NEW: Trump's team pushes back on the district attorney's argument that Nathan Wade's cell phone records are inadmissible and irrelevant.

Trump says that Judge McAfee should admit the evidence & allow the defense to call a witness to testify on the data.

documentcloud.org/documents/2444…
The state argued that Trump's team didn't provide sufficient notice of their intention to introduce the phone records through expert testimony.

Trump, however, says the prospective witness, Charles Mittelstadt, would not testify as an expert--he would just summarize the data. Image
Trump also argues that the cell phone data is admissible as "extrinsic impeachment" evidence and as relevant substantive evidence.

Specifically, Trump says, the cell phone records tend to show that the romantic relationship between Willis and Wade began before they say it did.

As for the state's suggestion that the cell phone data was obtained unlawfully, Trump's attorney, Steve Sadow, writes in a footnote that the claim is "patently frivolous."

"The records were obtained by valid subpoena issued to AT&T," according to the filing. Image

Gillen is up for David Shafer.

Gillen: Do you remember Merchant sending you a motion titled "motion to disqualify" Willis and Wade?

Bradley: Yes

Gillen: So you knew that she was gathering info in relation to a motion?

Bradley: at the time she sent it to me, yes

I'm in courtroom 5A, where Terrence Bradley--the former divorce attorney for special prosecutor Nathan Wade--is expected to resume his testimony as Judge Scott McAfee mulls whether to disqualify Fulton County District Attorney Fani Willis. 🧵👇

Watch:
Judge McAfee kicks off w/ a summary of why we're here:

After meeting w/ Bradley in private, I found that neither Wade nor Bradley carried their burden of establishing that attorney-client privilege applied wrt whether there was a relationship btween Willis and Wade.
Merchant, for Mike Roman, starts us off, asking Bradley about the timing of the relationship between Willis and Wade.

He says he has no knowledge of when the relationship began.

How in the world did Trump’s defense attorneys obtain the phone records of prosecutor Nathan Wade?

Don’t they need a court-authorized warrant for that?

Did the divorce lawyer for Wade’s estranged wife have anything to do with this?

You’ve got questions, I’ve got answers.🧵

1/
Let’s start with how they got the phone records.

Last week, Mike Roman’s counsel, Ashleigh Merchant, told Judge McAfee that she sent a subpoena to Wade’s phone provider, AT&T, on or about Feb. 9.

That tracks with the affidavit of Trump and Roman’s private investigator.

Some of you pointed out that the PI’s affidavit uses the term “request for records” rather than "subpoena."

But that’s just another way of saying “subpoena.”

I reached out to Roman’s counsel, Merchant, who told me that she signed a subpoena for the phone records.

NEW THREAD ON FULTON COUNTY HEARING:

We're back from lunch and Terrence Bradley has finally arrived to testify.

🧵👇
Bradley looks glum. He's not happy to be here.

Merchant, on behalf of Roman, begins by asking him about communications that she says she had with Bradley in the fall of 2023.

She has text messages that she says she exchanged w/ Bradley around that time.
Merchant: Did I text you asking if I could get an affidavit about the affair [between Wade and Willis]? And you said "No, no one would freely burn that bridge?"

Bradley: Yes, I do see that.

Nathan Wade says that he didn't date anyone in 2020 because he was battling cancer.

He re-affirms his testimony that they didn't begin dating until 2022.

Wade: "2022 was the start of any intimate, sexual relationship with the district attorney."

NEW THREAD: I'm in court observing the evidentiary hearing on whether district attorney Fani Willis should be disqualified from prosecuting Trump and others.

Special prosecutor Nathan Wade is on the stand.

Catch up in my first thread below 👇🧵
Merchant: Have you been to the condo where Willis lived in Hapeville?

Wade: Yes. I never spent the night there.

Merchant: Were other members of DA's staff ever there?

Wade: Not that I'm aware of...
It sounds like we're about to take a lunch break.

Merchant: Did you discuss your relationship w/ Ms. Willis in social settings?

Wade: What do you mean.

Merchant: Your romantic relationship.

Wade: No, ma'am. Our relationship wasn't secret, but we're just private people.
