Okay I’m going to 🧵 it from now on as long as I’m watching but they are now pointing out how this rhetoric has funnelled down to the soldiers on the ground showing a video of IDF singing about “no uninvolved civilians”
They are now bringing up that 95 year old genocidal terrorist you really do have to wonder what Israel thought they’d gain by letting such things happen in the time of the internet aljazeera.com/amp/program/ne…
South Africa now pointing out that it is not only the highest levels of government and military but also members of the Knesset- pointing to examples of politicians advocating razing crushing even doomsday weapons-

The Argument is clear destruction of Palestinian life is at the
Core of Israeli politics and is interwoven in within every level of its institutions and political systems
They are now showing how this rhetoric has translated into action leading Israel to restrict essentials for life from entering Gaza- food water electricity

Despite the begging and pleading of numerous non state actors and NGOs whilst the un recognises it as unprecedented
South Africa now pointing how that this genocidal vigour has made its way into Israeli civil society with the government facing criticism and protest for letting in any aid at all “recanting on its promise to starve Gaza”
The South African team now providing context to why it has sought the courts verdict and the numerous diplomatic steps it took beforehand to try and ensure Israel would stop the genocide- clearly showing good faith and that seeking the court was an action of last resort
This is an attempt to show that they took their time and exhausted all other options before seeking the court undermining any argument israel try to make about exaggeration or bad faith

It shows that Israel cared very little that there were legitimate accusations of genocide
Most other nations given such accusations would at least act to calm fears and assure its allies it was not doing so- Israel simply ignored any attempts to resolve such accusations
South Africa now explaining how and what conditions have been met to prove that a dispute between South Africa and Israel exists on this matter and why they have appealed to the court as the ICJ presides over cases of state versus state
we’re breaking for 10 mins but what I will say is South Africa knows what they’re doing- they have already shown that Israel’s order of evacuation was itself genocidal- it’s labelling of areas of safe only to bomb was genocidal- the ritualistic humiliation of “POWs” is genocidal
Al Jazeera coverage pointing out that it was key for the South African team to show that this conflict did not start on October 7th there was apartheid oppression and discrimination before

Also that it was key to show there was a pattern and repetition of such behaviour

International pressure will balloon to cut off support
Something I was remiss tonot mention South Africa has been clear that there is precedence for this sort of intervention in the case of Gambia and Myanmar as well as the burden of proof necessary for injunctions to stop the military action is a lot lower then for genocide outright
Al Jazeera now pointing out the hope In Palestine due to this case as well as the deep sense of appreciation for South Africa for bringing it- as well as providing context for the deep ties between the two nations

They are now once again providing the context of the Israeli occupation an occupation known to be illegal and there is a hint of criticism of the international community on its failure to hold Israel accountable for this and almost pointing Israel as a rogue state
South Africa justifying its
very restricted use of images especially of graphic ones out of respect for Palestinians but also because they are arguing in a legal environment on the rights of Palestinians- there argument does not rely on graphic vulgarity
Once again South Africa tries to undermine the argument of Israel that it has made humanitarian efforts to evacuate Palestinians instead rightly showing this to be forceful displacement as well as showing that these so called safe areas have often been bombarded
There is a lot of citation and referencing to un bodies and NGOs as well as human rights orgs

These are legitimate international orgs with data to back up their conclusions- the idea israel can cry hamas ran media here won’t work
South Africa also pointing to the numerous countries who have publicly supported their case- they also are once again clear in trying to find as much room to manoeuvre as possible

They are not looking for a conclusion of genocide in the here and now but arguing it’s plausible to
Infer that these acts and intents are genocidal- this has a real world objective as they seek injunctions and provisional orders for the military action to stop now
South Africa now clear that their argument can not be hand waved away with a simple “we are at war with Hamas” and that regardless of the justifications- the actions are genocidal and cannot be justified

Also that even if the crimes can be described as lesser crimes or other
Crimes does not undermine their argument that they can also reasonably be inferred to be genocidal crimes

They are now stressing that they were obligated to bring this case as a nation which has signed the conventions of genocide and thus moved to prevent this genocide
They have once again referenced the Gambia case where the precedent was set that states must act to prevent genocide as signatories of the convention and that the convention gives South Africa the right to invoke Israel to stop its genocide
South Africa once again making clear that there are other examples of such cases- Gambia Bosnia and Ukraine- where provisional measures were issued to stop military actions

South Africa now justifying why their provisional measures will materially ensure the protection of
Palestinians rights- rights which it can be interpreted to be being violated by Israel with its current military strategy

They are now showing the consequences for the court as well as the universality of human rights should the court not side with South Africa in this case
Arguing that they will be treating Palestinians differently and limiting their own purview in future cases
The Irish advocate for South Africa speaking French to suck up to the judges it seems lmao bit of a weird one but oh well
“Gaza has become a place of death and despair, families are sleeping in the open whilst temperatures plummet, areas which were declared safe are under constant bombardment… a public health crisis is starting”
There is now a focus on the living conditions within gaza moving away from the high death count from bombardment and onto the wide spread of disease hunger and lack of shelter (cited belief that more will die from this than bombing)

There is a highlighting of the seemingly purposeful targeting of journalists as well as the destruction of homes, desecration of corpses and resting places and again the targeting of medical workers
There is a highlighting of the rumoured strategy of Israel of bombing an area waiting for people to arrive to help and then bombing again

As well as highlighting the amount of children with no surviving family members
There was a lot of stats thrown out there-I didnt get exact numbers but numerous mentions of the high numbers of deaths of children mothers healthcare workers and journalists

