Good morning from a chilly Dedham District Court, where I'm here awaiting doors to open for the 9AM ET hearing in the #TurtleBoy Domestic Violence restraining order extension (the victim is a witness in the #KarenRead case).

No officer ever said that, by becoming a witness, the victim would become "protected from Mr. Kearney," the victim confirms.
The victim was told ANOTHER Grand Jury was being convened into Aidan Kearney when she was served that subpoena.
This is the rumored second Grand Jury into Read and Kearney, now confirmed.
The Judge will allow questions about the GJ proceedings up until the 24th of December.
Nothing about the GJ after that date.
Bradl says he wants to know more about what happened after the 24 to learn more about the GJ.

The victim got the initial subpoena on the 22nd of December.
The victim spoke with Mr. Kearney that night about having gotten the subpoena.
She remembers calling Kearney that night.
We learn that the Grand Jury testimony scheduled for the week after Christmas was delayed and the victim is working with the prosecutors to find a new date to testify at that Grand Jury.
Kearney's second round of criminal charges delayed the testimony.
The victim asked prosecutors if it was okay to tell Kearney that she had been subpoenad.
They said it was okay.
The victim did not tell the prosecutors that she was going to actually contact Kearney.

Kearney reached out the victim with a text on the 22nd of December to ask if the victim saw his court hearing that morning.
The victim had not been served with the subpoena at that point.
The victim told Kearney she needed to talk to him.
Then, says the victim, she saw the police in her lobby giving her a subpoena.
Then she told Kearney not to text her again until she calls him back.
The victim told Kearney, on the 22nd, not to call or text for a while because she was being served with the subpoena.
Kearney asks her why and the victim didn't explain.
Kearney accused the victim of being "shady" with that response.
"It was shady, wasn't it?"
"What is shady?"
Bradl tries to ask more about the victim being Shady. Victim's lawyer objects. Judge sustains.

Bradl asks the victim if she invited Kearney over on the 22nd, despite them having broken up earlier in December.
The victim wanted Kearney to come over to talk about the subpoena.
"Why not just text him?"
Victim says it's easier to talk in person.
"You wanted to use this subpoena to get back together with him?"
"False," comes the instant reply from the victim.
Bradl asks why the victim did this in light of "being afraid" and in light of "all the sexting"?
The victim says she prefers speaking to people in person about serious subjects.
Bradl wants to cite from the affidavit of the victim. The Judge makes Bradl cite to specific words.
Page 4 of the victim's affidavit says the victim messages Kearney a picture of her summons on the 22nd.
She was afraid Kearney would blackmail her with revenge porn if she talked to the state.
"You betrayed Aidan's trust, didn't you?"
Next question overruled. Bradl asked four questions in one.
"I don't believe I betrayed his trust. I was venting to Ms. Peter and I have a right to have another female friend to vent to."
"Okay, we'll leave it there," says Bradl.
"You were worried that Kearney would retaliate, right?"
"Yes,"
Next question struck from the record due to objection.
"Did you have ulterior motives?"
"No," says the victim.
The victim says Kearney wanted to meet up and discuss the subpoena in person.
The Victim says, as to the 23rd, it was a mutual meeting.
On the 23rd, Kearney reached out to the victim again and then the two parties agreed to meet, says the victim.
The victim sent a text saying she wouldn't call Bradl (Bradl refers to himself as "tim" in the third person) and now people would find out about the baby.
The victim wouldn't even tell the police detectives who served the subpoena about her medical issue, because she didn't want people to know she was pregnant .
She wanted Kearney to know the police were going to find out about the baby if they kept asking question.
The victim was not at Kearney for not coming over on the 22nd. She just wanted to get her own lawyer at that point, she says.
The next day, the victim contacted Kearney.
Bradl wants to introduce a single text message but the Judge wants to know if there were other messages too.
Bradl asked if this was the first text message on the 23rd.
The lawyer for the victim suggests that Bradl is trying to introduce a text message that could be out of context.
The Judge says the defense has a right to see what Bradl wants to show the witness.
Some tense moments right now as Bradl and the victim's lawyer talk about this screenshot of a text message.
The victim is saying this was not the first messages she exchanged with Kearney that day, per the Judge.
"There were many, many text messages leading up to that message."
"I can testify to those messages," says the victim.
Bradl seems stumped.
Now the victim says Kearney and her were talking about if the victim had talked to Kate Peter, via Facebook messenger (some kind of text she says).
Kearney said his Netflix documentary is now cancelled and he blamed the victim.
The majority of the messages were Kearney trying to pressure the victim into admitting that the victim was talking to Kate.
"After a length period of time of battering me about whether I talked to KKate, we finally had a phone conversation."
The victim says that, during that Facebook message exchange, she started crying because Kearney used "login credentials for MassCourts from a lawyer" to send her confidential documents about her children.
Then she asked Kearney for a call.
Bradl taking some time now as he pauses for an extended period before asking his next question.
Wasn't Kearney being gracious by saying he would forgive you, asks Bradl.
"It hurt me that the information about Allison and my mom came out," TurleBoy said to the victim.
Bradl reading a text from Kearney where he said he would forgive the victim.
"Kearney threatened me with private documents about my children [in that same conversation]," says the victim.
"It was illegal for Kerney to get those documents in the first place."
"Only lawyers have access to MassCourts?" Asks the Judge.
MassCourts wouldn't have sealed documents on it, says Bradl.
There is a difference between public and attorney access to MassCourts, though.
Bradl saying Kearney, as a journalist, has a right to get these kind of private documents about the victim's children if Kearney feels threatened.
Bradl says other journalists have access to MassCourts and stares at me.
I only have public access, not lawyer access.
Bradl saying what Kearney said in some of the messages shows he was not a "horrible person" or "threatening" the victim, but I'm not sure if that makes sense.
Next question, says the Judge.
Long pause from Bradl now. He seems rattled by how good this witness is on the stand.
To her credit, she is really, really good at telling her story.
"Just one moment, Your Honor," says Bradl.
Bradl asking if the victim told Kearney that the victim didn't deserve Kearney's love.
The victim says she doesn't remember exactly when that was said in the order of the conversation.
There were some messages before that, says the victim.
Bradl reading a message from Kearney to the victim where he says he believes she was sorry and Kearney believes the victim would "take back the betrayal" if she could.
Bradl framing testifying for the state in a criminal trial as a betrayal is weird.
Straight up mafia vibes.
Bradl now reading messages from the victim saying she was hurt and scared and that's why she cooperated with the government.
The victim's messages says she was not a devil for doing it.
"Everything that is going on scared me, and I had no one to turn to or confide it," the victim said to Kearney.
"I'm so sorry," said the victim.
"You gave him some and now you're telling him to come over for the rest, right?"
"I felt it was easier to speak in person," says the victim.
The victim spoke to Kearney on the phone before they mutually agreed to see each other.
The victim says Kearney was not gracious in their phone conversations and she doesn't have notes about that call.
"Why don't you ask her about the calls," the Judge tells Bradl.
The calls were before that 12:19PM text, says the victim.
Bradl now asking about more texts between the victim and Kearney.
The victim asks Bradl "aren't you going to scroll down so I can see all the messages."

