🧵 1. The House Intelligence Committee (“HPSCI”) is advancing a bill purporting to reform FISA 702.

That bill’s actual reforms are at best illusory.

But it’s worse than that.

The HPSCI bill would actually make it easier for the FBI to spy on Americans without a warrant.
2. HPSCI’s FISA 702 bill has some serious, glaring problems. Most obviously, it lacks a warrant requirement for all “backdoor” searches directed at American citizens whose communications have been “incidentally collected.”
3. But there are other, less-obvious—and more troubling—problems that can be found in section 504 of the HPSCI bill. Sec. 504 expands the scope of FISA 702, in a way that would make 702 applicable to hotels, restaurants, department stores, or anyone else offering public wifi.
4. Indeed, section 504 of the HPSCI bill would make FISA 702 applicable to businesses offering wifi.

If this bill were to pass, and you went to McDonald’s and used the McDonald’s wifi service, the NSA could go to McDonald’s and obtain that wifi data—without a warrant.
5. The HPSCI bill is attempting to *expand* the scope of domestic surveillance in America — at a time when Americans are rightly demanding the opposite approach, and are reasonably expecting compliance with the Fourth Amendment.
6. Aside from the serious policy and constitutional issues presented by HPSCI’s shiny-object, Trojan horse of a bill, the HPSCI bill would be wildly unpopular with many Americans at nearly every points on the political spectrum.
7. Today the HPSCI bill is being marketed aggressively to Republicans and Democrats alike.

House Republicans are meeting at 5:30 today to discuss the HPSCI bill, comparing it to a competing, well-written bill from the House Judiciary Committee, which would actually fix FISA 702.
8. Noticeably absent from HPSCI’s slick marketing is a recognition of (1) how meaningless the fake warrant requirement in that bill, which would essentially *never* come into play, or (2) section 504’s wanton expansion of FBI’s warrantless surveillance of Americans.
9. Whether you’re a Republican or a Democrat—or a liberal or a conservative—or something else, please tell your representatives to reject HPSCI’s fake, deceptive bill that, while purporting to fix FISA 702, makes them much, much worse.
10. If you’re represented by a House Republican, please reach out to your representative immediately, asking them to speak boldly in opposition to the HPSCI bill at the House GOP conference today at 5:30 pm.

1. FBI Director Christopher Wray just told the Senate Judiciary Committee that Congress (1) MUST reauthorize FISA 702, and (2) MUST NOT impose a requirement that FBI obtain a search warrant before conducting “backdoor searches” of American citizens through the 702 database.
2. I asked Wray about specific instances in which FBI personnel have abused the rights of Americans under FISA 702.

He insisted that those things are in the past and won’t happen again now that FBI has adopted new procedures.
3. The claim that FBI has fixed this—by changing its own internal procedures and adopted new policies—is completely unpersuasive.

I’ve heard the same thing from FBI directors in three different presidential administrations. This has not changed in the 13 years I’ve been on this.

2. Sadly, Hamas has now proven that taking hostages works, as Palestinian terrorists have been released in droves, hundreds of uninspected truckloads “humanitarian relief” have been sent to Gaza, and Israel has agreed to a temporary cease fire.
3. Hamas learned the value of taking hostages from its sponsor—Iran—which over the years has received many billions of dollars from Presidents Obama and Biden, in exchange for the release of just a handful of hostages.

Most of the time, abortion isn’t a federal issue. In the context military spending, it is.

Most of the time, Americans are sharply divided on abortion. In the context of using taxpayer funds for abortion, they aren’t.

Sure, they disagree with his strategy here. But why wouldn’t they direct their frustration toward @SecDef, who chose to make this an issue in the first place—in a manner contrary to the spirit (if not also the letter) of 10 USC 1093? @SecDef could end this impasse today.
@SecDef If you serve in federal office and claim to be pro-life, when are you going to show you’re actually pro-life if not now—where it’s a federal issue (DOD funding) and public sentiment is behind us (with three out of four Americans opposed to public funding for abortion)?

🧵 1. I’ve been on a conference call for the last 90 minutes with my colleagues and key Biden administration officials regarding the recent Hamas attacks on Israel. Heres what we learned:
2. The administration is mincing words and hiding behind classified-briefing doors, leading members to infer it is more to protect their own public image than as a means to actually giving the people’s representatives the truth. The only actor this helps is Iran.
3. This administration has treated Iran as a legitimate actor from day one, so much so that $6 billion REMAINS available for Iran to access. The Biden administration has not pulled this off the table. If we truly control the $6 billion, we should pull it off the table right now.