This is clearly an attempt to show Israel’s behaviour to clearly contradict its “war on Hamas” rhetoric
South Africa now focusing on the decreasing “safe” areas where Palestinians may find refuge and how the occupation has allowed Israel to restrict humanitarian aid bringing Gaza to the “edge of famine” as well as the number of preventable deaths caused by lack of medical supplies
South Africa reaching outfor the precedent set by the Canada vs Syria torture state-as provisional measures were justified due to similar ritualistic humiliation and torture that is analogous to Gaza at the moment

Same for Qatar where measures were justified due to displacement
In Qatar the court found it reasonable to implement measures when it only involves 150 students

In Gaza thousands of children and uni students have missed out on months of education 60% of schools damaged and many leading academics have been killed permanently…

Effectively organise and deliver aid without lines of communication and under bombardment the aid is not being distributed effectively enough to mitigate the damage
South Africa being very clear that only the halting of military action will allow for the removal of the humanitarian crisis and once again relying on precedents set by previous cases by this same court to show the need for provisional measures
South Africa now arguing that despite the unprecedented nature of the case not siding with South Africa would actually be the departure from its previous stances and would be proof of preferential treatment or a lack of consistency
There is now an homage to the general concept of “never again” as South Africa argues the international community has failed numerous times before to stand up to genocide until it is too late as they ask the court to act with foresight rather then hindsight
There is an intense criticism of the international community in this line of argument “the world should be horrified, the world should be ashamed” South Africa is accosting the international community
They have now highlighted a really powerful example of clear targeting of a medical institution- where a white board was found in rubble where it was written “we did what we could remember us” as the strike killed its author- healthcare worker for the hospital
More righteous accosting of the international community as South Africa repeats the sermon from a Palestinian “there will be no apologises accepted after the genocide, I ask where were you when this happened” (heavy paraphrasing there)
South Africa once again arguing that a conclusion of genocide is not necessary at this stage- and that there intention at this time is to have provisional measures implemented whilst the case is considered and a final conclusion is argued
To be clear from what I know the provisional measures they wish to see are a halting of Israel’s military action as well as a drastic increase in aid to ensure the humanitarian crisis is resolved
This seems to be a summary of South Africa’s arguments as well as the justification for such provisional measures- one key example of this is the precedent in the Bosnian case where the court ordered no action be taken which could further extend the crime of genocide
Ensuring that the court can have time to take preventative measures or making sure the accused don’t rush to finish the job
South Africa now also undermining Israel’s inevitable argument and deflection onto Hamas (its not a state so can’t be taken to the ICJ or sign conventions)
South Africa clarifying that they realise not all crime or even violence constitutes genocide (they compare to ethnic cleansing or even more general targeting of innocents) they argue that the idea these crimes may also be occurring does not mean genocide is not
South Africa highlighting its condemnation of Hamas attack as well as showing that Israel can’t handwave this accusation way with its “targeting of Hamas” chat as they indiscriminately bomb and attack civilian infrastructure specifically homes and shelter
Once again highlighting how the indiscriminate bombing and occupation amplifies the humanitarian crisis as Israel restricts aid

South Africa has also made numerous references to yank statements, I assume, to show that even Israel’s closest ally believes they go to far
backing their argument with the fact Israel uses dummy bombs (despite access to targeted bombs) as well as the use of them in residential areas and “safe areas”

Highlighting again that they wish to see a halt of all military actions that may violate genocide convention
South Africa now arguing that Israel is bound by the convention to punish those who take part in incitement of genocide- yet Israel has done nothing to politicians that have engaged in genocidal rhetoric to the point that within Israel there is concerns about the dehumanisation..

South Africa also asking for an order on the preservation of evidence and how Israel is obeying these measures
South Africa now dealing with the Israeli self defence argument- South Africa highlighting the occupation and how Israel controls borders supply lines and other such necessary functions for Gaza

South Africa now pointing out even if Israel is justified in self defence that this must be restricted within the confines of international law and no matter the scale of an attack suffered genocide is never…

South Africa now trying to undermine the inevitable Israeli argument that a court order is unnecessary as they do or will act to abide by the convention on genocide

As they essentially say Israel cannot be trusted especially given their initial dismissal to the claim till now

Two- any orgs military under israel control will take no further steps in continuing the above

Three- israel will take all reasonable steps possible to prevent genocide

Four- israel desists from all actions that it is considered to violate the convention (killing members…

Five- Israel desists from and takes step to prevent expulsion from their homes, provide access to food water clothes hygiene and medical supplies

Six- Israel shall ensure its military do not commit any acts that violate…
Measure 4 or 5 or take any public incitement of genocide and if they do steps are taken to punish them

Seven- Israel shall take effective measure to ensure the preservation of evidence within the scope of this case as will not deny or restrict access to fact finding missions
Eight- Israel shall submit a report to the court to show all actions it has taken to abide all these measures

Nine- Israel shall refrain from any action which might aggravate or make it more difficult to resolve this dispute
Okay so that’s the end of the case today South Africa has made its oral arguments and tomorrow the court shall hear Israel’s oral arguments at 12

Okay so imma 🧵 the Israeli oral arguments- the first remarks mentioned identity politics so we can all see where this is going but the crux of their argument at the moment is that they have not crossed the uniquely high threshold necessary to be committing genocide and that
South Africa has pained a distorted picture as well as its references to 1948 mirroring the “rejectionist rhetoric of Hamas” (they are going with the legal arm of Hamas argument) and inevitably they are justifying their actions with October 7th