Bradl is floundering.
Victim confirms it was a mutual decision on the 23rd for Kearney and the victim to see each other.
The Judge says Bradl is being argumentative. He withdraws his question.
The witness is really shaking up Bradl here.
He says, to the victim on the stand, "you're the moving party here."
That wasn't a question.
Bradl has spent 10 minutes going in circles about this mutual decision.
"I was scared after Kearney threatened me with those documents about my children and that's why I said anything to get him to not release those documents."

Victim says she she didn't feel she had to say she was sorry.
She was being threatened and manipulated.
Bradl asks if Kearney had a right to defend himself by threatening her.

He again tries to ask about the mutual invite to the victims apartment.
People in the courtroom are getting frustrated with all of this circular questioning.

Victim says she doesn't believe she betrayed Kearney.

Then the victim asked if they could date again. He said maybe.
Kearney says he was frightened of the victim when the victim said she felt pressure to have an abortion by Kearney.
In December 6th, the victim and Kearney met at the Dragon 88 to discuss how the victim was still pregnant.
Bradl asks Kearney if the victim lied about being pregnant.
Kearney says he thought she was a liar because she was having trauma over the abortion.
"She was pretending to cry on the phone," says Kearney. Bradl cuts him off.
Kearney attacks the victim as a drunk.

The victim called Kearney again that day, saying she needed help with the abortion on December 8th in Brookline.
Kearney agreed but the victim changed her mind and decided to take an abortion pill instead.

Kearney denies saying he was going to war with the victim when he left her house in the early morning that day.
Kearney says he went to the victim's house on 12/23 because he had been speaking with the victim and found out she was talking to the Commonwealth and Kate Peter.
The victim didn't want to screenshot things and send them to Kearney so he went to see her.
Kearney and the victim met in the conference room of her apartment building for 2 hours.
Around 11PM, Kearney and the victim went back to her apartment to check on her kids.
Kearney and the victim then went into her apartment.
Kearney thought the place was bugged and made her unplug devices.
Kearney and the victim went through all of the messages between Kate Peter and the victim from 12/11/23 until 12/23/23.
The victim would scroll through the messages and and Kearney was taking notes.

