First Amendment provides no protection for speech that amounts to crimes of deceipt, receipt, conspiracy. Non-starter. /2
Due process clause provides fair notice of criminal conduct. Trump argues he received no fair notice because no one has ever been charged with this scheme before. No one has ever committed this scheme before! /3
Trump argues double jeopardy clause prohibits this case because he was already acquitted by Senate in impeachment proceeding. Impeachment and criminal prosecution are apples and oranges. No “jeopardy” for impeachment because no prison results. /4
Trump argues selective prosecution, which means treating similarly situated defendants differently. Again, no one is similarly situated. /5
Trump argues he is being vindictively prosecuted. But that means being treated more harshly in retaliation for exercising a legal right. It comes up, for instance, when a defendant is sentenced to more time after a successful appeal. Vindictive prosecution does not apply here. /6
Finally, Trump has argued he is immune from prosecution as president. To extent immunity covers criminal cases (maybe), it applies only to conduct within the scope of presidential duties. Elections are administered by STATES, clearly outside scope of president’s duties./7
Smith also asks court to decide immunity and double jeopardy motions first because those two are immediately appealable, unlike the other motions, which must wait for appeal until after trial. With prompt work, appeals could be completed before March trial date without delay./END

The First Amendment is not absolute. Many crimes that involve speech are crimes — perjury, fraud, and conspiracy to name a few.
Selective prosecution requires a showing of disparate treatment for the similarly situated. No one has tried to subvert an election the way Trump is accused of doing. No comparables. No defense.

🧵1 Here is my take on yesterday’s removal hearing, in which former chief of staff Mark Meadows wants to move his state RICO case from Georgia state court to federal court.
2 Why seek removal? Federal court offers a larger jury pool that draws from predominantly Republican areas, no TV cameras in the courtroom, and nicer prisons, but the real reason is to assert governmental immunity and get the whole case dismissed. And Trump will tag along.
3 The legal standard is not simply whether the defendant was a federal official at the time of the alleged conduct, but whether he was acting within the scope of his official duties. Meadows seemed to fall far short of meeting that standard.

1 Durham Report is in. After four years, review of 1 million documents, 490 interviews, his conclusion is that FBI should have opened a preliminary investigation (PI) instead of a full investigation (FI) in 2016. THREAD
2 The only difference between FI and PI is the duration and the authorities that may be used. This is a hairsplitting quibble, and one on which FBI officials routinely disagree.
3 Durham also minimizes the reasons FBI was alarmed enough to open a FI in 2016 based on information received from Australian diplomats about Trump campaign adviser George Papadopoulos.

This week’s epic snowball fight on @UMich Diag was a study in strategy. As a lifelong resident of cold-weather climate, here are some observations about good and bad techniques.
First, the good. Goggles - excellent for eye protection from stray snowballs that violate the normal rules of no throws above the head.
Elevation - great move. Out of harm’s way and good angles of attack. Target may never see you coming.

As Jim Comey said regarding Hillary Clinton, DOJ prosecutes mishandling of classified documents cases when there is an aggravating favor present. Those factors are obstruction of justice, storage in a way that risks exposure, willful violation, and disloyalty to United States /2
In the Mar-a-Lago case, all but that last factor appear to be present. In the case of the Biden documents, there is no indication that any of the factors are met, but referral for investigation by the Chicago US Atty, a Trump appointee, seems prudent. /3
