1/7An excellent piece by @FayeBrownSky that lays bare the sinister behaviour of @HMRCgovuk in circumventing the sham Morse review to pursue innocent taxpayers ensnared in #LoanCharge schemes. The underhandedness of the HMRC approach cannot be overstated.
2/7 In 2017, at the time #hmrc was duping MPs and Parliament into legislating a retrospective tax change with a 20 year lookback, they were also concocting controversial changes to existing PAYE regulations, amending those rules retrospectively to give themselves yet another
3/7 weapon to bludgeon innocent taxpayers. Was Morse made aware in 2019 of this hitherto unknown, backup gun that HMRC was loading up as a reserve? Of course he wasn't. Yet here we are, 5 years after Morse and 20+ years after these schemes started and HMRC is still pursuing
4/7 people using rules it seems it's able to make up as it goes along. MPs were assured that Morse included "concessions" for pre-2010 years. This has proven to be worthless, much like #LoanCharge legislation itself which was effectively rendered meaningless by this s684 change.
5/7 The consequences of this will be huge and @JimHarraHMRC has been warned many, many times. Successive FSTs have also been fully briefed by tax and legal professionals like @keithmgordon , @SarahEGabbai , @DrOsitaMba and @Ray_McCann55. But it seems that nobody has any effective
6/7 oversight of this out of control Gov agency, including @HuddlestonNigel . HMRC can issue statements about "helping people deal with large bills" but the reality is very different. Forced to sell homes, bankruptcy, family breakdown, careers ended and, sadly, lives ended.

2/7 Further action being taken via discretion HMRC claims it has to transfer PAYE liability to employees. The point has been made about the lack of serious action against individuals engaged as tax advisors or promoters who enrolled victims in these fraudulent schemes. A company

The activities of the business are familiar. The Directors used the schemes they promoted to reduce their own tax liability.

1/4 I made an FOI in 2021 when it became known that Jim Harra had sought support from HMRC SOLS on the "strength of HMRCs claim". whatdotheyknow.com/request/email_…
This requested correspondence between Jim and SOLS for a 3 month period
2/4 This was refused by HMRC citing Sections 31 &42 of FOI. I subsequently raised an official case with @ICOnews in Oct 2021 contesting HMRCs use of these and questioning whether the public interest test had been correctly applied. I've received a response from ICO. Pages 1 - 4
3/4 and pages 5 & 6 here. Given that the very nature of the FOI relates to the extent to which HMRC established a legal position & basis for #LoanCharge, I find it difficult to reconcile the idea that it can then state that public interest favours NOT publishing advice.
