, or at least interfering, with law enforcement. Major charges resulting in extended prison time or even pretrial detention. Makes no sense he doesn't face similar charges. Image

NEW: Steven D'Antuono, head of Detroit FBI field office during Whitmer fednapping hoax, told House Judiciary committee he knew little about the details of the operation, knew nothing about FBI informants including Dan Chappel, suggested "investigation" originated out of FBI HQ.

D’Antuono said his recollection is fuzzy because the matter was “a long time ago.” (Keep in mind the FBI designated this case a “terror enterprise investigation” involving planes, drones, and at least a dozen informants operating out of multiple field offices.)

When asked to describe the predicate of the investigation, D’Antuono said he wasn’t “sure if it raised to that level of the Governor at that point or how we opened up the matter, but it was a domestic terrorism case that they were perpetrating to--or, looking to conspire to--I'm not sure what the definition or the opening of that case was, but it was a domestic terrorism case.”

D’Antuono seems to have learned most of what happened in the case from news reports and the trials. He appeared shocked at the level of interest. “That’s why a lot of this reporting that came out, I'm like, this is just a normal case. This wasn't botched. It was just a normal case. And it wasn't that, like, spectacular.”

While vague about the role of FBI HQ, D’Antuono said “he never talked to anyone at headquarters or DOJ about this matter until it came down to the final operation.” Which was the arrest of all suspects on October 7, 2020--a month before Election Day.

Dan Chappel was hired as an informant in March 2020. His FBI handlers, working out of FBI satellite office in Flint, managed Chappel for the rest of the year paying him at least $60k in cash and personal items.

Q: Do you remember a CHS named Dan Chappel?

D'Antuono: No.

Q: No?

D'Antuono: Other than, I'd probably remember him from the media reporting and stuff like that, the trial.

WHAT?
During first trial, at least one FBI agent testified that the highest level of FBI and DOJ knew about what was happening. He also confirmed DOJ chiefs would have had to approve the operation as a "terror enterprise investigation."

This absolutely demands questions of Chris Wray and Bill Barr, who has insisted he knew nothing of the fednapping scheme until right before the arrests.

Q: At any point from the initial receipt of source reporting, did either FBI headquarters or DOJ provide any direction or guidance with respect to this investigation or its steps, to your knowledge?

D'Antuono: Well, yeah, because it's a DT (domestic terrorism) case, so it comes into the DTOS (domestic terrorism operation section) and program management of headquarters, right? So there would've been opinions thrown back and forth, and I believe there was conversations going back and forth between my people and DTOS and our CDC and everyone to say, is there enough predication to open the case?

Because they have to come under that program management, and you have to have a conversation with headquarters.

NEW CHUTKAN FILES: I just obtained transcript of another sentencing by Judge Chutkan for a J6er, convicted by her of 4 misdemeanors after a brief bench trial. To say her view of what happened on January 6 is misinformed in an understatement.

It's not hyperbole, it's a lie:

After admitting she watched J6 select committee hearings--and asking a defendant if he had, lol--Chutkan compares Jan 6 to Game of Thrones.

And no one saw anyone erecting gallows. There is no video of it--and I've been trying to hunt it down for 2 years with no luck.
