Here's why the Colorado ruling that Trump can appear on the ballot despite engaging in an insurrection contains more bad news for Trump than good news.
🧵1/8
On Friday, Denver District Judge Sarah B. Wallace ruled that Trump “acted with the specific intent to disrupt the Electoral College certification of President Biden’s electoral victory through unlawful means; specifically, by using unlawful force and violence.” 2/8
The judge made a finding of *fact* that Trump engaged in an insurrection, but let him stay on the ballot because her *interpretation* of the 14th Amendment's disqualification of insurrectionists was that it didn't apply because it didn't specifically mention the presidency. 4/8
Judge Wallace’s decision will be appealed. But here's the thing: Appellate courts defer to district court judges’ findings of fact. Which means that on appeal, Judge Wallace’s finding that Trump incited an insurrection is likely to stand. 5/8
Yet appellate courts do not defer to district court interpretations of law or the Constitution. Which means that on appeal, Judge Wallace’s convoluted interpretation of Section 3 of the 14th Amendment may not be affirmed. 6/8
The bottom line: This isn't some obscure provision.
A New Mexico judge used it last year against an insurrectionist county commissioner. It must also apply to Trump.
Having once incited an insurrection against the U.S., there’s every reason to believe he’d try it again. 7/8
We need to pay attention to this case as it continues to make its way through the courts. I shared my thoughts in more detail here:
It pains me to say it, but RFK Jr is a dangerous, right-wing nutcase.
While his father was a fierce advocate for racial justice, Junior has gone down a dark, racist rabbit hole to become a proponent of hateful and bigoted conspiracy theories. 🧵 1/10
RFK Jr pushed a racist, antisemitic conspiracy theory that COVID-19 was an “ethnic bioweapon… targeted to attack Caucasians and Black people,” but spare “Ashkenazi Jews and Chinese.” 2/10
Leaning into the right-wing, manufactured, anti-trans panic, RFK Jr promotes a conspiracy theory that chemicals in the water are turning people transgender. 3/10
Hot Labor Summer is turning into Hotter Labor Fall.
It seems likely that the @UAW will go on strike against the Big Three automakers, starting tonight.
A strike against all three companies at once has never happened before. Here’s what you should know.
🧵1/10
Why are United Auto Workers likely to strike?
Like so many other workers organizing across the country, auto workers want a bigger piece of the economic pie they are generating for their employers.
They have good reason to want more.
2/10
Profits at the Big Three auto companies — Ford, General Motors, and Stellantis — have skyrocketed 92% from 2013 to 2022, collectively totaling $250 billion.
The Big Three paid out nearly $66 billion in dividend payments and stock buybacks during that same time period. 3/10
On Truth Social, Trump pledged to "never forget" 9/11.
He's probably hoping you'll forget the lies he's told about 9/11 and the ways he's tried to capitalize off of the horror of that day.
Here's what is true about Trump and 9/11 🧵

Trump's immediate reaction to the horror of 9/11 was to brag about the size of one of his buildings, phoning into WWOR to say “40 Wall Street actually was the second-tallest building in downtown Manhattan… And now it’s the tallest.”
