The law, which was passed in April, allows a jury to recommend, by a vote of at least 8–4, the death penalty for sexual battery on a minor.
"We are authorizing the death penalty for child rapists," stated DeSantis in April. In my opinion, some of these individuals will rape children as young as six or seven times on a regular basis.
The presidential contender stated to Orlando radio saying, "I think the death penalty is the only appropriate punishment when you have situations like that."

Gladson's office identified four aggravating circumstances that, in their view, make death an appropriate penalty for Giampa's alleged crime. Prosecutors contend that the crime was committed for financial gain and assert its particularly heinous, atrocious, or cruel nature.
In November, Giampa was arrested in Lake County, Florida, following an investigation by Lake County Sheriff's deputies. During questioning at his residence on November 2, Giampa displayed his laptop computer, revealing a video depicting a man engaging in the sexual abuse of a child. The video allowed authorities to identify Giampa as the suspect.
Since his arrest last month, Giampa has been held in the Lake County Jail.
It's worth noting that in 1977, the U.S. Supreme Court ruled against imposing the death penalty for rape, citing a violation of the Eighth Amendment rights protecting citizens from cruel and unusual punishment. Additionally, in a 2008 ruling, the Supreme Court reiterated that the Eighth Amendment barred the death penalty for child rapists in a 5-4 decision.