Kearney says the victim told him she couldn't afford a lawyer so he tried to link her with someone named Mike Gerlick (sp?) from Worcester.
Kearney says he wasn't trying to get the lawyer for the victim to help Kearney but rather to help the victim.

Kearney says he was worried about the victim talking to Kate Peter because Kearney didn't want Peter to learn about information that Kearney would rather be kept private.
Kearney says he exchanged sexual pictures with the victim almost every day.
Bradl asks Kearney to tell the Court about when he had sex with the victim that night;
After they read the text messages, the victim and Kearney laid on a couch.
She touched his penis, gave him oral sex and then they had sex for 20 minutes.
The victim was very upset when Kearney tried to leave right after having sex with her.
The victim, says Kearney, then went to get the notepad (that belongs to the victim) and put them down her shirt.
Kearney said the notes were his property and was upset she took them.
Kearney says, at that point, he did not touch the victim he was just upset about her taking the notes.
Then, after things calmed down following the sex, the victim took four abortion pills and became very upset at Kearney.
Kearney says he saw the victim take the four abortion pills and that she told him she was in distress because she was going to have to pass the fetus over the next few hours.
At that point, Kearney left and the victim followed him saying she was unwell.
"I'm going to be in pain, you can't leave me here," Kearney says the victim told him that morning.
Kearney responded by scolding the victim for "saying she was going to bleed out in the driveway and tell his family about the baby she just aborted."
Judge shuts Kearney down.
Kearney now accuses the victim of "pretending to pass a baby," that he stayed with her all night, tried to drive home, and then crashed his car on 495.
Kearney denies touching the victim.

Kearney and the witness know each other through Facebook and they are "friendly", says Bradl.
Bradl is making an offer of proof here, but after that last video he vouched for I am not relaying him word for word until the Judge makes a ruling on this proffer.
Bradl now saying that the witness he is trying to call didn't want to testify and didn't want to be involved, but then Mr. Bradl sent his investigator and the witness (Ms. Barrett) talked to that investigator.
This was a babysitter who worked for the victim and also is a fan of Kearney.
The Judge wants to know why the witness is ignoring the Court's order that she be in court today.
"Where is she, right now, Norwood?" asks the Judge.
Now, Bradl says that this witness spoke to Ms. Lombardi this morning.
Is this Olivia or her mom?
Bradl says Lombardi is a friend of Kearney's who has been "helping with the case."
Uhh. What is going on here?
The Judge doesn't understand why this witness, who is under court order to appear, is not here.
The Judge really wants the witness in court.
Bradl needs a moment to talk to his co-counsel.
The Victim's lawyer says she will testify that she did not say that to the witness.
"I want to examine this witness," says the Judge.
"I don't know what to tell you, she's sick," says Bradl.
"She didn't say anything about being sick this morning," says the Judge.
The Judge says we will bring her in on Zoom.

Kearney is back.
The witness is on zoom.

The witness is called.
Her name is Grace Barrett.
She lives in Norwood.
She was a babysitter for the victim and also a fan of Kearney's.
Witness says she is not a babysitter and has "only done it three times for her friend, the victim."
The victim is an in-law to this witness.
The witness does not know Mr. Kearney, she says.
Now, the witness saying that she does not follow Kearney at all and has never seen his content.
What?
That's not what Bradl said earlier today.
Now the witness is asked when she talked to Kearney.
Sometime around the 26th.
"I don't even know right now,"
"I know nothing about this what are you getting at," says Bradl's witness.
What the hell is going here.
"I told your investigator I knew nothing about this, and that I knew nothing about the pregnancy, and I know nothing about this."
Bradl's own witnessnis very upset with him.
The Judge won't let Bradl ask cross exam questions on direct.
"This is your witness, you may not ask leading questions," says the Judge.
Bradl asks for time to talk to his assistant.
The witness is melting down and very upset.
"You should be prepared, Mr. Bradl" judge says.
The witness denied speaking to Kearney.
"I have nothing to say about this or these two people. That's it. And I told your investigator that. I said don't involve me."
"There was nothing for me to even be involved with."
"I know nothing and there's nothing to say," says Bradl's witness.
"I told your investigator I don't want to be involved."
"You're trying to impeach your own witness!" the Judge bellows.
The Judge is furious.
The witnesses is saying she refused to speak to Kearney or talk to him about the victim.
She is furious with Bradl.
The Judge won't let Bradl asks leading questions.
"But she's not being cooperative," says Kearney.
No shit.
The Judge forces Bradl to ask what the victim said to the witness.
"I told the victim not to tell me anything. She told me nothing. I told her I didn't want to be involved."
"She didn't tell me anything."
The witness keeps saying she did not want to get involved.
"I know nothing!"
She pleads.
"Jesus!"
The witness is furious that Bradl won't accept her answer that she didn't speak to the witness.
Nothing further.
No cross.
Bradl wants to call Kearney to impeach Bradl's witness.
"That is not going to happen," says the Judge.
"That is not proper, Mr. Bradl, you're crossing a line here and I'm not allowing it." Says the Judge.
Bradl is pleading with the Judge now that Bradl should be able to impeach his own witness by calling Kearney again.
The Judge is not having it.
"You made an offer of proof that she would testify to a, b and c...and you apparently got it wrong," says the Judge.
The lawyer for the victim raises and says Bradl wasn't prepared, his witness didn't say what he wanted, and the Judge sustains the objection.
Kearney will not be recalled.
Closing arguments now.
Bradl, entirely humbled, is giving his closing argument now.
He says these allegations are entirely fake, Bradl says the victim has no evidence (that's some projection right there) and Bradl says the victim called the police and the victim and state are just mad at Kearney.
Bradl now says that the victim is lying about being in fear, lied about being pregnant (no she didn't) and "acts insane all the time", and just wanted to date Kearney through this "insane pantomime."
Wut?
Bradl's argument is basically;
"The victim is a liar, and she is a bad person, and Mr. Kearney is a saint."
I'm paraphrasing.
Now Bradl is calling the State of Massachusetts the "enemy" and says the victim betrayed Kearney by becoming a state's witness.
Okay, Tony Soprano.
Bradl says Kearney kept getting naked pictures from the victim for weeks and Bradl doesn't understand why the victim would do that.
Bradl doesn't even know what Battered Person's Syndrome is.
Bradl says the victim is just a rejected suitor and the police "shook down a mentally unstable person."
Bradl asks the RO be ended.
Now the victim's attorney is up.
Victimsawywr says Bradl is engaging in classic victim shaming that makes no sense.
There were aot of distractions today to avoid talking about the incident on the 25th, and the victim met her burden under the statute for this order to be extended.

Judge says we will take a short tecess as he makes his decision.

The Judge is hearing one last matter on the docket.

A restraining order against Aidan Kearney has been extended for a year.
"The victim has met her burden."
The Judge will not allow Bradl to modify a part of the order to allow Kearney to release DCF or court documents about the victim.
Bradl really wants Kearney to be able to disseminate documents about the victim.
Bradl calls this journalism.
Bradl, again, asks that clause 14 be removed from the RO.
The Judge won't allow it. He says Bradl can go back to the original judge if he wants to.
A lawyer for the victim opposes Bradl's request for modifying the order, saying Bradl is trying to give Kearney a right to keep harassing the victim.
"Why would he want to have anything to do with her?" Says the Judge.
Bradl says it's about journalism, basically.
Nonsense.
The Victim's lawyer is firmly opposing the attempt to change the order.
Judge won't rule on a modification now.

I am at Dedham District Court for a very serious hearing today involving Aidan #TurtleBoy Kearney.
Kearney wants to lift an restraining order held by his victim, prominent local advocate Lindsey Gaetani.
Last night, reports emerged of a rape investigation into Kearney.
Reports also emerged that Kearney was inadvertently sent a full copy of his victims phone, in the context of an active felony case against Kearney, and came to posses intimate images of Lindsey's children.
I asked Kearney about both allegations.

Bradl, Kearney's attorney, says just some discovery matters today.
The new Special Prosecutor, a former Judge named Robert C. Cosgrove, is now the counsel of record for the case.

Good (early) morning from Norfolk Superior Court in Dedham for the first day of trial (and jury selection) for accused murderer #KarenRead, as to the lonesome death of @bostonpolice Officer #JohnOKeefe.
Read was cheating on John in the lead up to a fateful DUI by Karen on the night of 1/28/22-1/29/22 allegedly cost John his life.
Then, because of the overwhelming evidence of Read's guilt, says the state, Read and her defense team engaged the PR services of formerly-jailed #TurtleBoy blogger Aidan Kearney in order to poison Read's jury pool with information that would never otherwise come in at trial.
That state of affairs was further confirmed when, last week, Read's team did not even file a formal motion to present a third party culprit defense at trial (despite months of promising to do so), and, in turn, the defense may be forced to rely on a Bowden theory (an unknown culprit the police did not search for), rather than a specific third party culprit.
That would make it impossible, for the most part, for Read to even put on a defense.
We are expecting some rulings and filing today, but, on the whole, jury selection is entirely prevented from being broadcast. No live-blogging allowed, either.
